Concise HSE Requirement in Contract Clauses
Sub-Clause 22.2 - The Contractor, without prejudice to the
generality of clause 23.0 (Compliance with Law – Licenses), shall
be deemed to have acquainted itself and shall comply in so far as
applicable with the terms, standards and specification stated in
Resolution No. 210 for 2001 issued by the Environment Public
Authority containing the Executive Terms of Reference for Law No.
21/1995 amended by Law No. 16/1996 .
Sub-Clause 22.3 - The Contractor shall take full responsibility for
the adequacy, stability and safety of all its operations and methods
necessary for the performance of the Works and shall ensure that
the Works are carried out in accordance with the requirements of
HSE stipulated in Kuwaiti law, Governmental requirements,
guidelines of statutory bodies and safe working practices as
required by the Company The Contractor shall strictly comply with
the Company’s latest version of Fire and Safety Regulations and
Health, Safety & Environmental Management Systems (“HSEMS”)
Guidelines for Contractors existing on the date prior to the Date of
Bid comprising an attachment to Appendix E (Scope of Work and
Description of Services).

Sub-Clause 22.5 - The Contractor, within thirty (30)

Sub-Clause 22.8.1 - The Contractor shall ensure that all
construction tools and equipments, and Temporary
works and other items including, but not limited to,
scaffolding, forms, sheds, buildings and trailers, whether
purchased, rented or otherwise provided by the
Contractors or its Subcontractors are maintained in a
safe, sound and good condition and are capable of
performing the functions for which they are intended and
where they are not, the contractor shall do all that is
necessary to put them in such satisfactory condition.
Sub-Clause 22.8.2 - The Contractor shall ensure that all
lifting tackles, lifting appliances, mobile work platforms
and hoists under its control possess a valid company
approved classification society current certification, prior
to their use on site, and provide the copies of the test
certificates and records to the Superintendent for
examination. The cost of obtaining such certification
shall be deemed included in the Contract Price.

personnel and its Subcontractor’s personnel with
personal protective clothing and equipment, such as
hard hats, gloves, safety shoes, safety glasses,

Sub-Clause 22.11 - The Contractor shall ensure that all • Environmental Requirement and

Sub-Clause 22.12 - The Company shall not permit
disposal of untreated sewage, oil spills, chemicals and
the like to ground. The method of sewage disposal shall
be subject to the Company approval. The Contractor
shall collect untreated sewage in appropriate containers
and remove it from the Site and transport it to State
approved disposal facilities.

from time to time to ascertain the Contractor’s safety
preparedness and ensure compliance with the

Sub-Clause 22.15 - The Contractor shall inform the
Company immediately of any incident on Company’s
premises or any other work related incident causing death,
injury to personnel or damage to any property including
near misses, followed by an accident/incident report
within twenty-four (24) hours. The Contractor shall hold a
thorough incident investigation immediately after any
incident, determine the cause, and take preventive
measures to avoid re-occurrence. The Contractor shall
submit such report to the Superintendent. The Contractor
if directed by the Company shall demonstrate mock-up of
the accident and the corrective action taken to prevent
such reoccurrence in the Company’s HSE forum and
safety meetings

Sub-Clause 22.19.1 - The Contractor shall adhere to the
Company’s driving procedures and specified speed limits
in Company’s operating areas and within Ahmadi. In the
event that any of the Contractor’s personnel do not follow
the speed limits, the Company may direct the Contractor
to replace such personnel at no additional cost to the
Company.
Sub-Clause 22.19.2 - The Contractor shall ensure that
buses, cars, trucks, vans and other vehicles shall not be
older than 5 years at any time during the performance of
the works; be regularly serviced and maintained in
accordance with the manufacturers’ recommendation; and
be subject to inspection by the Company as per agreed
schedule.

Sub-Clause 22.19.3 - The Contractor shall fully comply

photography is prohibited in the Company operational
areas. The Contractor shall not use mobile phones,
watches and similar equipment and tools that have
