Longline association again appeals to Lolo to temporarily lift 50-mile zone ban

The local association representing the longline fishing fleet has again appealed to Gov. Lolo Matalasi Moliga to lift the ban so its fleet can be allowed to fish temporarily within American Samoa’s 50-mile zone, where only local alias are allowed at this time. In a Sept. 24 letter to Lolo, the Tautai-O-Samoa Longline & Fishing Association applauded the governor’s opposition to President Obama’s original Pacific Remote Islands Marine National Monument expansion plan (which has since been revised - see Friday’s story.). Lolo in his opposition to the expansion, informed Obama in July that the “continued economic viability of our tuna fish canneries is already in jeopardy by the aggressive and preda tory investments by China in fisheries development in the Pacific. Cash-starved independent islands of the Pacific are selling fishing permits to Chinese fishing vessels to harvest fish within their exclusive economic zones.” According to the Tautai association, this statement by Lolo

“I am truly blessed to and honored to repre sent Tradewinds Hotel and American Samoa,” was a message posted by newly crowned Miss American Samoa Annelise Fa’aitumalo Sword on her FB the day after the pageant. Daughter of Lori Fale and Gary Sword, Annelise said “God always gets the glory for everything. He orches trated everything accordingly and it showed beautifully at the pageant.” She explained, “He gave me the best team any contestant could ask for and for that I am extremely grateful to Him for His grace and His favor. I was truly blessed and honored to repre sent Tradewinds Hotel and American Samoa.” She also said her “Nana” (her namesake the late Annelise T.H Sword) would’ve been so happy to see her as Miss Tradewinds.

The five contestants in last Friday’s pageant along with Annelise vying for the crown were: Lorraine Kirsten Polu Fano sponsored by TMO (Tautua Mo Oe); Anne Mendoza sponsored by PCS-TV; Tina Mase sponsored by Dal’s Cre ation and Daryleen Moi sponsored by Diva’s Creations.

First Runner up was the crowd’s favorite, Miss TMO Lorraine; Miss Diva’s creation Daryleen Moi came in second, third place was Miss Dal’s Creation, Tina Mase and Anne Mendoza sponsored by PCS-TV came as fourth runner up. Lorraine was also awarded Miss Confident, won the best puletasi, best sarong, the siva Samoa and was named Miss Charity. Miss Personality was awarded to Tina Mase while Miss Photogenic was Miss Daryleen, who also received the award for the best float. Annelise won the best traditional wear; best

Samoa News Reporter Chairman of the hospital Board, Mase Akapo told Samoa News back in March, when the first phase of the hos pital fee reduction took place, that “a lot more people will take advantage by coming to the hospital. Thus, an increase of patients will bring in more money.” However, in the Fono, Ituau Faipule Archie Taotasi Soliai is calling on the House Hospital Committee to hold a hearing about the reductions that are further planned, noting during the House regular session last week that he is concerned about the hospital’s need for more funding and the effect these further reductions may have on its FY 2015 budget. call in hospital board mem bers and officials regarding the second half of Governor Lolo M. Moliga’s mandate to reduce hospital fees, which is scheduled to go into effect this coming Wednesday, October 1, 2014.

In March, the hospital board approved a reduction of the first $5 from all outpatient clinic fees, laboratory fees and Emer gency Room fees, and they are supposed to be reduced to a total of $10 by October.

In the House regular session last week, while commending the hospital for going through with the reduction of hospital fees, Taotasi noted his concern and pointed out that everyone has an interest in doing good deeds for the territory, but he’s concerned that the reduction of this fee may have an affect on hospital operations.

In January 2014, Lolo in his address at the opening of the Fono pointed out that his col lective expectations on health care service improvement at the LBJ Tropical Medical Center had not materialized. He said that the mandate calling for major changes at LBJ remained unfulfilled and admitted that “there are a lot of problems at the hospital” and that one of the deliverables at the hospital is the reduction of the current $20 fee to $10 to see a physician. The recommendation was also made at that time to estab lish one fee structure for all residents of American Samoa, regardless of immigration status.

Mase told Samoa News the hospital board decided to lower another $5.00 from all outpatient fees, including lab and X-ray. He also pointed out that the hospital will just have to do with less funding. “We will just have to do with less. We have exhausted our share from CMS (Center for Medicaid Services) thus, we can now request money from the Affordable Care Act, or ObamaCare, that will help pay for this short fall.” Samoa News asked Mase, how will the hospital cope with this change?

“We will all have to wait and see. In the past when we lowered the fees, a lot more people took advantage, by coming to the hospital. Thus, an increase of patients will bring in more money.” He also pointed that the renovation of the Dialysis Unit should be completed by the end of the year, adding 16 more chairs “which help us serve more of our people. The psychiatric and mental health wing of the hospital will be completed early next year, thus allowing us to serve this portion of our population.” Amituana’i sponsored a bill to repeal the 2% wage tax as of September 2014. They stated that while they understand the need to secure long term funding to sustain our only medical facility in the territory, the 2% wage tax is extremely problematic. “It is detrimental to our low income families which are the most vulnerable sector of our community, and it will adversely impact our overall economy because of the less disposable income available for purchase of goods,” the faipule said.

They concluded that it was very unfair to all wage earners.

Mase told Samoa News that LBJ has received all of the 2% for this fiscal year (2013 2014), however they have yet to receive money collected from FY 2012-2013, which according to the Treasury Department,this is about $2.5 million.

CEO POSItION

Mase told Samoa News that they have received 11 applications thus far (as of last Friday) for the CEO position, which has only been advertised locally.

Asked as to when they will initiate the interview process, Mase said “we are waiting for HR (Human Resources) to con duct the review and screening process. When this process is done, the Board will then schedule the interviews, which will be conducted by the Board themselves.” Asked if there are any suit able candidates yet, he said, “No.”

2% wAGE tAX

Samoa News asked Mase if the 2% wage tax should be repealed, given this is the plea from the working people of American Samoa.

His answer was, “No. The hospital receives most of its funding from the Federal Gov ernment through Medicaid and Obama Care, the ACA, how ever these federal monies need local matching funds. Thus, we relied on the 2% employment tax and money collected from hospital fees to provide our local match.” In March, three Members of the House of Representatives, Larry Sanitoa, Taotasi Archie Soliai and Vailoata Eteuati

The 2% wage tax com menced in tax year 2012. The revenue generated from this wage tax is to be split evenly: 50% to pay back the $3mil lion loan from the Workmen’s Compensation Account that was made on behalf of the medical center, and the other 50% to be trans ferred to the LBJ operation, which included support of the Off-Island Medical Referral Program. Proceeds are not to be used for personnel costs.

According to Treasury, this year, the loan has been paid back in full, and the full 2% wage tax should be going all to the medical center to be used as noted. LBJ at one time was com plaining about not getting the proceeds, however, Mase, it seems, is now saying that the government is catching up — with 2013- 14 paid in full, but still owes for 2012- 13.

Leata currently lives in Salt Lake City, Utah, where she works with Military Intelligence for the 141st A Company, Utah Army National Guard. She travels back and forth to American Samoa, where she has close family ties — she was born and raised here w— and is deeply interested in both community service as well as political concerns of the territory. In her most recent visit, she assisted the Department of Youth and Women’s Affairs as they held “American Samoa’s Best Dance Crew” competition. Leata says it is service that compels her to continue returning home, as she feels that is the most important thing which she can do for her people at this time.

Hanipale Malae sex case may see charges dismissed against defendant’s wife

New information revealed in High Court last Friday, in a high profile sex case, has it that the Attorney General’s office may be dismissing the criminal charges filed against Asenati Malae, wife of Hanipale Malae’s and Fa’aso’oso’o Sosaiete, one of the girls who originally came for ward as a victim but later changed her story, denying anything happening. Asenati is charged with tampering with a witness and concealing an offense while Fa’aso’oso’o Sosaiete has been charged with tampering with a witness and destroying evidence. This is in con nection with the case of Hanipale Malae, an Ofu man who sponsored two domestic workers from Samoa to work for him and his family. Hanipale last month admitted to having sex with both the 15-year-old girl and the 20-year-old girl without their consent. He was charged in two separates criminal cases which are related. The plea deal offered between the Attorney General’s office and the defense was initially sealed when it was called before Acting Associate Justice Elvis Pila Patea, however Patea moved to unseal the plea.

The first case against Malae charges him with two counts of rape, two counts of sodomy, two counts of deviate sexual assault, two counts of sexual abuse first degree, sexual assault, endan gering the welfare of a child, third degree assault and furnishing pornographic material to minors, on allegations that Malae allegedly assaulted three girls physically and sexually. In the second case filed against Malae, he is charged with tampering with a witness and con cealing an offense. According to Hanipale’s attorney, Sharron Rancourt, “Although it was not specified in the plea agreement, counsel (Deputy Attorney General) Jessop did present to Acting Associate Jus tice Patea that upon Mr Malae’s plea of guilty she will be willing to dismiss the criminal charges against Asenati (Hanipale’s wife) and co-defendant on tampering charges.” Rancourt during Hanipale’s sentencing pointed out that before the court is a 58-year-old man with no prior record, who has an exemplary history of service in the military. She said during the time he’s been in custody he has taken steps forward in terms of rehabilita tion, by attending one of the counseling sessions they have for anger management, as there is lim ited counseling at the jail. She said her client came before the court and admitted responsibility to the very serious charges and in addition he did not put the complaining witnesses through trial. Chief Justice Michael Kruse then called Rancourt and Jessop to the stand and minutes later he said this matter has been transferred over to Acting AJ Patea, who’s currently off island, however this matter will be rescheduled for sentencing as it was Patea who accepted the plea agreement in this case. The three girls from Savai’i all lived with Malae and his wife in Manu’a and the incident came to light when one of the girls ran away from the defendant’s residence after she was allegedly assaulted. She was picked up by Manu’a police officers the next day and was taken to the hospital for treatment. While at the hospital, “FS” informed police she had also been sexually abused by the defendant along with two other females, who also lived with him. (Samoa News should point out in the first case filed against Malae, the three victims are identi fied only by initials and ages: FS (27 years old), FP (15 years old) and SS (20 years old) in court fillings. Fa’aso’oso’o Sosaiete (FS) is now identified as one of the three victims in the Hanipale case, and she is 27 years old.) In the second case, the government charged Malae together with his wife Asenati Malae and Fa’aso’oso’o who was originally one of the complaining witnesses. Fa’aso’oso’o is charged with tampering with a witness and destroying evidence after she changed her statement to the police. Mrs. Malae is facing charges of tampering with a witness and concealing an offense.

According to the plea agreement with the government for the first case, Malae pleaded guilty to deviate sexual assault, sexual assault and endangering the welfare of a child. Upon the entry of his guilty plea the government moved for the court to dismiss two counts of rape, two counts of sodomy, deviate sexual assault, two counts of sexual abuse first degree, third degree assault and furnishing pornographic to a minor. By his plea of guilt, defendant admitted to sponsoring 15-year old FP and 20 year old SS to the territory from Samoa in the spring of 2013 to do housework for him and his family. He further admits that he had sex with 15-year-old FP and that his actions created substantial risk to the life, body or health of the minor. He also admitted that he had sex with SS without her consent. In the second case the defendant pled guilty to conspiracy to commit tampering with a witness which was amended from tam pering with a witness. He agreed that he and Fa’aso’oso’o and his wife Asenati engaged in con duct which would induce a witness in an official proceeding to withhold evidence, information or documents, or to testify falsely by offering to confer upon said witness a direct or indirect benefit.

With his guilty plea to the conspiracy tampering count, the defendant admits that his wife Asenati brought him a cell phone in jail, which he used to call Fa’aso’oso’o to tell her to ask FP and SS to recant their statements to the police.

Malae admits that his conduct was without legal justification or excuse.

There was plenty to do on Tutuila on Saturday, Sept. 28. In addition to the Coast Weeks festival, musicians could be heard playing at the BookWorm in Malaeimi (seen here) which is celebrating their five year anniversary in the territory. Along with free hot dogs, drinks and raffle prizes, those who stopped by were treated to the always delightful sounds of 3-Legged Dog, who were joined by other local musicians as they sang their way through the celebration, which was held from 10 am till 2pm. Twice the musicians began to pack up to leave, only to be encouraged by the crowd to stay on and play. They finally made their way down to Utulei Beach, where there was a wide array of musical talent on display.

Samoa News Reporter Despite a plea from the deceased’s mother for leniency in the sentencing of Matulino Tauali’i, the High Court sen tenced him to 15 years in jail. Matulino last month pleaded guilty to second degree murder in connection with an incident where he struck another man with a hammer, who later fell into a coma and died. Sentencing was handed down by Associate Justice John L Ward II and Associate Judge Fa’amausili Pomele last week Friday. During sentencing, the defendant’s father who came into the territory from Savai’i informed the court that two traditional apologies (ifoga) were made in this matter, as the men come from the same Village of Satupaitea, Savai’i. The father told the court they when his son came to the territory, they did not antici pate anything like this would happen and it was not some thing he planned to do. The father pleaded with the court for leniency and asked that he be allowed to leave the terri tory and serve his sentence outside of American Samoa. He spoke of the two ifoga’s, one of which was held in their village where the deceased is buried and the second was held here on island, and he said that both were accepted by the family. The ifogas included fine mats, cash and cases of tin fish. The defendant in tears begged for the court’s mercy and leniency in handing down his sentence. He told the court that he’s sincerely remorseful for his actions and for vio lating the laws of the territory.

Matulino apologized to the deceased’s family for what happened, he also rendered his apology to his family for put ting them through this whole ordeal and denigrating their family’s good name. “Forgive me,” he said in tears. Public Defender Douglas Fiaui pointed out to the court the defendant had a promising future, however all of that changed in one night. He noted that according to their inves tigation, the deceased had threatened the defendant with a machete, which prompted the incident, and Matulino had acted out of fear for his life. He put it to the court to consider that two ifogas were conducted, and both had been accepted. Assistant Attorney General

Evacuations are more common than many people realize. Fires and floods cause evacuations most frequently across American Samoa and almost every year, people along coastlines evacuate as hurricanes approach. In some circumstances, local officials decide that the hazards are serious and require mandatory evacuations. In others, evacuations are advised or households decide to evacuate to avoid situations they believe are potentially dangerous. When community evacuations become necessary local officials provide information to the public through the media. In some circumstances, other warning methods, such as sirens, emails or telephone calls are used. The amount of time you have to leave will depend on the hazard. If the event is a weather condition, such as a hurricane, you might have a day or two to get ready. However, many disasters allow no time for people to gather even the most basic necessities, which is why planning ahead is essential. Plan how you will assemble your family and supplies and anticipate where you will go for different situations. Choose several destinations in different directions so you have options in an emergency and know the evacuation routes to get to those destinations.

Tautai Association say they are at a disadvantage on every level, and are pleading with the governor and local leaders for consideration in allowing the longliners a moratorium to fish in unused fishing grounds — i.e. the 50 mile-zone around Amer ican Samoa’s islands — for a set time. “This will allow the longliners to recuperate, if possible, by fishing in closer waters, as there will be less fuel consump tion, which translates to less expenses, allow the boats to follow fish if they move through these closed areas and this will also allow the fishery managers to collect data to better manage our waters,” the letter says. The group explained that they only target the highly migra tory species or at least the fish that are passing through territorial waters. The association called on Lolo to follow the suggestions and facts presented by the Western Pacific Regional Fishery Man agement Council staff. “If scientists and managers have the data to prove that this is not a good initiative for our islands, then we will follow this; but there is no data that a temporary moratorium will cause any damage to our ocean resources now or in the future,” they say. “You do have data of where the local alias are fishing and the safety concerns - on where they fish - related to the distance from shore.” Tautai also reprised some part of Lolo’s statements to Obama to reflect what they face locally. “We implore you Mr. Governor to please NOT prohibit us temporary access to unused fishing waters in the American Samoa Exclusive Economic Zone,” the group concluded.

The pageant however was not all wonderful to others, who have labeled this pageant as one of the worse, in terms of organization. Con sistently, complaints made note that the girls or participants were beautiful and delivered as best they could in an event that was poorly organized.

“This by far is one of the worst pageants ever, the girls were great, but the organizing committee MASI (Miss American Samoa Incorporated) was not so organized… delay with starting of the program, MC’s without scripts, and technical difficulties of the sound and lighting system,” was one of the comments on Samoa News’ Facebook page.

However, MASI President, Meafou Imo said MASI broke record this year with just 2hrs and 45minutes of the pageant. She said the delay was due to one of the contestants being late and also, they waited for the governor to arrive. “I didn’t want to be rude and start the pag eant without the one contestant who arrived late and we wanted to wait for the governor,” she said.

According to one complaint emailed to Samoa News, the “Miss American Samoa pag eant was once a prestigious and well followed, widely viewed pageant, but seriously last night, was just, horrific.” The complaint said the MCs sounded lost, unscripted, however it was not their fault, and also said that the DJ and lighting crew “failed to the max.” The woman said she felt sorry for the con testants, their families, sponsors, supporters, and for the general public that watched the pag eant. “I feel like something needs to be done for the MASI to redeem itself. Tiffany Oldfield called to the stand the deceased’s mother, who said that she has forgiven Matulino for what happened — and even more so, that as soon as she saw Matulino he reminded her of her son who had died. She confirmed to the court that two traditional apologies were made and accepted. She said that her family from Savai’i contacted her that they have accepted the apology. The mother further pointed out to the court that she’s not a woman from the medieval times, as she has forgiven Matulino. She too pleaded with the court for leniency in this matter. AJ Ward noted that the defendant had pled guilty to murder, second degree, a class A felony, however, pursuant to local statute with the tradition apology being accepted, they are bound by the law to reduce the charge to second degree murder, a class B felony, which is punishable from five to 15 years in jail. Ward said while the court took into consideration of the defendant’s plea and statements, along with the probation report and the victim’s family plea, the court pointed out this is still a murder case they are looking at. The judge then handed down a 15-year sentence for Matulino.

Ward also informed the PD’s office that pursuant to immigra tion laws, they are to submit their bill to the court for review and then it will be forwarded to the Immigration office in order to bill the defendant’s sponsor in this matter. According to the government’s case, the defendant had alleg edly struck the victim on his head with a hammer. The victim fell unconscious and was admitted to LBJ hospital’s Intensive Care Unit. Court filings say the victim was in a drinking session in Fagaalu with Matulino when the argument occurred, over a girl. The government claimed the defendant allegedly admitted to police that he had struck the victim.

The Request for Proposals (RFP) describes the specifications for the services to be provided in suff icient detail to permit competition and allow offeror to properly respond to the RFP.

This RFP is issued under Title 28, Chapter 1, of the A

merican Samoa Code Annotated.

DBAS invites the submission of proposals to include pricing and other details as indicated in the specifications. Attachments will be provided as an aid in presenting a comprehensive proposal consi stent with the requirements of DBAS.

DBAS will select a contractor who best meets the needs of DBAS. The factors for selection will inclu de, but not be limited to, the following: understanding of the requirements of the financial and single aud its; verifiable ability to perform well; good reputation; flexibility, including ability to respond quick ly to needs of a small client in a remote location and throughout the year; and reasonability of costs.

The proposals will be reviewed by a committee consisting of representatives from DBAS management and board. The committee may request interviews with potential contractors after reviewing the proposal s before the final selection is made.
