Every occupier/operator of a Health Care Establishment including both Government and private Hospitals, Nursing Homes, Pathological Laboratory, Blood Bank, Animal Hospital etc. generating Bio-Medical Waste, has to submit the Annual Report under Bio-Medical Waste (Management & Handling) Rules, 1998 for the period of Jan-Dec. 2014 on prescribed Form-II which can be obtained from Regional Office of J&K State Pollution Control Board, Gladni or can be down loaded from J&K website www.jkspcb.nic.in and the filled up forms should reach by Jan. 31, 2015 positively or else legal action under Environmental (Protection) Act 1986, will be initiated against the defaulters.

In the light of the Hon’ble Supreme Court’s Order Dated : 16.09.2014 passed by the Hon’ble Supreme Court of India in Writ Petition (Civil) No. 349/2006-Voluntary Health Association of Punjab (Regd) Vs UOI & Ors Expressing its concern about female foeticide and the reduction of sex ratio and proper implementation of Pre-conception and Pre-Natal Diagnostic Techniques (Prohibition and Sex Selection) Act at various lev els and this has affected overall sex ratio in various States where female infanticide is prevailing without any hindrance.

It is impressed upon all the Owners of Ultrasound Clinic/Centre (Govt/Private) are directed to get install CCTV Cameras in the prominent places for surveillance of Ultrasonography under the Act within a week’s time positively, failing which the same will be informed to the District Advisory Committee/District Appropriate Authority of PC&PNDT for appropriate lawful against all the concerned and Registration will be cancelled without any notice in the light of Hon’ble Supreme Court’s Order.

Whereas, Shri Syed Rasool I/C Assistant Engineer (Electric) has sub mitted his representation alongwith his Resident of Backward Area (RBA) certificate for inclusion of the same against his name in the sen iority list of Junior Engineers (Electric) Degree/Diploma issued vide Government Order No. 314-PDD of 2007 dated 23.10.2007 and; Whereas, Shri Syed Rasool, I/C AE (Electric) is figuring at Seniority No.

205 in the final seniority list of Junior Engineers (Diploma Holders) under Open category, and; Whereas, representation of Shri Syed Rasool for inclusion of RBA cat egory in the seniority list of JE was examined in the Department and vide this Department letter No. PDD/HRM/158/2014 dated 18.10.2014, Deputy Commissioner, Budgam was requested to furnish the genuine ness of the RBA Certificate; and Whereas, the Assistant Commissioner (Rev) Budgam vide his letter No. DCB/SQ/014/1050 dated 07.11.2014 has stated that as verified and reported by Tehsildar Budgam vide his No. 231/MM/14 dated 29.10.2014, the RBA certificate issued in favour of Shri Syed Rasool S/o Syed Mehdi Shah R/o Labartal Tehsil Budgam has been issued vide No. 262/MM/14 dated 30.08.2014 under rules and the said certifi cate is valid upto 30.01.2019; and Whereas, inclusion of RBA category of Shri Syed Rasool, in the senior ity list of Junior Engineers (Diploma Holders) issued vide Government Order No. 314-PDD of 2007 dated 23.10.2007 needs to be considered; and Now, therefore, before inclusion of the RBA certificate of Syed Rasool I/C AE, objections are invited from the persons who are likely to be effected by incorporating the RBA category against the name of Shri Syed Rasool, I/C AE (Electric) figuring at Seniority No. 205 in the final seniority list of JE (Electrical) issued vide Government Order No. 314 PDD of 2007 dated 23.10.2007, in the HRM Branch Civil Secretariat Jammu within 10 days from the date of publication of this notice, failing which no objection shall be entertained and it shall be presumed that nobody has any objection regarding re-fixation of seniority of the peti tioner as proposed above.

Subject : Receipt and Opening of Tenders

In exercise of powers conferred upon the J&K State Vigilance Commission under section 8(I)(h) of the Jammu and Kashmir State Vigilance Commission Act, 2011, the following Circular instructions are hereby, issued for strict compliance and implemen tation by all Government Departments and Public Sector Undertakings/Govt Companies /Societies involved in procurement.

The Commission has observed that there is a need to maintain transparency in respect of inviting receipt and opening of the tenders and suitable arrangements for receipt of sealed tenders on the scheduled date and time through conspicuously located tender boxes needs to be ensured.

It has been found that due to the bulky size of tender documents the bid conditions envisage submission of tenders by hand to a designated officer. However, instances may arise when bidder(s) while trying to locate the exact place of submission of ten ders may get delayed by few minutes resulting in non acceptance of tender which in turn may lead to filing of complaint or resorting to avoidable litigation.

In order to maintain transparency in the invitation, receipt and opening of tenders, it is impressed upon all the concerned that the receipt of tenders should be through ten der boxes. However, in cases where the tenders are required to be submitted by hand, it may be ensured that the name, designation and their official/mobile numbers, of at least two officers are mentioned in the bid documents. The information about these officers should also be displayed at the entrance/reception of the office prem ises where tenders are to be deposited so as to ensure convenient approach for the bidders. The tenders after receipt should be opened on the stipulated date and time in presence of all the intending bidders.
