EPA regulation changes & developments
Container & containment rule
Planned applicator certification rule revision
Pesticide NPDES permit requirement
EPA container & containment rule
Originally proposed as a rule first time in 1988
Became a final rule in 2006
Minor amendments to the rule in 2008
Parts of rule became effective 2010
EPA container & containment rule
Purpose:
minimize human exposure while handling containers
facilitate container disposal & recycling
protect environment at bulk pest. storage sites (not you?)
Will impact:
registrants (manufacturers)
retailers
distributors
commercial applicators *
users *
EPA container & containment rule
Registrants must:
Refillers & repackagers must:
insure container design meets new integrity specifications
incorporate new language into labels
clean containers before refilling
comply with bulk storage & containment rules
Users must:
Comply with new label directions (this is you)
EPA container & containment rule
Refillable container labels:
“refillable container”
container cleaning instructions
instructions for recycling or disposing of container
Nonrefillable container labels:
“nonrefillable container”
“do not reuse” …not even as service containers
more detailed rinsing instructions (triple rinsing ?)
instructions for recycling or reconditioning of container
EPA planned applicator certification
rule revisions
40 CFR Part 171
Original rule 1972
Currently applies to RUP applicators only
Most state standards exceed current EPA rule
Initial rule review & brainstorming began 1998
Proposed rule revisions: Winter 2011 ?
EPA planned applicator certification
rule revisions
Under consideration ?
minimum age for private & commercial applicators
federal standards for recertification programs
min. age for those working “under the supervision”
federal standards for training of those supervised
States must adopt federal category designations
Pesticide NPDES permit
What does NPDES stand for?
National Pollutant Discharge Elimination System
Pesticide NPDES permit
What is the purpose of the NPDES permit for
pesticides?
Control discharges of pollutants (pesticides) “to,
over, near” waters of the US.
NPDES created under Clean Water Act (CWA).
Pesticide NPDES permit
Do all pesticide applications “to, over, or near”
waters of the US need a permit?
Yes, except for agricultural storm water runoff
“Near” within 10 ft. of waters edge in IN
Permits can be:
individual (one application & one site)
general (multiple sites & multiple applications)
Pesticide NPDES permit
What applications fall under general permits?
Mosquito & other flying insect control (black flies, etc.)
Aquatic weed & algae control *
Aquatic nuisance animal control (zebra mussels, trash
fish, etc.)
Forest canopy pest control (Gypsy Moth, etc.)
Pesticide NPDES permit
Who will issue & process the permits?
EPA in Alaska, Idaho, Maine, New Hampshire, New Mexico,
Oklahoma, Federal lands & Indian lands. (no state permit program)
Indiana Department of Environmental Management (IDEM).
State permits must be consistent with EPA permit.
Anticipating EPA’s mid-Feb. 2011 release of final permit.
Pesticide NPDES permit
Who is eligible for general permit ?
All operators that discharge pesticides “to, over,
near” waters are covered by the general
permit.
“Operator” can be:
entity that orders the application…decision maker
applicator
Pesticide NPDES permits
What will the general permit require?
Notice of Intent (NOI)
Pesticide Discharge Management Plan (PDMP)
Technical Based Effluent Limits (TBEL)
Adverse incident monitoring/reporting (AI)
Record keeping (RK)
Annual reporting (AR)
OK, tell me again Who does What !
All operators that discharge pesticides “to, over,
near” (within 10 ft.) US waters are eligible for
coverage by the general permit.
“Operator” can be:
decision makers
applicators
Who must file the NOI ?
Applicators (for hire)…NO
Decision makers:
who annually exceed: …YES
6400 treatment acres (mosquitoes or forest canopies)
80 acres water or 20 linear miles edge (aquatic weeds or animals)
federal or state agency…YES
irrigation or mosquito control districts…YES
who discharge to restore/protect water or public health,
but do not further degrade Tier III waters …YES
Who files PDMP & Annual Report ?
Large NOI submitters…YES
public entity servicing over 10,000 citizens
private entity exceeding SBA limits
Small NOI submitters…NO
complete worksheets only
Applicators (for hire) …NO
Who is responsible for TBELs ?
Decision makers…YES
insure appropriate application rate & frequency (label)
ID target pest(s)
insure treatment thresholds are met (IPM type decisions)
Applicators…YES
use appropriate application rate & frequency (label)
assess appropriate weather conditions for application (label)
maintain & calibrate equipment (label or BMP)
keep records of equipment calibration
Who is responsible for
monitoring & reporting (adverse
incidents) ?
Applicators…YES
where it fits into normal procedures (during…after)
adverse incidents (already required in most states)
dead fish or critters
spills into or near water
Decision makers…YES
insure reporting of adverse effects takes place
include in annual reports or worksheets
What is best advice for compliance
with NPDES permit requirement?
Contact state water agency (EPA) Feb, 2011.
Applicators:
follow label
maintain & calibrate equipment
keep records of applications & calibration
report spills & kills to IDEM
Decision makers:
file NOI with water agency by April 9, 2011
determine if you will exceed annual thresholds
EPA pesticide product labeling
Label improvement initiative
Drift labeling activities
EPA label improvement initiative
Need clear, concise & consistent labels-the 3 Cs
State Lead Agency mantra for many years:
“The label is the law”
labels are too long & confusing
advisory vs. mandatory (enforceable) ?...AVOID
EPA finally agreed they could/should do better
Training product label reviewers: follow policies
Train registrants (label submitters) next?
EPA drift labeling initiative
Drift PR Notice 2009-X
Commercial & consumer outdoor use products
“Do not apply this product in a manner that will contact
workers or other persons, either directly or through drift.
In addition, do not apply this product in a manner that
results in spray drift that harms people or any other nontarget organism or site.”
