Hazardous Waste Exemptions and Exclusions Hazardous Waste Exemptions A Special Rule Applies to As-Generated Wastes 40 CFR 261.3(g)(1) – Wastes listed solely for Listed Solely for Exhibiting a Characteristic ignitability, corrosivity, or reactivity (I,C,R) that do not exhibit the characteristic at the point of generation are not hazardous waste. There are 29 waste codes that are listed for I, C, or R. 7/18/2015 2 Hazardous Waste Exclusions 40 CFR 261.4(b) Solid wastes which are not hazardous wastes. The following solid wastes are not hazardous wastes: 7/18/2015 3 Hazardous Waste Exclusions 40 CFR 261.4(b) Household Hazardous Waste 261.4(b)(1) Agricultural Waste 261.4(b)(2) Mining Overburden 261.4(b)(3) 7/18/2015 4 Hazardous Waste Exclusions • Household Hazardous Waste – wastes generated by normal household activities (routine house and yard maintenance, not home-based meth labs or auto repair waste from a homebased shop) – Includes household-like areas (bunkhouses, campgrounds, picnic grounds, but not hotel-based drycleaners) Special Regulatory Conventions 7/18/2015 5 Hazardous Waste Exclusions 40 CFR 261.4(b) Agricultural Waste 261.4(b)(2) Mining Overburden 261.4(b)(3) 7/18/2015 6 Hazardous Waste Exclusions 40 CFR 261.4(b) Fossil Fuel Combustion Waste (Bevill) 261.4(b)(4) Oil, Gas, and Geothermal Wastes (Bentsen Amendment) 261.4(b)(5) Trivalent Chromium Wastes (requires a demonstration) 261.4(b)(6) Mining and Mineral Processing Wastes (Bevill) 261.4(b)(7) Cement Kiln Dust (Bevill) 261.4(b)(8) 7/18/2015 7 Hazardous Waste Exclusions 40 CFR 261.4(b) Arsenically Treated Wood 261.4(b)(9) Petroleum Contaminated Media & Debris from 261.4(b)(10) Underground Storage Tanks Injected Groundwater 7/18/2015 261.4(b)(11) 8 Hazardous Waste Exclusions 40 CFR 261.4(b) Spent Chlorofluorocarbon Refrigerants 261.4(b)(12) Used Oil Filters 261.4(b)(13) Used Oil Distillation Bottoms 261.4(b)(14) 7/18/2015 9 Hazardous Waste Exclusions 40 CFR 261.4(b) Landfill Leachate or Gas Condensate Derived 261.4(b)(15) from Certain Listed Wastes Solvent-contaminated wipes sent for disposal 7/18/2015 261.4(b)(18) 10 Hazardous Waste Exemptions Without Special Regulatory Conventions Some Wastes Might be Excludedwaste from Regulation • 261.4(c) – Hazardous which is generated in a product or raw material tank, transport vehicle, vessel, or pipeline, or in a manufacturing process unit is not subject to regulation until it exits the unit in which it was generated, unless the unit is a surface impoundment, or unless the hazardous waste remains in the unit for more than 90 days after the unit ceases to be operated. 7/18/2015 11 Hazardous Waste Exemptions Regulatory Conventions Some Wastes Might be • Excluded 261.4(d) from Regulation Samples of waste, water, soil, or air • 261.4(e) and (f) Treatability study samples • 261.4(g) Dredged material subject to a permit • 261.5 HW generated by a conditionally exempt small quantity generator 7/18/2015 12 Recycling Requirements for Specific HW - 40 CFR 261.6(a)(2) 40 CFR 261.6(a)(2) • Recyclable materials used in a manner constituting disposal • Hazardous wastes burned for energy recovery in boilers and industrial furnaces • Recyclable materials from which precious metals are reclaimed • Spent lead-acid batteries that are reclaimed 7/18/2015 40 CFR Part 266 Subpart C Subpart H Subpart F Subpart G 13 Recycling Requirements for Specific Hazardous Waste – 40 CFR 261.6(a)(3) Other materials not subject to regulation when recycled: • Industrial ethyl alcohol that is reclaimed • Scrap metal (not already excluded) • A variety of reclaimed oils and oilderived fuels associated with oil refining • Coke and coal tars containing hazardous wastes from the iron and steel production process (K087) 7/18/2015 14 Recycling Requirements for Specific Hazardous Waste - 40 CFR 261.6(a)(4) Used Oil: Special management standards in 40 CFR Part 279 • Includes used oil that is reused, re-refined, reclaimed, burned for energy recovery, or reprocessed 7/18/2015 15 Questions? 7/18/2015 16
