What Ties the Federal Government Together?
The “Supremacy Clause,” Article VI, Clause 2
This Constitution, and the Laws of the United States
which shall be made in Pursuance thereof, and all
Treaties made, or which shall be made, under the
Authority of the United States, shall be the supreme
Law of the Land, and the Judges in every State shall
be bound thereby, any Thing in the Constitution or
Laws of any State to the Contrary notwithstanding.”
What Ties the Federal Government Together?
Before public servants may assume
office, they are required to take two oaths:
1. Oath of Office
2. Oath to Support the Constitution

Characteristics of Oath to Support
The Constitution was written
for the “average citizen” / “voter” to understand.
It was written for shop keepers and farmers.
We do not need lawyers and scholars
to interpret it for us.

Where is the Authority for Amendments
and/or a New Constitution found?
The Declaration of Independence states:
" That whenever any form of government becomes
destructive of these ends, it is the right of the people
[sovereign authority of the people] to alter [Article
V] or to abolish it, and to institute new government
[Constitutional Convention], laying its foundation on
such principles and organizing its powers in such form, as
to them shall seem most likely to effect their safety and
happiness.”
Limitations of an Amendment
Article V sets NO LIMIT on the scope
of an amendment, so…
An amendment can be the change of one comma,
or the change of everything but one comma.

ARE A DISTINCTION WITHOUT A DIFFERENCE.

What is the real issue?
Do we fear a change
in the language of the Constitution?

We should fear a change in our form
of government and our sovereign status!

What Five Words Could Do.
"The states' sovereignty is abolished."
This kills federalism.
States would have no authority or duty to:
• keep the central government in check
• to keep the central government from infringing
on your un-alienable God given rights

Power Granted to Congress Regarding
Constitutional Amendments Extends Beyond Article V.

Control of Article V Amendment Process
Who “controls” an Article V Convention?
An Article V “Convention for proposing
Amendments” is a federal convention,
not a “convention of states.”
Congress, state legislatures, and the People
all play a role, but the Constitution itself
determines in what capacity.
Control of Article V Amendment Process
Who “controls” an Article V Convention?
The entity that calls a Convention makes the
initial rules, determining such things as where
and when the Convention will meet, and
recommending basic rules of the Convention.
Article I, Section 8, Clause 18,
the “necessary and proper” clause,
grants Congress this authority.

trigger an Article V convention, stated

The Madison Coalition encourages both State
leaders and Members of Congress to work for the
eventual adoption of the Madison Amendment
to permanently and constitutionally guarantee
the right of 34 states who propose an identical
Amendment to limit the scope of a Convention
they call to an up or down vote on that specific
Amendment.
On Thursday August 5, 2010,
the ALEC International Affairs and
Federalism Task Force recommended that ALEC
endorse the proposed Madison Amendment to the U.S. Constitution.
“The National Taxpayers Union (NTU)
is joining Idaho Rep. Walt Minnick in promoting
an amendment to the U.S. Constitution that would allow states to
call constitutional conventions to handle specific topics, rather than
a full rewrite of the country’s founding document.”

Solution to Republic’s Problem
1. Educate Citizens on the Constitution and
Fundamental Principles of Federalism so
they can hold politicians accountable.
2. Take back the states so they can uphold
their duty to rein in the central government.

amendments to give the citizens the power of :
a. Recall over every state officer
from dog catcher to Governor,
b. Initiative - to pass laws,
c. Referendum - to withdraw laws.
But what if the people will not learn the Constitution
