Проект ЄС “Виконання Україною зобов’язань щодо членства в СОТ та реалізації Європейської політики добросусідства в сільському секторі (секторальний підхід)” Ways of Solution The following legal acts need to be immediately brought in line with existing legislation: - the law On Agricultural Cooperation. - Model Charters of the Agricultural Service Cooperative and that of the Agricultural Service Cooperative & Commercial Agri Firm. - all training-methodical manuals and guidelines for setting up and running an agricultural service cooperative. Проект ЄС “Виконання Україною зобов’язань щодо членства в СОТ та реалізації Європейської політики добросусідства в сільському секторі (секторальний підхід)” Problem 4 The stage of setting up a service co-op: Lack of informational materials and guidelines at local level Lack of awareness on principles of ASC activities Lack of experience in realistically assessing and drafting cooperatives activities programmes Lack of experience in drafting statutory documents and in propping up its interests in tax authorities; Проект ЄС “Виконання Україною зобов’язань щодо членства в СОТ та реалізації Європейської політики добросусідства в сільському секторі (секторальний підхід)” Possible ways of solution! - provide rural communities with accessible information and educational materials; - carry out trainings and advise the initiative groups` members on the following topics: how to develop a business plan and set up a cooperative; how to develop draft statutory documents how to elaborate internal rules of a cooperative how to prepare and hold a constituent assembly state registration of a cooperative Проект ЄС “Виконання Україною зобов’язань щодо членства в СОТ та реалізації Європейської політики добросусідства в сільському секторі (секторальний підхід)” Problem 5 The stage of organizing the economic activities of service co-ops: • Material inputs should be provided; • A co-operative while working on a contractual basis with its members/clients should develop together with them a programme of economic activities stipulating the following: members shall fulfill their written commitments concerning their participation in the cooperative`s economic activities the cooperative shall fulfill its obligations concerning the quality of service provision Проект ЄС “Виконання Україною зобов’язань щодо членства в СОТ та реалізації Європейської політики добросусідства в сільському секторі (секторальний підхід)” Possible Ways of Solution! - economically justify the optimal type of cooperative association - identify the optimal size of entrance and lands share contributions - assess the cooperative members capacities to participate in furnishing the material and technical input for the cooperative and in its economic activities - provide information on possible forms and sources for furnishing the material and technical inputs for the cooperative Проект ЄС “Виконання Україною зобов’язань щодо членства в СОТ та реалізації Європейської політики добросусідства в сільському секторі (секторальний підхід)” Problem 6 Organization of accounting activities??? -keeping accounts of the number of cooperative’s members and share capital; - keeping account of each member’s participation in the economic activities of the cooperative; - pricing of the cooperative’s services; - formation and accounting of the cooperative’s assets and of cooperative benefits and shares Проект ЄС “Виконання Україною зобов’язань щодо членства в СОТ та реалізації Європейської політики добросусідства в сільському секторі (секторальний підхід)” Problem 7 Organization of tax accounting activities • deciding on a taxation system to choose (general, simplified, non-profit); • deciding on what should be the taxation activities of a service cooperative when it accepts the role of a tax agent in relation to its members; • deciding on VAT (non)payer status • providing a transparent tax base which will include an off-balance accounting of agricultural products brought by cooperative’s members for storage, processing and packaging.
