Proposed Revisions to Disposal Reporting System (DRS) and Adjustment Method (AM) Regulations November 4, 2003 1 Diversion Rate Measurement System • The disposal-based method for measuring diversion rates by jurisdiction started in 1995 • Diversion had never been measured in this way before • Adjustment Method (AM) and Disposal Reporting System (DRS) regulations established minimum standards to allow for local flexibility 2 SB 2202 Review of Diversion Rate Measurement System • Required the Board to analyze the DRS and submit a report to the Legislature including recommendations for improvement • Analyzed how the system was working throughout the state after five years • Identified issues and various potential solutions • Proposed revisions to regulations consistent with the Board’s recommendation to the Legislature • Involved extensive stakeholder input 3 Informal Rulemaking Process • 1st draft DRS and AM regulations sent out for public review and comment in November 2002 • Two workshops on the 1st informal draft held in December 2002 (1 North, 1 South) • Four workshops on focused DRS sub-topics of the 1st informal draft held in March 2003 (2 North, 2 South) 4 Informal Rulemaking Process • 2nd draft DRS regulations sent out for public review and comment in June 2003 • Two workshops on the 2nd informal draft held in June 2003 (1 South, 1 North) 5 Informal Rulemaking Process • Based on input received during the informal process, significant changes were made to the regulations • The following slides will highlight proposed revisions regarding the following areas, as detailed in the agenda item: – – – – – – – – Signage Scales Training Origin surveys Determining jurisdiction of origin Reporting State minimum standards Adjustment Method 6 Comparison of Current Regulations, 1st Informal Draft Revised Text, and Proposed Revised Text for 45-day Comment Period 7 Signage • Current Regulations – No requirement • 1st Informal Draft Text – Post sign re: origin survey within 10 ft. of gatehouse • 45-day Formal Text – Post sign re: origin survey in location clearly visible to incoming vehicles 8 Scales • Current Regulations – No scales requirement • 1st Informal Draft Text – Scales required for stations and landfills with annual average throughput >100 tons per day (tpd) (>200 tpd for rural landfills) – Weigh all loads unless host county has Board approval to not weigh car and pickup loads – Specified conversion factor for waste that is not weighed 9 Scales (continued) • 45-day Formal Text – Scales required for stations and landfills with annual average throughput >100 tpd (>200 tpd for rural landfills and stations) – Weigh all loads >1 ton (or >6 cubic yards) – Use documented conversion factors to estimate tonnage of waste that is not weighed 10 Training • Current Regulations – No requirement • 1st Informal Draft Text – Training for relevant staff based on content of specified sections of the DRS regs • 45-day Formal Text – Training for relevant staff on the DRS regs content as it pertains to employees’ job duties (Board will provide training modules.) 11 Origin Surveys • Current Regulations – One week per quarter minimum origin survey period • 1st Informal Draft Text – Daily origin surveys for all loads – One week per quarter survey allowed for car and pickup loads and all loads at rural facilities • 45-day Formal Text – Same as 1st Informal Draft, except reference to car and pickup loads changed to loads >1 ton 12 Determining Jurisdiction of Origin • Current Regulations – All haulers provide origin information at time of waste delivery or, if previous arrangements made, within two weeks after the quarter ends • 1st Informal Draft Text – Origin information from commercial haulers based on dispatcher records of generator locations • 45-day Formal Text – Commercial haulers provide waste origin based on company records of hauler routes and generator locations, billing records, or other relevant records 13 Determining Jurisdiction of Origin (continued) • 1st Informal Draft Text – Commercial self-haulers provide gate attendant with jurisdiction of origin information such as waste collection address, hauler name, and phone number – Other self-haulers provide jurisdiction of origin • 45-day Formal Text – All other haulers provide gate attendant with jurisdiction of origin (Facility operators may also require these haulers to provide additional origin information) 14 Quarterly Disposal Reports • Current Regulations – Each landfill and transformation facility reports total tons disposed (or that underwent transformation) allocated to each jurisdiction – Each landfill reports total tons of each type of material used as alternative daily cover (ADC) and alternative intermediate cover (AIC) allocated to each jurisdiction 15 Quarterly Disposal Reports (continued) • 1st Informal Draft Text – Report the total tons of the following waste categories allocated to each jurisdiction and by delivery source (station, direct haul or self-haul): • Waste accepted • C&D debris, inert debris, designated waste by type, and all other waste disposed • ADC, AIC, and beneficial reuse material listed by type • Material sent off-site for recycling 16 Quarterly Disposal Reports (continued) • 45-day Formal Text – Report tons of disposal, ADC, and AIC by jurisdiction as in current regulations – Report tons of waste received by jurisdiction – Report facility summary information: • Total tons of each type of material used beneficially on-site at landfill • Total tons sent off-site for recycling • Landfill waste-to-cover ratio • Landfill compaction rate 17 Annual Methods Reports • Current – No requirement • 1st Informal Draft Text – Station, landfill, and transformation facility operators report their facility DRS methods such as frequency of origin surveys, volumetric conversion factors used, methods of tracking waste 18 Annual Methods Reports (continued) • 45-day Formal Text – Annual reporting requirement as in the 1st Informal Draft, with some minor changes to report content 19 State Minimum Standards • Current Regulations – Keeping DRS records required as part of the State minimum standards for transfer stations • 1st Informal Draft Text – Also require keeping DRS records as part of the minimum standards for a landfill • 45-day Formal Text – Same as 1st Informal Draft 20 Adjustment Method • Current Regulations – Use employment as reported by the California Employment Development Department (EDD) • 1st Informal Draft Text – Use countywide EDD Industry or countywide EDD Labor Force employment – Use countywide EDD Industry in the nonresidential estimate and countywide EDD Labor Force employment in the residential estimate • 45-day Formal
