Hazardous Waste Exemptions
A Special Rule Applies to As-Generated Wastes
40 CFR 261.3(g)(1) – Wastes listed solely for
Listed Solely for Exhibiting a Characteristic
ignitability, corrosivity, or reactivity (I,C,R) that do not
exhibit the characteristic at the point of generation are not
hazardous waste.
There are 29 waste codes that are listed for I, C, or R.

maintenance, not home-based meth labs or auto repair waste from a homebased shop)
– Includes household-like areas (bunkhouses, campgrounds, picnic grounds,
but not hotel-based drycleaners)

Recycling Requirements for Specific

Other materials not subject to
regulation when recycled:
• Industrial ethyl alcohol that is
reclaimed
• Scrap metal (not already excluded)
• A variety of reclaimed oils and oilderived fuels associated with oil
refining
• Coke and coal tars containing
hazardous wastes from the iron and
steel production process (K087)
