1. CONSTITUTIONAL CONTEXT
NATIONAL GOVERNMENT MAIN ROLE
 Policy-making, regulation and oversight
 Set norms and standards and has overriding powers
 Administers exclusive national functions, e.g. civic functions,
justice, international relations, defence
 Shares certain functions with provinces (concurrency), e.g.
social services functions, education, housing, health, social
grants and welfare
 Others exclusive national whose functions have direct
bearing on municipalities, e.g. DWA, Energy, etc
 Major taxing powers – Revenue sharing model

PROVINCIAL GOVERNMENT MAIN ROLE
 Performs exclusive and concurrent functions with
National Government (schedule 4&5)
 Administers social services functions, e.g. education,
housing, health, welfare, etc
 Limited revenue raising powers (motor licences fees,
casino, horseracing taxes and hospital fees)
 Constitutionally charged with monitoring, support and
oversight responsibility over LG; and
 Intervening powers in municipal governance

 Represent, promote

and protect interest of local
government;
 Act as an employer body representing all municipal
members and by agreement, associate members;
 Lobby and advocate for members municipalities
 Act as resource for knowledge and information to
municipalities;
 Affiliate and participate in the affairs of regional,
continental and international organisation that will serve
interest of its members

COGTA PORTFOLIO & CONCURRENCY
 Not a direct service delivery portfolio;
 Departmental configurations at Provincial level uneven;
 Share a legislative and executive competence, e.g.
support and strengthen the capacity of municipalities;
 Coordination of intergovernmental relations (spheres
Nat. & Prov, sectors) efforts towards supporting
municipalities;
 Responsible for implementing similar priorities on LG,
e.g. LGTAS and managing LG institutional &
administrative systems

5. KEY CHALLENGES OF THE PORTFOLIO

Study on Provincial COGTA, done 2006/07
 Struggling to fulfil their support and oversight
role;(improvements differs from prov. to prov.)
 Across all provinces COGTA is seriously under-resourced;
 Prevailing structures and patterns of staffing do not match
increasingly complex mandate;
 Confusion and sometimes conflict between COGTA and
OTP;
 S139 has not provided practical basis for constructive
intervention;
 Land use is, at best patchy and under-resourced

 Poor consultation, coordination and joint planning
between National Cogta with Provincial counterparts;
 Few Provincial legislations passed on this portfolio;
 No alignment of National annual performance plan (APP)
with Provincial APP;
 Emerging protection of turfs – particularly around
implementation of national priorities relating to local
government;
 Poor collaboration and management of IGR both at
National and Provincial level;
 LGTAS provided basis for collaboration but has died down;

Conduct comprehensive study on the effective
management of the concurrent COGTA function in
relation to implementation of its mandate, covering the
following areas:
Norm and Standards for core functions, structure
budgetary implication;
Alignment of the Annual Performance Plans
Intergovernmental relations coordination responsibilities;
Skills audit and the required skills for the sectoral
responsibilities
Business case for resourcing the function both at National
and Provincial level
