New Era: 특허전쟁의 시대
‘특허 괴물’들의 사업 전략은 간단하지만 위력적이다. 이들은 중소기업, 폐
업한 회사, 개인 발명가 등이 보유하고 있는 ‘상당한 가치가 있지만 거의 평
가 받지 못한 특허’들을 헐값에 대량으로 구입한다. 이 특허는 그들의 공격
무기다.
이들은 노키아, 삼성전자, 인텔, 델 등 ‘돈 많은 기업’들을 상대로 ‘당신들의
제품이 우리가 보유한 특허를 침해하고 있으니 그만큼 로열티를 물어 내라’
고 통보하고, 이를 받아들이지 않을 경우 소송에 나선다. 대표적 특허괴물로
꼽히는 인터디지털은 2005년 세계 1위 휴대폰 제조업체인 핀란드 노키아에
유럽식 이동통신 표준(GSM)관련 특허 소송을 제기해 2억5000만 달러에 이
르는 특허료를 받아냈다. 미국 유럽 등 해외시장에 진출해 있는 삼성전자도
인터디지털과의 소송에 패해 670만 달러의 로열티를 지급했다. LG전자는
아예 인터디지털과의 싸움에 승산이 없을 것으로 판단, 소송을 포기하고
2006년부터 2008년까지 해마다 9500만 달러씩 모두 2억8500만 달러의 로
열티를 주는 것으로 이야기를 마무리 지었다.
New Era: 특허전쟁의 시대
2000년 들어 특허가 거래대상이 되기 시작함.
- 당장 만든 사람에게는 필요치 않더라도, 다른 이에게는 요긴히 쓰일 수 있는 특허의 발견.
- 특허거래시장 규모 : 2001년 2억달러 → 2008년 14억 달러
초기 NPE(Non Practicing Entities)
- 특허를 필요한 곳에 재판매, 대여
- 경매시장 개설
(오션토모-2006년 최초로 오프라인 특허경매 시작)
특허괴물
- 싼 값에 대량으로 특허를 사들인 다음 기
업을 상대로 기술 특허 사용료나 소송합의
금을 챙기는 기업.
직접 제품을 생산, 판매하지 않음.
- “발명가에게 공정한 보상을 해주고
기업이 정당하게 이용하는
특허생태계를 만들 뿐.”
이후, 특허침해여부 전문조사기업 등장

상 3만5000~490만달러.
AST(Allied Security Trust) – 시스코, 에릭슨, 구글, 모토로라가 가입한 특허방어펀드
아이큐브 파트너스 – 우리나라 정부 자금이 투입된 특허펀드 운영회사
인텔렉추얼 디스커버리 - 민관 합동의 제1호 한국형 창의자본주식회사.
2010년9월 출범, 특허포트폴리오 작성, 특허풀 구축.
특허 생태계 구축
미국 – IPXI (IP Exchange International) 설립, 특허권을 주식처럼 거래하도록 중개
