Florence Forum 27-28 November 2014 2.1.1. Adoption of Regulation on Capacity Allocation and Congestion Management CACM Guideline - background Europex supports the completion of the Internal Energy Market and an effective and sustainable governance scheme, robust to market evolutions, given the strong dynamics and need for continuous improvements of the market design. PXs and TSOs have made significant progress towards achieving the Target Model in anticipation of the Network Codes by working on consensual basis together with NRAs and Member States: • For DA, MRC covers 75% of European electricity consumption and should cover 90% as from early next year • For ID, the TSOs and PXs are in the midst of a major project to implement a SOB and capacity allocation mechanism across NWE, SWE, CSE and Baltic 2 CACM Guideline Europex members: • welcome that the latest CACM Guideline recognizes that “TSOs, NEMOs and regulatory authorities should draw on the experience gained, respect the decisions made, and use solutions developed” in previous market integration projects • are concerned that provisions on the governance in the draft CACM Guideline could potentially lack clarity and harm rather than assist in the goal of building on the experience and successes that have been achieved. Great care now needs to be taken to ensure that the CACM does not induce unnecessary or unjustified change or disruption to the arrangements now in place or being implemented, as this would delay the market integration and increase costs, while not adding value for market participants Europex has requested the EC to engage in a constructive dialogue with power exchanges to identify areas of improvement and suggest possible solutions to the current formulation. 3
