Originally proposed as a rule first time in 1988

Became a final rule in 2006

Minor amendments to the rule in 2008

Parts of rule became effective 2010

Purpose:

minimize human exposure while handling containers
facilitate container disposal & recycling
protect environment at bulk pest. storage sites (not you?)

Refillers & repackagers must:

insure container design meets new integrity specifications
incorporate new language into labels
clean containers before refilling
comply with bulk storage & containment rules

Comply with new label directions (this is you)

instructions for recycling or disposing of container
Nonrefillable container labels:

“do not reuse” …not even as service containers

What is the purpose of the NPDES permit for
pesticides?

Control discharges of pollutants (pesticides) “to,
over, near” waters of the US.

NPDES created under Clean Water Act (CWA).

Do all pesticide applications “to, over, or near”
waters of the US need a permit?
Yes, except for agricultural storm water runoff
“Near” within 10 ft. of waters edge in IN
Permits can be:
individual (one application & one site)
 general (multiple sites & multiple applications)


What applications fall under general permits?
Mosquito & other flying insect control (black flies, etc.)
 Aquatic weed & algae control *
 Aquatic nuisance animal control (zebra mussels, trash
fish, etc.)
 Forest canopy pest control (Gypsy Moth, etc.)


Who will issue & process the permits?

EPA in Alaska, Idaho, Maine, New Hampshire, New Mexico,
Oklahoma, Federal lands & Indian lands. (no state permit program)

Indiana Department of Environmental Management (IDEM).

State permits must be consistent with EPA permit.

Anticipating EPA’s mid-Feb. 2011 release of final permit.

Who is eligible for general permit ?

All operators that discharge pesticides “to, over,
near” waters are covered by the general
permit.

“Operator” can be:
entity that orders the application…decision maker
 applicator



Notice of Intent (NOI)
Pesticide Discharge Management Plan (PDMP)
Technical Based Effluent Limits (TBEL)
Adverse incident monitoring/reporting (AI)
Record keeping (RK)
Annual reporting (AR)






coverage by the general permit.

