Definition of “Oil”
Oil of any kind or in
any form, including
but not limited to
animal fats and oils,
vegetable oil,
petroleum, fuel oil,
sludge, synthetic oils,
mineral oils, oil
refuse, or oil mixed
with other wastes
Regulated Facility
1) It must be non-transportation related;
2) It must have an aggregate aboveground
storage capacity equal to or greater than
1,320 gallons or a completely buried storage
capacity of 42,0000 gallons or more;
3) There must be a reasonable expectation of
discharge into or upon navigable waters or
adjoining shorelines.
Exemptions
• Completely buried tanks – UST Program
R.61–92.280
• Minimum container size – 55 gallon
containers
• Permanently closed containers
• Wastewater treatment
Requirements
• Reviewed and certified by a licensed Professional
Engineer
• Maintained at the facility if the facility attended at
least four hours per day, or at the nearest field
office if the facility is not so attended
• Available to the Regional Administrator (EPA) for
on-site review during normal working hours
• Reviewed and updated every 5 years
