The Disabled In A Changed World
The tragic events of September 11th, 2001 stunned, shocked, and saddened the
world. That day also demonstrated how critical emergency planning and
preparedness are – whatever the nature and scope of the problem.
And as stories from 9/11, both sad and heroic, have emphasized, individuals with
disabilities have to be better prepared in an emergency.
In our changing world, there is a new focus on disaster readiness for individuals
with disabilities. We believe that proactive responses are wisest and safest in
preparing for an unpredictable future.
New Threats, New Liabilities
To the old threats of fire and natural disasters, there is a new threat —
terrorism.
For the owners, managers, administrators, and tenants of buildings where the
disabled live, work, shop, attend school, travel, and find recreation, there are
threats of another kind – lawsuits and liabilities that could be ruinous.

According to a late 2001 Harris Poll survey released by the National Organization
on Disability (N.O.D.), among those people with disabilities who are employed
full
or part time, 50% say no plans have been made to safely evacuate their
workplace.

prepared, but people with disabilities lag behind everyone else. This is a critical
discrepancy because those of us with disabilities must in fact be better prepared
so we are not at a disadvantage in an emergency.”

Do You Have A Plan?
Do you have a plan for evacuating people from your facility? Of course you
do. Does it effectively address the safe evacuation of people with disabilities?
It better.
The ADA requires that your facility plan safely evacuates people with disabilities.
Developing A DEP Is The Law In The United States
 (ADAAG Appendix) A4.3.10 Egress Because people with disabilities may visit,
be employed or be a resident in any building, emergency management plans with
specific provisions to ensure their safe evacuation also play an essential role in
fire safety and life safety.
28 CFR §35.105 & DOJ Title II T.A. Manual pp. 40-43 “The following areas need
careful examination in a self-evaluation: …whether emergency evacuation
warnings and procedures are adequate to protect people with disabilities.”
Title III – 4.2100 A public accommodation must reasonably modify its policies,
practices or procedures to avoid discrimination. Facilities are obligated to modify
evacuation procedures to provide alternate means for individuals with mobility
impairments to be safely evacuated. Facilities must also modify their evacuation
plans to take into account the needs of people with visual, hearing, and other
disabilities.

Kevin G. McGuire, Chairman & CEO
Kevin McGuire is Chairman & CEO of McGuire Associates, Inc., a leading consulting firm
specializing in issues of compliance with federal and state disability related laws since 1991.
Over the past 11 years, Kevin has developed a solid reputation for assisting large
organizations in effectively and proactively meeting the standards prescribed by ADA
regulations. Kevin’s own spinal cord injury has afforded him particular insight into and
appreciation for issues surrounding persons with disabilities.
Prior to founding McGuire Associates, Inc., Kevin served as Assistant District Attorney/Staff
Assistant in Bronx County, New York, for four years. He also worked as a Staff Assistant for
U.S. Congressman, Hamilton Fish, Jr., and U.S. Senator, Edward M. Kennedy. Kevin assisted
in drafting legislation for the Massachusetts Rehabilitation Commission and worked with the
California Governor’s Office of Employment of People with Disabilities to develop public
service announcements. In addition, Kevin has a background in motion pictures and
television productions. Kevin had an onscreen featured role in “Born on the Fourth of
July”. He also served as a technical advisor in “Born on the Fourth of July” and in
“Gattica”.
Kevin graduated with a law degree from Georgetown University and a B.A. from Boston
University.
