Buenos Aires Declaration June 2010 • Request for the follow up group to collaborate, together with the IFRC , in sketching a Regional Compendium which model was analyzed during this meeting on the basis of IDRL guidelines Quito Declaration 2011 • Adopted the model of Regional Compendium Disaster Laws Process of Consolidation RLC www.ifrc.org Saving lives, changing minds. An early draft of the Compendium was presented in the Bs As meeting Follow up group: Bs As Declaration: host countries of the past EIHP meeting: Mexico, Brazil, Argentina and Ecuador as the next host country, OCHA and the IFRC Virtual meeting Aug. 2010 Follow- up group workshop Dec. 2010 Final draft (April 2011) Approval: Quito Declaration Disaster Laws Purpose of the RLC Facilitate the work of governments in the region in the process of assembling, in the framework of domestic legislation, relevant information on the regulation and facilitation of international humanitarian aid in cases of disasters, as outlined in the IDRL Guidelines Allow governments of the region to identify the strengths of their national legislation regarding disaster prevention and relief, as well as those areas where regulatory frameworks could be strengthened in anticipation of future disasters; Allow a rapid exchange of information about existing legal procedures in different countries of the region during an emergency or disaster; and, Constitute a tool to enhance mutual cooperation between countries and other international actors providing assistance emergencies or disasters. www.ifrc.org Saving lives, changing minds. • COUNTRY PROFILE Disaster Laws Structure of the RLC 1. Ejemplo de Directrices Modelo de Compendio Normativo Regional Leyes IDRL/ implicadas Autoridad En caso de desastres, actualmente no existen Artículo 10º · 6 establecidos procedimientos legales que de la Ley Nº garanticen la supervisión y fiscalización del uso y 28905. (UIF) destino de ayuda de carácter humanitario. Sin Ley N° 27693 embargo, por el artículo 10º de la Ley Nº 28905, la y Ley N° Contraloría General de la República tiene 29038. facultades de coordinación con los sectores de fiscalización correspondientes. Es menester indicar que también actúa la Unidad de Inteligencia Financiera de la Superintendencia de Banca, Seguros y AFP para evitar el lavado de activos. Finalmente, debemos indicar que existe también para el caso de la distribución de la Ayuda Humanitaria algunos instrumentos para la actuación que facilitan el posterior control como por ejemplo las Planillas de Distribución Final de Bienes de Ayuda Humanitaria .
