Purpose of the Circular
• To restate the purpose of the Minimum
Competency Level Regulations
• To introduce the concept of “Special
Merit Cases”
• To clarify what constitutes proof of
competency

Special Merit Cases
• Applies to officials currently employed by the
municipality
• To be considered, an official must be in the
process of attaining the minimum
competency level
• If approved, an official will have an extension
up to eighteen months (July 1, 2014)

Special Merit Cases cont’d
• To be considered for Special Merit status, the
municipality must apply to National Treasury
not later than September 7, 2012
• Approval is not automatic
• If approved, progress will be monitored by
National Treasury
• Special Merit Status may be withdrawn at
any time

New Officials
• All officials appointed after April 2012 should
meet the Minimum Competency Level
• If not, the municipality must apply to
National Treasury, seeking consideration to
delay the Regulation for that official
• The municipality must explain to National
Treasury why the municipality was unable to
appoint a duly qualified person

Conclusion
• Circular 60 provides municipalities with some
“breathing space” in terms of compliance
with the Regulation
• If Special Merit status is approved, the official
receives an extension, NOT an exemption
• Every new appointment must meet the
minimum competency level
• THE TIME TO ACT IS NOW!!
