THE SPIRIT OF ANIMAL
PROTECTION LAWS
LONG BROKEN
BUT THERE IS A CALL TO
MEND
• Prevention of Cruelty to Animals Act 1979 No 200
Part 1 Section 3
3 Objects of Act
• The objects of this Act are:
• (a) to prevent cruelty to animals, and
• (b) to promote the welfare of animals by requiring a
person in charge of an animal:
• (i) to provide care for the animal, and
• (ii) to treat the animal in a humane manner, and
• (iii) to ensure the welfare of the animal.

ROUTINE MUTILATIONS
• PREVENTION OF CRUELTY TO ANIMALS ACT NEW
SOUTH WALES 1979 (as amended 1996)
• Section 24 Certain Defences:
mutilations of farm animals permitted;
mulesing, dehorning, tail docking, castration etc.
without analgesia
“For any proceedings for an offence against
this Part or the Regulations in respect of
an animal…the person accused of the
offence is not guilty…if the act or omission
was done…in a manner that inflicted no
unnecessary pain upon the animal.”
AUSTRALIAN WOOL INOVATION -VS- PETA et
ANIMAL LIBERATION
OUTCOMES for animals:
• ADMISSION THAT FARM ANIMALS FEEL
PAIN EVEN UNDER 6 MONTHS AGE
• ANALGESIA: Tri-Solfen (post) / - and now
readily available + Carprofen (pre-procedure)
***Therefore if one were to mules a lamb
without analgesia – it is argued that
unnecessary pain would have occurred.
Defence of s.24 no longer applies.

•
INTENSIVE PIG FARMING
•
Prevention of Cruelty to Animals Act 1979 (as amended 1997) NSW
• Be a dog, don’t be a pig:
Section 9
(1) A person in charge of an animal which is confined shall not fail to provide
the animal with adequate exercise.
(1A) Subsection (1) does not apply to a person in charge of an animal if the
animal is
(a) a stock animal other than a horse, or
(b) an animal of a species which is usually kept in captivity by means of a
cage.
SOW STALLS
33 people tether themselves next to tethered sows at ‘Parkville’ piggery (part
owned by Paul Keating)
.
All charged with trespass. As they were being ‘processed’
at police station the Minister for Agriculture, Richard Amery, declared a ban on the
tethering sows in piggeries as of the next year (1996). Charges dismissed.
1996- 44 people chain themselves next to sows at ‘Bunge’ piggery near
Corowa, NSW. The largest piggery in southern hemisphere. Police investigate
cruelty complaints and escort activists out. No trespass charges laid.
2005- This Piggery –’Rivalea’’s management agrees to
meet to discuss sow stalls.
One year later invite us to see new ‘eco-shelters’ for
gestating sows.
December 2009 announces phase out of stalls
THE KANGAROO –
AUSTRALIA’S NATIONAL ICON
• Last but not least, the Malu plays a significant role in maintaining our
Song Lines, i.e. the lines and centres of energy upon which our
culture and all humanity is dependent for sustaining its balance and
centredness. The Malu is part of the animal kingdom (together with
other animals) which preserve the energy of the Song Lines through
their travel over those Lines. In particular, their natural habit of
thumping their tails is what keeps the energy of the Lines
“activated” and “flowing” around Australia. Their slaughter and loss
of habitat interferes with this process which can only be detrimental
to the wellbeing of both Aboriginal and other cultures.
• I thank you for taking the time to read this letter and my wish is that
you will give these matters due consideration.
• Yours faithfully,
• Max Dulumunmum Harrison
AUSTRALIAN ALLIANCE FOR
NATIVE ANIMAL SURVIVAL
• AAFNAS – a group of First Peoples’ with
representatives from all over Australia – is
an independent community based
educational association that is a non-profit,
non-government alliance that advocates
for animals & cares for country

Some of our aims & objects include:
To educate the Australian and international communities about our native
animals. This includes First Peoples’ concepts and cultural practices of
caring for country, natural resources and for all life past, present and future.
To link up First Peoples with all other Australians and international
supporters to promote advocacy, care and protection of animals in safe
locations on a national level along the ancient communication routes &
dreaming tracks.
To undertake legal challenge consistent with these Objects, including
the initiation and conduct of court proceedings at local, regional,
national and international levels, in order to achieve and promote
these Objects.
AAFNAS is currently seeking legal advice with the aim of calling for a
Moratorium on the killing of all native animals to provide time until
consultation with the First Peoples has taken place. Since the arrival of
other peoples who came and stayed, starting with the British in 1788 and
subsequent land practices, far too many mammals, birds, fish, reptiles &
plants have become extinct. This decimation continues at a relentless pace.
