Planning & Community Development Department Consideration of a Call for Review Conditional Use Permit #6032 7-Eleven (645 East Walnut Street) City Council Meeting October 7, 2013 Call for Review Planning & Community Development Department • Before the City Council is a request for a call for review of a decision made by the Hearing Officer. > Hearing held on September 18, 2013, decision rendered on September 19, 2013, decision letter dated September 23, 2013. > Appeal period is within 10 days from decision September 20, 2013 to September 30, 2013 (10th day fell on weekend). Effective date of October 1, 2013. > Councilmember Kennedy called for a review effective Monday, September 30, 2013. > As indicated in the decision letter and pursuant to PMC Section 17.72.060.B.4, if there is a Call for Review, the appeal period continues to run. > If the Council decides to Call for Review, a hearing will be scheduled before the Board of Zoning Appeals. > If the Council decides to not Call for Review, and an appeal is not filed by 5:00 p.m. on October 8, 2013, the decision of the Hearing Officer is effective. 2 Requested Entitlement Planning & Community Development Department • Conditional Use Permit: > To establish a Convenience Store Use in the CD-3 Zoning District • Project: > Demolish existing one-story 1,400-square-foot commercial building > Construct new one-story 2,700-square-foot commercial building at street corner > Improve parking lot with 10-parking spaces and landscaping > Proposed hours of operation: 24-hours/day, 7-days/week > No off-site alcohol sales • Design Review is required for the proposed new building > Design & Historic Preservation staff continues to work with applicant on the design of the proposed building 3 Site Plan Planning & Community Development Department Parking and Landscaping New 2,700 SF Structure Walnut Street 4 El Molino Avenue Parking and Landscaping One-Way Driveway Public Hearing Planning & Community Development Department • Five speakers in opposition > Does not agree with environmental exemption determination as the use will increase ambient noise and light > Concern the use will attract transients > Concern the use will be in close proximity to rehab homes > There are similar convenience store uses nearby > Concern the use will increase traffic accidents on El Molino Avenue > Concern regarding safety > Use is incompatible as the area is a quiet neighborhood 5 Public Hearing Planning & Community Development Department • Eleven signatures submitted in support • One letter submitted in opposition • Hearing Officer took the application under advisement • Hearing Officer rendered a decision to approve the application on September 19, 2013 6
