A.B. 801 - Swanson
Illegal Dumping and Code Enforcement Officers
• Authorizes a code enforcement officer to exercise the power
of arrest of a peace officer
• Consistent with existing law
• To enforce laws related to illegal dumping or littering

A.B. 1750 - Solorio
Rainwater Capture Act of 2012
• Enacts the Rainwater Capture Act of 2012.
• Does not require a water rights permit from the State Water
Resources Control Board.
• Authorizes a landscape contractor to enter into a prime
contract for the construction of a rainwater system.
• Recapture water must be used for landscape irrigation or
water feature for fountain, pond, decorative water feature

Land Use: Fees
• Prohibits a city, county, or city and county from basing fees
for a solar energy system based on valuation
• Or fees not associated with the permit
• Or valuation of the property or improvement
• Requires local entities to identify each fee assessed

Swimming Pool Safety
• Revisions to a swimming pool, spa or public wading pool to
have:
• Minimum 2 circulation suction outlets per pump
• Separated minimum 3 feet between the suction outlets
• Application of new standards for antientrapment
covering
• Changes to DPH form to include if pool operates with
single or multiple suction outlets

Real Property: Blight
• Deletes the sunset date (Jan. 1, 2013) of existing law that
authorizes a civil fine for failure to maintain vacant
foreclosed residential property
• Provide a time frame (60 days) for a housing or building
department to issue a violation to the new owner
• Authorizes a court to require an owner to pay all
unrecovered costs associated with receivership

S.B. 1186 - Steinberg
Disability Access
• Requires an attorney to provide written advisory to a
building owner or tenant with each complaint for
construction related accessibility claim
• Requires notification that leased or rental property has been
inspected by a certified access specialist (CASp)
• Requires the State Architect to monitor fees charge for the
CASp program. Limits application fee for certification to
$250 for certain professionals
• State fee of $1.00 local business license or renewal January
1, 2013 to December 31, 2018

S.B. 1222 - Leno
Solar Energy: Permits
• Requires that permit fees for rooftop solar energy systems
not exceed the reasonable cost for the service provided
• Residential: Not to exceed $500 + $15/kW for each kW
>15kW
• Commercial: $1,000 + $7/kW for each kW 51kW to 250kW
• Plus: $1,000 + $5/kW for each kW >250kW

S.B. 1394 - Lowenthal
Carbon Monoxide and Smoke Detectors
• Permits issued on or after January 1, 2014 >$1,000 to include
the permittee to demonstrate that all smoke alarms required
for dwelling units are devices approved by the State Fire
Marshall
• Makes owners of certain multi-family dwelling complexes
and single-family rentals responsible for testing and
maintaining alarms
• Requires CO detectors in all existing hotel and motel
dwelling units by January 1, 2016. Standards by HCD impose
state-mandate local program
