‫اإلقليم ‪:‬‬
‫ألغراض هذه االتفاقية ‪ ,‬يعتبر إقليم دولة ما المناطق البرية‬
‫والمياه اإلقليمية المتاخمة لها المشمولة بسيادة تلك الدولة‬
‫أو سلطتها أو حمايتها أو انتدابها‪0‬‬

‫المادة (‪)3‬‬
‫الطائرات المدنية وطائرات الدولة ‪:‬‬
‫ا‪ -‬تطبق هذه االتفاقية على الطائرات المدنية فقط وال تطبق على طائرات الدولة‬
‫ب‪ -‬تعتبر الطائرات المستعملة في خدمات عسكرية أو جمركية أو خدمات‬
‫الشرطة من طائرات الدولة‬
‫ج‪ -‬اليجوز الى طائرة من طائرات الدولة التابعة لدولة متعاقدة ان تطير فوق‬
‫إقليم دولة أخرى او إن تهبط إذا كانت قد حصلت على ترخيص بذلك عن‬
‫طريق اتفاق خاص او بأية طريقة أخرى ‪ ,‬وطبقا لشروط ذلك تتعهد الدول‬
‫المتعاقدة بان تأخذ في االعتبار الواجب سالمة المالحة للطائرات المدنية‬
‫عندما تضع المتعلقة بطائرات الدولة التابعة لها‬

‫استعمال الطيران المدني‪:‬‬
‫توافق كل دولة على أال تستعمل الطيران المدني فى اى غرض‬
‫اليتفق مع أهداف هذه االتفاقية‬

‫انظمة الدخول والخروج ‪:‬‬
‫ان القوانين واألنظمة المعمول بها فى دولة متعاقدة بصدد دخول‬
‫ركاب الطائرات وطواقمها والبضائع المنقولة عليها الى إقليمها‬
‫او خروجهم منه كاألنظمة المتعلقة بالدخول والخروج والهجرة‬
‫والجوازات والجمارك والصحة تتبع عند دخول إقليم تلك الدولة او‬
‫الخروج منه او أثناء البقاء فيه بواسطة او بالنيابة عن هؤالء‬
‫الركاب أو الطواقم او فيما يتعلق بهذه البضائع‬

‫المغادرة ‪ ,‬وأن تفحص الشهادات والمستندات األخرى‬
‫المنصوص عليها فى هذه االتفاقية بدون أن تسبب تأخير‬
‫غير معقول‬

‫تقارير التسجيل ‪:‬‬
‫تتعهد كل دولة متعاقدة بأن تقدم على بناء على طلب ‪,‬الى اية دولة متعاقدة أخرى أو الى‬
‫منظمة الطيران المدني الدولي ‪ ,‬المعلومات بخصوص تسجيل وملكية كل طائرة مسجلة‬
‫فى تلك الدولة‬
‫وباإلضافة الى ذلك تقدم كل دولة متعاقدة الى منظمة الطيران المدني الدولي ‪ ,‬طبقت‬
‫لألنظمة الى تقررها هذه المنظمة ‪,‬تقارير تحتوى على البيانات المالئمة التى تستطيع‬
‫إتاحتها عن ملكية وإدارة الطائرات المسجلة فى تلك الدولة والمستعملة عادة فى‬
‫المالحةالجويةالدولية‪ 0‬وتضع منظمة الطيران المدني الدولي البيانات التي حصلت‬
‫عليها بهذه الطريقة تحت تصرف الدول المتعاقدة األخرى بناء على طلبها‬

‫المادة(‪)29‬‬
‫المستندات التى تحمل على الطائرات‪:‬‬
‫تحمل على كل طائرة تابعة لدولة متعاقدة وتعمل فى المالحة الدولية المستندات‬
‫اآلتية طبقا للشروط المنصوص عليها فى ةهذه االتفاقية‪:‬‬
‫‪ .1‬شهادة تسجيلها‬
‫‪ .2‬شهادة صالحيتها للطيران‬
‫‪ .3‬الرخص المالئمة لكل من أعضاء طاقمها‬
‫‪ .4‬سجل رحالتها‬
‫‪ .5‬رخصة جهازها الالسلكي اذا كان بها مثل هذا الحهاز‬
‫‪ .6‬قائمة بأسماء الركاب وأماكن المغادرة والمقصد و اذا كانت تحمل ركاب‬
‫‪ .7‬قائمة بالبضائع وإقرارات تفصيلية بشأنها ‪ ,‬اذا كانت الطائرة تحمل بضائع‬

‫المادة (‪)30‬‬
‫جهاز الالسلكي بالطائرات ‪:‬‬
‫اليجوز لطائرات كل دولة متعاقدة ‪ ,‬أن تحمل جهاز إرسال السلكي أثناء وجودها‬
‫فى إقليم دولة متعاقدة أخرى أوفوق ذلك اإلقليم ‪ ,‬إال إذا كانت السلطات‬
‫المختصة قى الدولة المسجلة فيها الطائرة قد أصدرت ترخيصا بتركيب مثل‬
‫هذا الجهاز وتشغيله‬
‫ويكون استعمال جهاز اإلرسال الالسلكي داخل إقليم الدولة المتعاقدة التي تطير‬
‫الطائرة فوقها خاضعا لألنظمة التي تضعها هذه الدولة‬
‫اليجوز ان يستعمل جهاز اإلرسال الالسلكي اال أعضاء طاقم الطيران الذين لديهم‬
‫رخصة خاصة لهذا الغرض صادرة من السلطات المختصة فى الدولة‬
‫المسجلة فيها الطائرة‬

‫المادة(‪)31‬‬
‫شهادات الصالحية للطيران‪:‬‬
‫تزود كل طائرة تعمل فى المالحة الدولية بشهادة صالحية‬
‫للطيران صادرة أو معتمدة من الدولة المسجلة فيها الطائرة‬

‫المادة (‪)32‬‬
‫رخص طاقم القيادة‪:‬‬
‫يشترط فى طاقم كل طائرة تعمل فى المالحة الدولية وباقي أعضاء‬
‫طاقم قيادتها أن يكون لديهم شهادات أهلية ورخص صادرة أو‬
‫معتمدة من الدولة المسجلة فيها الطائرة‬
‫(ب)تحتفظ كل دولة متعاقدة بحقها في عدم االعتراف ‪ ,‬فيما يتعلق‬
‫بالطيران فوق إقليمها و بشهادات األهلية والرخص التي‬
‫تمنحها آلى من رعاياها دولة متعاقدة أخرى‬

‫المادة (‪)33‬‬
‫االعتراف بالشهادات والرخص‪:‬‬
‫تعترف الدول المتعاقدة األخرى بصحة شهادات الصالحية‬‫للطيران وشهادات األهلية والرخص الصادرة او المعتمدة من‬
‫الدولة المتعاقدة المسجلة بها الطائرة ‪ ,‬بشرط ان تكون الشروط‬
‫التي أصدرت أو اعتمدت بمقتضاها تلك الشهادات أو الرخص‬
‫معادلة أو أعلى من الحد األدنى للقواعد القياسية التى قد تقرر‬
‫من وقت آلخر تطبيقا لهذه االتفاقية‬

‫المادة (‪)34‬‬
‫سجالت الرحالت ‪:‬‬
‫يحتفظ لكل طائرة تعمل فى المالحة الدولية بسجل رحالت‬
‫تقيد به البيانات عن الطائرة وطاقمها وعن كل رحلة من‬
‫رحالتها ‪ ,‬وذلك بالشكل التي يقرر من وقت ألخر تطبيقا‬
‫لهذه االتفاقية‬

‫المادة (‪)38‬‬
‫الخروج عن القواعد القياسية واإلجراءات الدولية‪:‬‬
‫على أية دولة ترى أنها يتعذر عليها عمليا االمتثال فى كل الوجوه الى من هذه القواعد‬
‫القياسية أو اإلجراءات الدولية أوجعل أنظمتها أو إجراءاتها الخاصة متفقة تماما مع أى‬
‫من القواعد القياسية أو اإلجراءات الدولية بعد تعديل هذه اإلجراءات ‪ ,‬أو ترى من‬
‫الضروري اعتماد أنظمة أو إجراءات مختلفة فى ناحية معينة عن األنظمة أو‬
‫اإلجراءات التي قررتها قاعدة قياسية دولية أن تبلغ فورا منظمة الطيران المدني الدولي‬
‫باالختالفات بين إجراءاتها الخاصة وبين اإلجراءات التي قررتها القاعدة القياسية‬
‫الدولية‪ 0‬وفى حالة التعديالت القياسية الدولية ‪,‬فعلى كل دولة ال تدخل على أنظمتها‬
‫أواجراءاتها التعديالت المالئمة أن تخطر المجلس خالل الستين يوما التالية العتماد‬
‫القاعدة القياسية الدولية أو توضح اإلجراء الذى تعتزم ا تخاذه‬
‫وفى هذه األحوال ‪ ,‬يبلغ المجلس فورا جميع الدول األخرى باالختالف القائم بين عنصر أو‬
‫أكثر من عناصر القاعدة القياسية الدولية‪ ,‬المعنية وبين ما يقابلها من اإلجراءات الوطنية‬
‫فى تلك الدولة‬

‫المادة (‪)40‬‬
‫صالحية الشهادات والرخص التي بها إضافات‪:‬‬
‫اليجوز ألية طائرة او عضو فى طاقم طائرة ممن لديهم شهادات او‬
‫رخص بها إضافات أن يشتركوا فى المالحة الجوية ‪ ,‬إال إذا كان ذلك باذن‬
‫من الدولة او الدول التى يطيرون فوق أرضها‬
‫أما مسأ لة تسجيل أو استعمال مثل هذه الطائرة ‪ ,‬أو أى جزء تشمله الشهادة‬
‫من أجزاء الطائرة ‪,‬‬
‫فى دولة غير الدولة التي أصدرت فيها شهادتها أصال ‪ ,‬فيترك لتقدير الدولة‬
‫تستورد إليها الطائرة أو جزء الطائرة‬

‫المادة (‪)41‬‬
‫االعتراف بالقواعد القياسية القائمة الخاصة بأهيلة أفراد طاقم القيادة‪:‬‬
‫ال تسرى أحكام هذا الفصل على أفراد طاقم القيادة الذين أصدرت‬
‫رخصهم فى األصل قبل انتهاء السنة التالية للتاريخ الذي تعتمد فيه‬
‫ألول مرة قاعدة قياسية دولية بخصوص أهلية هؤالء األفراد‬
‫ولكن هذه األحكام تسرى على أية حال على جميع أفراد الطاقم الذين تبقى‬
‫رخصهم صالة لمدة خمس سنوات بعد تاريخ اعتماد مثل هذه القاعدة‬
‫القياسية‬

‫إن غايات وأهداف المنظمة هي العمل على تطوير مبادئ وتقنيات المالحة الجوية الدولية وعلى تعزيز تخطيط النقل الجوى‬
‫الدولي وتطويره من أجل ماياتى‪:‬‬
‫تأمين النمو المأمون والمنظم للطيران المدني الدولي في جميع أنحاء العالم‬
‫تشجيع فنون تصميم الطائرات وتشغيلها ألغراض سلمية‬
‫تشجيع تطوير الطرق الجوية والمطارات ومرافق المالحة الجوية للطيران المدني الدولى‬
‫تلبية احتياجات شعوب العالم إلى نقل جوى يتسم باألمان واالنتظام والكفاءة واالقتصاد‬
‫منع الهدر االاقتصادى الناتج عن المنافسة غير المعقولة‬
‫تأمين االحترام الكامل لحقوق الدول المتعاقدة وإتاحة فرصة عادلة لكل دولة متعاقدة لتشغيل مؤسسات للنقل الجوى الدولى‬
‫تجنب التمييز بين الدول المتعاقدة‬
‫تعزيز سالمة الطيران فى المالحة الجوية ةالدولية‬
‫تعزيز تطور جميع جوانب الطيران المدني الدولي بوجه عام‬

‫المادة (‪ )83‬مكرر‬
‫نقل بعض المهام والواجبات ‪:‬‬
‫بغض النظر عن أحكام المواد (‪ )12‬و (‪ )30‬و(‪ )31‬و (‪( )32‬ا) ‪,‬وعند تشغيل طائرة مسجلة‬
‫فى دولة متعاقدة بموجب اتفاق إليجار أاستئجار أو تبادل الطائرة أو بموجب أال ترتيب‬
‫مماثل بواسطة مشغل يون مركز أعماله الرئيسي ‪ ,‬أو يكون محل إقامته الدائمة أن لم يكن‬
‫له مركز عمل رئيسي فى دولة متعاقدة أخرى يجوز لدولة التسجيل ‪ ,‬باالتفاق مع تلك‬
‫الدولة األخرى أن تنقل اليها كل أو بعض مهامها أو واجباتها كدولة تسجيل بالنسبة لتلك‬
‫الطائرة بموجب المواد (‪ )12‬و (‪ )30‬و (‪ )31‬و (‪( )32‬ا) ‪ 0‬وتعفى دولة التسجيل من‬
‫المسئولية فيما يتعلق بالمهام والواجبات المنقولة ‪0‬‬
‫اليصبح النقل نافذا بالنسبة لدول متعاقدة أخرى قبل أن يكون االتفاق الذي يتضمنه قد سجل‬
‫لدى المجلس وأعلن وفقا للمادة (‪ , )83‬أو قبل أن تكون سلطات الدولة أو الدول المتعاقدة‬
‫األخرى المعنية قد أخطرت مباشرة بوجود االتفاق ونطاقه بواسطة دولة طرف فى االتفاق‪0‬‬
‫تسرى أحكام الفقرتين (ا) و(ب) أعاله كذلك على الحاالت التى تشملها المادة(‪0 )77‬‬

application of units of measurement and termination

International System of Units (SI) and guidance on the
application of the SI, conversion factors, Coordinated
Universal Time (UTC), and presentation of date and

Part I — International Commercial Air Transport —
Aeroplanes.
This document specifies international Standards and
Recommended Practices for aeroplanes used in
international commercial air transport operation carrying
passengers or freight. The Annex addresses flight
operations; performance operating limitations; aeroplane
instruments, equipment and flight documents; aeroplane
communication and navigation equipment; aeroplane
maintenance; flight crew; flight operations officers/flight
dispatchers; manuals, logs and records; cabin crew;
security; lights to be displayed in the air and on the ground
during operations; contents of an operations manual; and
flight time and flight duty period limitations.

Annex 7
Aircraft Nationality and Registration Marks.
This Annex contains standards adopted by ICAO as
the minimum standards for the display of marks
to indicate appropriate nationality and
registration marks which have been determined
to comply with Article 20 of the Convention.
The provisions in the Annex provide definitions,
location and measurement of nationality and
registration marks as well as the standard form
for the certificate of registration.

Annex 8
Airworthiness of Aircraft.
This Annex contains the Standards and Recommended
Practices for the airworthiness of aircraft. Part I of the
Annex provides definitions. Part II contains general
airworthiness procedures applicable to all aircraft
together with the
standard format for the certificate of airworthiness. Part
IIIA contains the Mimum airworthiness characteristics
of aeroplanes over 5 700 kg for which application for
certification was submitted on or after 13 June 1960.
Part IIIB contains the minimum airworthiness
characteristics of aeroplanes over 5 700 kg for which
application for certification will be submitted on or
after 2 March 2004. Part IV contains the minimum
airworthiness characteristics of helicopters.

Annex 9
Facilitation.
Annex 9 contains Standards and Recommended
Practices, and related definitions and appendices
concerning the facilitation of international air
transport. They are the outcome of Article 37 of
the Convention on International Civil Aviation
which requires ICAO to adopt international
Standards and Recommended Practices dealing
with, inter alia, customs and immigration
procedures and such other matters concerned
with the safety, regularity and efficiency of air
navigation.
