Policy Review • Alcohol & Drug Policy – Follow all laws of City, State, College – No purchase of alcohol with fraternity funds – No sale/possession/use of controlled substance at any fraternity event – No alcohol at any pledge program – “Slush Funds” are prohibited – No Drinking Games Policy Review • Alcohol & Drug Policy (continued) – “No-Host” cash bar with professional bartender preferred – Reasonable precautions to prevent excessive drinking – No underage consumption – Alternative “non-alcoholic” beverages should be available – Designated non-drinking members Policy Review • Hazing Policy – Hazing Defined: • Any action taken or situation created, intentionally or unintentionally whether on or off fraternity premises, to produce physical or mental discomfort, embarrassment, harassment, or ridicule or possibly cause physical harm or injury – Physical Hazing Examples: • Use of alcohol, paddling, excessive fatigue, physical and physiological shocks, kidnapping of pledges, etc. Policy Review • Hazing Policy (continued) – Mental Hazing Examples: • Pre-initiation activities causing mental or physical fatigue • Activities during pledge education program that are done with the purposes of intimidating, creating discomfort, display lack of respect • Verbal abuse – Personal Liability • President, VP of Membership, Pledge Educators held personally responsible for chapter violating hazing policy Policy Review • Publication of Inappropriate Material – Members prohibited from producing publishing and/or distributing any material, whether written or electronically as text, audio, video, or some combination of all three that would be deemed harmful to the good name and reputation of the Fraternity Consequences • Any chapter found to be in violation of the Board of Directors Statement of Policy related to risk management: – – – – – Officer(s) removed from office Probationary Period Chapter Action Plan Publication in The Diary Financial penalties • Reimburse fraternity for investigative expenses • Increased insurance premiums – Suspension or expulsion of offenders – Chapter’s charter revoked Playing it Safe How Can We Protect Our Chapter, Our Fraternity and Ourselves? • Compliance Committee • Judicial Review Board • Know escalation process • Alternatives to hazing Compliance Committee Purpose: Simply Stated Ensure Compliance Compliance Committee • Duties: –Review chapter Bylaws –Suggest changes –Review activities Compliance Committee • Duties (continued): – Events • Planning • Execution – CC rep at event • Post-event review • Report violations Compliance Committee • Suggested Additional Duties: – Review the chapter calendar • Secondary review of each event within the calendar. – Review pledge class calendar – Review activities of the pledge program Judicial Review Board (JRB) • Purpose: – The purpose of the JRB is to conduct investigations of violations chapter and fraternity policies – The fraternity’s Judiciary Committee can provide guidance through the disciplinary process JRB • Duties: – Conduct investigation of violations – Submit all documentation of any proceeding to fraternity Judiciary Committee JRB • Duties (continued): – Proactively ask “why” incidents are happening and determine course of action for the chapter to take to reduce risk of incidents reoccurring – JRB should NOT be used on a frequent basis Pros for CC/JRB • Pros for Compliance Committee and JRB – Assists the chapter in reducing risk – Allows for non-eboard members to sit on committees – Assists the chapter in following proper local, fraternity and university policies and regulations Escalation Procedures • If a member identifies a potential problem within the chapter President/Compliance Committee Advisor/ Regional Director Judiciary Committee Alternatives and Discussion • Foster unity • Develop problem solving • Work under pressure • Develop leadership skills • Instill sense of pride for membership • Time Management • Increased confidence For More Information • Review the chapter toolbox online at akpsi.org on the Judiciary Committee page • Attend the Risk Management Seminar at the next PBLI or Convention • Ask questions!
