Designs 外觀設計 那些外觀設計是可以註冊的？ Basically every new design for the appearance of an article is registrable 基本上任何物品的新外觀設計都可以申請 註冊 What rights a registered owner has? Rights to take legal actions for relief i.e. damages, when being infringed 註冊擁有人有甚麼權利？ Exclusive right to deal with the design i.e. use, manufacture, sale, import at the place of registration and issue license to others to deal with it 在註冊地享有獨有該外觀設計的如使用、 製造、售賣及進口等處置權及授權他人以 特許使用處置該外觀設計 Infringement 侵犯知識產權 被侵犯知識產權時有權採取法律 行動要求如賠償的濟助 Good defense and counterclaim when being sued 當被他人起訴時該註冊外觀設計 為一有力的答辯及反申索 Notes on Application for Registration of Designs 申請註冊外觀設計注意事項 Design must be new at the date of filing of the application 在提交申請當日，該外觀設計必須是新的設計 OR 或 Design must be new at the Priority Date (Date of filing of the first application in a Paris Convention Country or WTO member territory – date of filing in HK must be within 6 months from the first application to claim priority) 在優先權日期時﹝在巴黎公約國或世貿組織 成員區提交首次註冊申請的日期 – 在香港 提交申請的日期必須是該首次申請日期的6個 月內才可聲稱有該優先權﹞該外觀設計必須 是新的設計 What designs can be considered as new? 甚麼的外觀設計才會被認為是新的？ •Not yet registered for the same or any other articles •該外觀設計在過去未為該物品或其它物品 註冊 •Not yet disclosed in HKSAR or other places •該外觀設計在過去未有香港或其它地方披露 There must not be any non-confidence disclosure before filing of application 注意在提交申請書前不可在沒有保密情況 下披露該外觀設計的機密 Designs Registry 外觀設計註冊處 Application Procedure 申請程序 Applicant 申請人 Filing 提交 Required Items •1 set of completed application Form (D1) Notice •7 identical sets of representation of the 通知 design •A Statement of Novelty •Samples (for textile design only) •Payment of filing and advertisement fee 所需項目 •一份填妥的申請表格﹝D1﹞ •七份相同的該外觀設計陳述 •一份新潁性陳述書 Upon receipt of the application, issue notice to applicant informing him date of filing 註冊處在收到申請後會通知申請人其 申請的提交日期 Notice Formal Examination 型式方面的審查 通知 If any deficiency on the application, inform applicant to correct 若申請內有未符合型式上的規定，通知 申請人更正 Amendment 更正 Issuance of Certificate 發出註冊 證明書 If no deficiency 符合型式規定 Publish in the Gazette and issuance of Certificate of Registration 在憲報上刊登及發出註冊證明書 •樣本﹝祇適用於紡織品外觀設計﹞ •繳付提交費及廣告費 Normal process time – 3 months 正常處理需時3個月 Duration of Registration 註冊有效期 5 years/年 Initial 5 years and Renewable 4 times Each time 5 years 首次有效期為5年及可續 期4次，每次為期5年 5 years/年 5 years/年 5 years/年 5 years/年 Trade Mark 商標 What is a trade mark? 商標是甚麼？ •A sign capable of distinguishing the goods and services of one undertaking from another •一個能識別不同企業的貨品或服務的 標誌 •It might consist of words (including personal names), indications, designs, letters, numerals, colors, sounds, smells... •可以由文字﹝包括個人姓名﹞、徽示、 設計式樣、字母、數字、顏色、 聲音、氣味等等構成 •BUT must be capable of being represented graphically •必須能以書寫或繪圖展示 What rights does a registered owner have?
