Article 9 1083/2006
The Funds shall provide assistance which
complements
national actions, including actions at the regional and local levels, integrating into them the priorities of the Community.
The EC and the MS shall ensure that assistance from the Funds is
consistent
with: * the activities * policies * and priorities of the Community and
complementary
to other financial instruments of the Community. shall be indicated in Community strategic guidelines on cohesion, in the national strategic reference framework and in the operational programmes
In accordance with their respective responsibilities, the Commission and the Member States shall ensure the
coordination
between the assistance from the Funds, the EAFRD, the EFF and the interventions of the EIB and of other existing financial instruments.
Operations financed by the Funds shall
comply
with the provisions of the Treaty and of acts adopted under it.
Programming
Article 10 1083/2006
The objectives of the Funds shall be pursued in the framework of a
multiannual programming system
* organised in several stages * comprising the identification of the priorities * the financing * a system of management and control.
Partnership
Article 11 1083/2006
The objectives of the Funds shall be pursued in the framework of
close cooperation
(
partnership
) between the EC and each MS.
MS shall organise, where appropriate and in accordance with current national rules and practices, a partnership with authorities and bodies such as: (a) the competent regional, local, urban and other public authorities; (b) the economic and social partners; (c) any other appropriate body representing civil society, environmental partners, non-governmental organisations, and bodies responsible for promoting equality between men and women.
MS shall designate
the most representative partners
at national, regional and local level and in the economic, social, environmental or other spheres (partners), in accordance with

national rules and practices, taking account of the need to promote equality between men and women and sustainable development through the integration of environmental protection and improvement requirements The partnership shall be conducted in full compliance with the respective institutional, legal and financial powers of each partner category.
The partnership shall cover the preparation, implementation, monitoring and evaluation of operational programmes.
MS shall involve, where appropriate, each of the relevant partners, and particularly the regions, in the different stages of programming within the time limit set for each stage.
Each year the EC shall consult the organisations representing the economic and social partners at European level on assistance from the Funds.
Territorial level of implementation
Article 12 1083/2006
Implementation of operational programmes referred to in Article 32 shall be the
responsibility of Member States at the appropriate territorial level
, in accordance with the institutional system specific to each Member State. That responsibility shall be exercised in accordance with this Regulation.
Proportional intervention

The financial and administrative resources employed by the EC and MS in the implementation of the Funds in relation to (a) the choice of indicators provided for in Article 37(1)(c) (b) the evaluation under Articles 47 and 48; (c) the general principles of management and control systems referred to in Article 58(e) (f).

Shared management

The budget of the EU allocated to the Funds
implemented within the framework of management between the MS and the EC shall be shared

The EC shall exercise its responsibility for implementing the general budget of the EU in the following ways: (a) the EC shall

the payment deadline or
suspend
all or part of payments in accordance with Articles 91 and 92
if the national management and control systems fail

Contributions from the Structural Funds
shall not replace
public or equivalent structural expenditure by a MS.
For regions covered by the
Convergence objective
, the EC and the MS shall determine the level of public or equivalent structural expenditure which the MS shall maintain in all the regions concerned during the programming period.
The level of expenditure by a MS shall be one of the items covered by the decision of the Commission on the NSRF (national strategic reference framework ) The methodological paper of the Commission, shall provide guidance [ Commission methodological paper giving guidelines on the calculation of public or equivalent structural spending for the purposes of additionality .Working document no. 3. October 2006]
Additionality
Article 15 1083/2006
As a general rule, the level of the expenditure shall be at least equal to the amount of average annual expenditure in real terms attained during the previous programming period.
The level of expenditure shall be determined with reference to the general macroeconomic conditions in which the financing is carried out and taking into account certain specific or exceptional economic situations, such as privatisations as well as an exceptional level of public or equivalent structural expenditure by the MS during the previous programming period

: MS shall transmit to the EC the information required to enable the verification of compliance with the level of public or equivalent structural expenditure determined.
Where necessary, methods of statistical estimation should be used.
mid-term 2011
: EC in cooperation with each Member State, for the Convergence objective. the Commission (in consultation with the MS), may decide to modify the required level of structural expenditure if the economic situation in the MS concerned has significantly changed from the one existing at the moment of the determination of the level of public or equivalent structural expenditure.

The Commission shall

the results by MS of the verification of the additionality, including the methodology and sources of information, after the conclusion of each of the three stages of verification.

The MS and the EC shall ensure that

perspective is promoted during the various stages of implementation of the Funds.
The MS and the EC shall take appropriate steps to

Art 4 1080/2006 The ERDF shall contribute towards the financing of: (a) productive investment which contributes to creating and safeguarding sustainable jobs, primarily through direct aid to investment primarily in small and medium-sized enterprises (SMEs); (b) investment in infrastructure (c) development of endogenous potential by measures which support regional and local development.
These measures include support for and services to enterprises, in particular SMEs, creation and development of financing instruments such as venture capital, loan and guarantee funds, local development funds, interest subsidies, networking, cooperation and exchange of experience between regions, towns, and relevant social, economic and (d) environmental actors; technical assistance (Articles Regulation (EC) No 1083/2006.

access to transport and telecommunication services of general economic interest

strengthening secondary transport networks
by improving links to TEN-T networks, regional railway hubs, airports and ports or multimodal platforms, providing radial links to main railway lines and promoting regional and local inland waterways and short-sea shipping; (b)
promoting access to, take up, and efficient use of ICTs by SMEs
by supporting access to networks, the establishment of public Internet access points, equipment, and the development of services and applications, including, in particular, the development of action plans for very small and craft enterprises.

Art 5 1080/2006 In addition, for operational programmes supported by the ERDF in the regions eligible for the specific and transitional financing referred to in Article 8(2) of Regulation (EC) No 1083/2006 (phasing-out regions) the Member States and the Commission may decide to extend support to the priorities referred to in Article 4 of this Regulation.

: the creation and development of scientific and technological networks, and the enhancement of regional R&TD and innovation capacities (where these make a direct contribution to the balanced economic development of transnational areas) (*) Assistance to bilateral cooperation between maritime regions may be extended to the priorities referred to in point 1

: strengthening polycentric development at transnational, national and regional level, with a clear transnational impact.
