Notice to parents of non-compliance of attendance policies.

Every student who has 3 or more unexcused

absences will receive this notice in the mail.

Notice of absences are now automated and are sent to each campus by the dept. of student retention and truancy.

  Students who are at least

six years of age

, or who have been previously enrolled in first grade, and who have not yet reached their

18th birthday

shall attend school for the entire period the program is offered. If the student is absent from school on ten or more days or parts of days within a six-month period in the same school year or on three or more days or parts of days within a four-week period , the student’s parent is subject to prosecution under Education Code 25.093, and the student is subject to prosecution under Education Code 25.094

 ◦ If a student fails to attend school without excuse on ten or more days or parts of days within a six-month period in the same school year, the District shall within ten school days of the student’s tenth absence : File a complaint against the student or the student’s parent or both in a county, justice, or municipal court for an offense under Education Code 25.093 or 25.094, as appropriate.

 Texas Education Code TEC 25.092 states “a student may not be given credit unless the student is in attendance for at least 90 percent of the days the class is offered.”The number of excused and unexcused absences are combined to determine the total of absences per class, even if student is passing the class

Fall semester- Student loses credit on the 5th absence.

Spring Semester- Student loses credit on the 6 th absence.

Early Intervention

When Student is Violating the attendance policy between 90-75% Rule the student will meet with Early Intervention Team.

Unexcused Excused Court Referral Intervention Contract Make up assignments Ensure Proper Documentation Make up assignments Additional Intervention if needed Additional Intervention if needed ***Students who have exceeded the 75% must meet with the legal attendance review committee. ***

 Interventions are decided on a case by case basis by the Early Intervention Team.  Early Intervention meetings with parent and student  Staff Intervention (At Risk Referral, LEP or SPED coordinator, counseling staff, etc. )  School-wide Parent Meetings  Additional services as appropriate and needed.

 Contract are issued in an effort to help parents and students avoid court fines and will be offered as an intervention when a student receives a Notice of Absence (Not Mandatory).

 Agreements are between parent, student and administrator.

 It is an agreement with conditions to work together on improving student attendance. ◦ If conditions are met and attendance improves, then school will request for favorable considerations with justice of the peace. **Conditions are made on a case by case basis. **

Notice of meeting for individual credit appeal will be mailed. Parent/adult student/ or guardian will decide on one of the following: *attend scheduled meeting- No further action needed *reschedule- request in writing *opt not to attend complete form allowing committee to proceed .

Committee will review and decide on one of the following: * Reinstate- no further action needed *Learning Activity Must complete plan for credit reinstatement *Deny Credit- may appeal to the board and further actions required will be provided at that time.

 A letter will be sent out with the time and date for each student with a 5-10 minute time frame.  If parent cannot attend we can reschedule, however, it may delay the process. If unable to attend with parent permission we can proceed without parent being present.  Parent and/or student may be represented at this hearing and may present documentation for extenuating circumstances at this time.

 All decisions will be made on a case by case basis.  If the committee denies a student credit or a final grade, the student may appeal the decision to the Board.

 Folders will be provided with call log and district calendar.  Gather all documentation for extenuating circumstances.  Log any calls/notes from this day forward  Try to schedule appointments during any breaks/holidays.
