HB08-1388 School Finance
“Out-of-District” Placed Students
Removes facility pupils from districts’ counts for
FY2004-05, FY2005-06, 2006-07, and 2007-08 for the
purpose of excluding them from the pupil enrollment
and averaging in FY2008-09.
“Pupil Enrollment” does not include a pupil placed in a
facility as defined in 22-54-129(1)(c) and who is
receiving services through an approved facility school
as defined in 22-54-129(1)(a).
Districts will no longer count pupils in “out-of-district”
placement in facilities.

“Out-of-District” Placed Students
Facility students will be reported directly to CDE by
each “approved facility school” through the newly
established Facility School Unit.
No later than October 15, the Facility School Unit at
CDE will notify resident districts of pupils publicly
placed in an approved facility school. These
students will be counted by the approved facility
school.

Districts should remove or withdraw these students
from their October count and enrollment.
Districts will no longer bill CDE for non-district
students living in a facility or group home and
attending a district school.
Districts will include any student residing in a
facility or group home and attending a district
school in their October count for funding.

“Out-of-District” Placed Students
Districts which had out-of-district placed pupils in facilities in
FY2007-08 will receive $292 per pupil for the number of facility
pupils in the FY2007-08 count, for a total appropriation of
approximately $587,504.
The $292 per pupil is a separate appropriation and is not included
in Public School Finance Act Total Program funding.
Students in “out-of-district” placement attending public schools
will be counted in the pupil count of district of attendance.

“Supplemental Kindergarten Enrollment”
Kindergarten pupils will be counted as .5 FTE, but a factor of .58 FTE
will be used for funding purposes.


Approximately $31.7 million additional funding provided towards phasing in
full-day kindergarten.
Included in Public School Finance Act Total Program Funding
“Hold-harmless Full-day Kindergarten Funding” (2,454 Half-day slots)

Amount determined by:

The number of full-day kindergarten children served by a district through the
Colorado Preschool and Kindergarten Program in FY2007-08 or the current number
of kindergarten children (whichever is less)



Use of Supplemental Full-day Kindergarten Funding and
Hold-Harmless Funding



If, prior to FY2008-09, a district provided full-day K to some or all of
the kindergarten pupils enrolled, district is encouraged to expand the
existing program rather than to defray the costs of the existing
program.
Encouraged to follow the basic program standards of the full-day K
program established under the Colorado Preschool and Kindergarten
Program (22-28-108, C.R.S)
Encouraged to prioritize homeless children during enrollment.

Use of Supplemental Full-day Kindergarten Funding and
Hold-Harmless Funding



District shall use the total amount received from supplemental and
hold-harmless full-day K funding to provide access to a full-day
kindergarten program.
Except in any year when the district provides full-day K to at least
90% of the kindergarten pupils who choose to attend full-day K, then
district can use the funding for other purposes.
District may request technical assistance from the department related
to implementation of the full-day program and ongoing training of
personnel for the successful implementation.

Full-day kindergarten reserve – tracking of expenditures



A district that does not report any full-day kindergarten pupils in the October
1 pupil count shall hold the moneys received through “supplemental
kindergarten enrollment” in a separate reserve account called the “Full-day
Kindergarten Reserve” within the General Fund.
The district shall not use the money in the reserve until one or more pupils
are enrolled in full-day kindergarten (pupils counted in October count).
For FY2008-09, a district that does not count any full-day K pupils in the
October count may use the supplemental kindergarten moneys for planning
and facility preparation necessary to offer a full-day K program in subsequent
years (use Grant Code 3142 in the General Fund to track these
expenditures).
