Ordinance No. 122 (Version 5). Version 5
includes two minor changes from Version
4A approved on July 18, 2005.
• Board previously adopted Negative
Declaration on July 18, 2005.
• Board previously adopted Resolution
2005-06 amending fees on July 18, 2005.

Ordinance No. 122 Overview
• Revises Water Distribution System (WDS) rules
to create multi-level, impact-based system to
process permits; adds new pre-application step.
• More efficient and reduced cost process for
lower-impact applications; more extensive and
costly process for higher-impact applications.
• Impact based on parcel size, number and type;
potential water demand; proximity to Sensitive
Environmental Receptors (SER) and other wells.

• Staff recommends Version 5, including
Table 22-A (permit level review matrix).
• Version 5 adds text for accuracy and
clarity, and does not change adopted
CEQA conclusions.
• Version 5 changes are highlighted in red in
this presentation. (See Exhibit 8-A starting
on page 69).

Ordinance No. 122 Elements
• Rule 11 defines 10 new terms and revises
seven current definitions.
• Rule 20 is amended to allow exemptions
for specific criteria; sets a 10-year limit on
exemption to replace “inactive” well.
• Rule 20.4 enforcement procedures are
amended to apply to non-compliance with
permit conditions as well as operating
without a permit.

• Rule 21-A is amended to add preapplication step; proper terminology for a
licensed professional geologist is used.
• Rule 22-A is completely replaced with
multi-level, impact-based protocol for
Levels 1, 2, 3, and 4; relies on matrix table
to determine review level.

• When the General Manager becomes
aware that a water distribution system is
operating without a permit or is in
violation of current permit conditions,
particularly the system limits ….
• A procedure is followed, starting with
written notification to the system owners
and recipients of water from the
unpermitted or non-complying water
distribution system…

Rule 20.4 Changes, continued
• The system owner shall file an application
for a permit to create or amend a water
distribution system in accord with District
Rule 21 or take action in accordance with
District Rule 40 within 60 days of
notification.

Rule 21-A-9, “Qualified
Consultant” (pages 9-10 of Ordinance)
• The term “registered geologist” is replaced
by “licensed professional geologist,”
which is now used by the State.
• All specialists shall be certified, registered
or licensed by the State of California.
