The divorce process
 Getting married (The Matrimonial Causes Act
1973)
 who are not closely related
Who are of the opposite sex to one another
Not already married
Who are aged over 18 ,or over 16 with parental consent,
to marry
Special rules allow those who are not domiciled in
England or Wales to marry polygamouslyoutside of
England or Wales.
The parties have the capacity to marry
The Marriage Act 1949

The ground for divorce
 This irretrievable breakdown may be
shown in one of five ways :
1. Has adulter and finds it intolerable to live with
him or her
2. Behavior
3. Has deserted ( two years)
4. Have lived apart (at least two years)ตามที่ตกลงที่ศาล
5. Have lived apart (at least five years)
The procedure for obtaining a divorce
The divorce will proceed under the special
procedure. If the judge is not satisfied he
or she can ask for further evidence and if
necessary there can be a hearing relating
to the child.
Drafting a petition
 Use an overall structure,whether it be chronogical or
putting the worst allegations first and then lesser
allegations.
 Put each allegation in a separate numbered paragraph.
 Draft each allegation concisely and clearly.
 If there are many allegations,choose the strongest.
 Allege facts,not evidence.
 Try to include specific actions rather than generalisations
and emotions.
 Choose appropriate vocabulary, to put the client’s words
into a suitable form for presentation to the court.
