Con il presente accordo la Società ASAP Online PSN Ltd. Registrata presso la
Companies House of England and Wales al numero 7175743 concede al/alla
Sig./Sig.ra ___________________________________ C.I. nr. ____________ Patente
di guida nr. __________ Incaricato ID ________ nel Circuito ASAP WORLD,
l’autoveicolo marca _____________________ Targa _________ in COMODATO
D’USO GRATUITO AZIENDALE ad uso promiscuo per la durata di mesi 6 (sei) solari
con decorrenza a partire dalla data odierna.
L’Incaricato viene contestualmente indicato alla Società _______________________
proprietaria del veicolo in qualità di utilizzatore dello stesso a tutti i fini di legge ed
assicurativi.
L’utilizzo ha finalità commerciali e di marketing aziendali, tuttavia l’Incaricato stesso
può indicare di seguito altre 4 (quattro) persone autorizzate alla guida, sotto la sua
responsabilità verso l’Azienda.
Tutti i costi di manutenzione ordinaria e straordinaria (cambio gomme, riparazioni
ecc.) sono a carico dell’Azienda proprietaria del veicolo per tutta la durata del
presente accordo. L’Azienda provvede al pagamento diretto alle autofficine
autorizzate dalla casa produttrice dell’autoveicolo. Le piccole riparazioni fino ad un
importo di € 150,00 sono a carico dell’Incaricato.
L’autoveicolo è coperto da polizza assicurativa Full Kasko presso primaria compagnia
assicuratrice, tuttavia è prevista una franchigia pari ad € 1000.00 per le auto di fascia
Verde, € 1500.00 per auto di fascia Blu, € 2000.00 per auto di fascia Rossa, € 2500 per auto
di fascia Gold e di € 3000.00 per auto di fascia Platinum.
L’Incaricato comodatario è responsabile per il corretto utilizzo del veicolo.
Egli non rimuoverà od altererà gli adesivi ASAPCAR presenti sul veicolo alla consegna.
Nel caso di sanzioni amministrative, esse verranno detratte dai compensi spettanti
all’Incaricato ed, ove non vi sia capienza per il pagamento di tutte le eventuali
sanzioni, l’Incaricato dovrà bonificare ad ASAP Online PSN Ltd. L’importo delle
sanzioni nel termine di 15 giorni dalla ricezione della comunicazione da parte
dell’Azienda. Nel caso in cui tale utilizzo non si dimostri corretto e le sanzioni
fossero più di 2 (due) al mese, l’Azienda potrà rescindere il contratto di comodato in
base alla presente clausola, con riserva di rivalersi sull’Incaricato per eventuali danni
da essa subiti. In questo caso, l’Incaricato porterà il veicolo in luogo indicato
dall’Azienda per il ritiro entro 5 giorni dalla cessazione del presente accordo. In caso
di inazione da parte dell’Incaricato, l’autoveicolo, dotato di localizzatore satellitare,
verrà recuperato direttamente dall’Azienda ed il materiale eventualmente ivi
contenuto sarà disponibile in qualsiasi momento presso la sede della locale Branch
od Agenzia dell’Azienda stessa.
L’Incaricato che effettuerà più di 15.000 Km nell’arco della durata del presente
contratto sarà tenuto all’acquisto di uno o più pacchetti aggiuntivi di 10.000
kilometri a seconda della differenza fra il kilometraggio effettivo e i 15.000 km
previsti al termine del presente contratto. Se la differenza è inferiore ai 10.000 km
l’Incaricato acquisterà 1 pacchetto da 10.000 km aggiuntivi, se la differenza fosse
superiore ai 10.000 km l’Incaricato ne acquisterà due e così via. Se l’acquisto non
viene perfezionato entro 5 (cinque) giorni dal termine del presente contratto, il
mancato pagamento costituirà utilizzo non corretto e rientra nel punto precedente.
Per tutto ciò che riguarda gli OBBLIGHI DELL’UTENTE IN RELAZIONE ALL’USO
DELL’AUTOVEICOLO e Il RECESSO ANTICIPATO, si fa esplicito riferimento al Modulo
di esercizio dell’Opzione Pacchetto ASAPCAR precedentemente sottoscritto
dall’Incaricato.
Le Parti attestano con la sottoscrizione del presente accordo, che ASAP OnlinePSN
Ltd.

_____________ in FREE Enterprise Loan for promiscuous use for the duration of 6
(six) solar months with effect from the present date.
The Advisor is simultaneously indicated at the company _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _
_ _ _ _ _ _ _ owner of the vehicle user thereof for all purposes of law and insurance.
The use has commercial and marketing purpose, however the same Advisor may
indicate below other 4 (four) persons authorized to drive under its responsibility
towards the Company.
All costs of servicing and maintenance (tires changes, repairs etc.) are responsibility
of the company that owns the vehicle for the duration of this agreement. The
company shall pay directly to auto repair shops authorized by the manufacturer of
the vehicle. Minor repairs up to an amount of € 150.00 are assumed to be under the
liability of the Advisor.
The vehicle is covered by Kasko insurance by a primary insurer, however this leaves
an exemption of the following amounts: € 1000.00 for Green Section cars, € 1500.00
for Blue Section cars, € 2000.00 for Red Section cars, € 2500.00 for Gold Section cars
and € 3000.00 for Platinum Section cars.
The Advisor is responsible for the correct use of the vehicle. He won’t remove or
modify the ASAPCAR stickers present on the car at the delivery. In the case of
administrative penalties, they will be deducted from the remuneration of the
Advisor and, where there is an insufficient amount in order to cover all the fines,
within 15 days of receipt of communication from the company the Advisor shall
wire the right amount of money to ASAP Online PSN Ltd. In the eventuality that the
use of the car does not prove to be correct and the penalties were more than 2
(two) per month, the company may terminate the loan under this clause, with full
right to be repaid by the Advisor for any damage suffered by it. In this case, the
Advisor shall deliver the vehicle in the place indicated by the company for pickup
within 5 days from the termination of this agreement. In the event of inaction on
the part of the Advisor, the vehicle, equipped with satellite tracking, will be
retrieved directly from the company and any material contained therein will be
available at any time at the headquarters of the local Branch or agency of the
Company itself.
The Advisor who shall drive for over 15.000 Km in the duration time of the present
agreement is due to purchase one or more additional mileage packages for 10,000
Km each, depending on the difference between the effective mileage and the
15.000 Km reported in this agreement. If the difference is lower than 10.000 Km the
Advisor shall purchase 1 additional 10.000 Km mileage package, if the difference is
bigger, the Advisor shall purchase 2 mileage packages and so on. In case the
additional mileage package is not purchased in the term of 5 (five) working days
from the termination of this contract, the fail to provide the payment shall be
considered Not Correct Use of the vehicle and shall be comprehended in the
previous point.
For everything related to the OBLIGATIONS OF THE ADVISOR RELATING TO THE USE OF THE
VEHICLE and The EARLY WITHDRAWAL, this agreement makes explicit reference to the
exercise of the Option Application Form for the ASAPCAR Package previously signed by the
Advisor.
The Parties certify, by signing this agreement, that ASAP OnlinePSN Ltd. delivers in the hands of
