The basic principles

• If the contracting entities don’t produce service as their own work, they are obliged to organize competition to buy service outside • Public procurements shall be maiden as advantageous as possible • the award of public contract should base either to the tender most economically advantageous for the contracting authorities or to the lowest price • the existing possibilities of competition shall be taken to advantage in contract procedures • the candidates and tenderers shall be treated an equal and impartial basis • collisions between principles cannot always avoid 27/04/2020 Tarja Aarla / Ministry of Trade and Industry

Planning helps to make good invitation to tender

• Planning part of PP procedure has not been regulated in PP directives • However the most important part • makes CA to thought i.e. how to produce certain service in future and what it is going to buy – which are necessary parts of service and which are not – is some service better to buy outside – or would it become cheaper to produce it by itself • Helps to formulate good invitations to tender • In Finland court praxis has shown that many of appeal procedures would have been avoided by good planning and drafting good invitation to tender 27/04/2020 Tarja Aarla / Ministry of Trade and Industry

Buying services – a challenge

• Service directive in force not until 1992 • No national legislation either before membership in EC • In Finland lots of services are produced by municipals • Lots of services have began to buy outside • Difficulties to define the subject matter of the contract • Planning and evaluation of own production is important • A good example - Finnish Road Administration – lots of own produce before – started to buy road maintenance services from private enterprises – Remarkable savings by competition 27/04/2020 Tarja Aarla / Ministry of Trade and Industry

Uncertainty - fields which need clarification
