Ia. The Legal Front (PRBoA Initiatives)
1) On 04 Nov 2009, the PRBoA filed its first (1st) Formal Complaint at
the Office of the Ombudsman Against former DPWH Sec. Ebdane,
2 incumbent DPWH Undersecretaries, the PICE and Atty. Vicente
Foz, publisher of the intercalated (falsely worded) version of P.D.
No. 1096 (1977 National Building Code of the Philippines/
NBCP);
2) The PRBoA is filing its second (2nd) Ombudsman Complaint
Against LGU Officials, PICE Chapters and CEs illegally practicing
the separate State-regulated profession of architecture in late
December 2009 or early January 2010; and
3) The PRBoA may file its third (3rd) case (a criminal complaint) vs. a
CE illegally practicing architecture.

Ib. The Legal Front
1) In October 2009, the UAP-IAPoA has apparently decided to await
the Supreme Court Decision (in say 3-4 years) in the civil case/
Petition filed at the RTC by the PICE vs. Sec. Ebdane with the UAP
(as Intervenor) re Secs. 302.3 & 4 of the 2004 Revised IRR of P.D.
No. 1096 (1977 NBCP) which provide that only RLAs can sign and
seal architectural plans and documents;
2) The Indirect Contempt Petition filed before the RTC by the PICE
vs. PRBoA Chairman Alli & a Past President of the UAP CamSur
may finally be decided before June 2010; and
3) A number of pending administrative and criminal cases against
civil engineers (CEs) charged with the illegal practice of
architecture are moving too slow (or are presently NOT moving).

Ic. The Legal Front (Recent Victories)
1) In May 2009, the Court finally ruled in favor of the registered and
licensed architects (RLAs) on the matter of the Motion for
Reconsideration filed by the PICE in March 2008 Against the
January 2008 Court Decision favoring the RLAs; the case is now
with the Court of Appeals;
2) Certain cases against DPWH officials in the Bicol Region have
been resolved in favor of RLAs;
3) RLAs in Cebu City have asked the LGU to implement the law;
4) In late October 2009, the DPWH has finally agreed to let the PRC
resolve the matter of inter-professional disputes, particularly on the
matter of the signing and sealing of building plans (including
architectural plans and dociments) filed as part of building permit
applications.

2a. Compliances and Issues Raised
1) There are now about twenty (20) registered
architectural firms (RAFs) under Sec. 37 of R.A.
No. 9266;
2) There are only two (2) foreign architects (FAs)
with Temporary/ Special Permits (TSPs) granted
under Sec. 38;
3) The UAP-IAPOA work on the Standards of
Professional Practice (SPP or the 1979 UAP
Documents) is still in progress;

2b. Compliances and Issues Raised
4) The UAP-IAPOA is now a continuing professional
education/ development (CPE/D) Provider; NO
CPE/D programs have been submitted by the
UAP-IAPOA since August 2009;
5) The structure of the UAPI-IAPOA has been
questioned by a PIA Member before the PRC;
PRC still to resolve the matter; and
6) The NON-drafting reformat of the LEA subject
on Architectural Design and Site Planning has
been requested for deferment by the CODHASP
before the PRC; PRC still to resolve the matter.

3a. The LEA and FLEA
1) NON-drafting Reformat of the Subject on Architectural Design
and Site Planning of the Licensure Examination for Architects
(LEAs) and the Foreign LEAs shall ALSO focus on compliances
with P.D. No. 1096 (1977 NBCP), R.A. No. 9514 (2008 FCP), P.D.
No. 957 (Subdivisions and Condominium), B.P. No. 220 (Socialized
Housing), B.P. No. 344 (Accessibility) and their respective IRRs
and the like; Code Searches and compliances precede architectural
plan preparation which precede architectural design preparation;
2) Reformatted Subject shall be multiple choice answer format (4
choices); ten (10) more sample questions from the Nov and Dec
FLEAs shall be posted at the PRBoA website by Dec 30 2009;
3) Reformatted Subject shall be multi-problem format (5 short
problems instead of 1 long problem); NOT to be posted at website;
4) Reformatted Subject shall still require non-graded sketching and
drawing (NOT drafting) to arrive at the required answers;

3b. The LEA and FLEA
5) Reformatted Subject shall assess only the objectively measurable
component of Architectural Design and Site Planning, which is
about the Examinees’ stock knowledge of the Architectural Plan
and Design Processes, NOT anymore of their subjective, training-/
experience-biased interpretations of the Design problem/s; it shall
NOT further attempt to assess the subjectively measurable
component of the Subject (results for which may be unreliable);
6) OPEN BOOKS for Rules VII and VIII [the main architectural
sections of the 2004 Revised IRR of P.D. No. 1096 (1977 NBCP)];
7) Shall be computer-checked to fully eliminate subjectivity, thereby
also fully complying with R.A. No. 9266 and R.A. No. 8981;
8) Have been successfully administered to 333 examinees in the
Foreign LEAs (FLEAs) for KSA, Qatar & UAE in Nov/Dec 2009;
9) Shall hopefully be administered by the PRC in the January 2010
Manila LEA with approx. 1,500 applicant-examinees (an all time
record for a January LEA).

4a. What Should be Next?
1) A working CPE/D Program that shall lead to the possible
issuance by the PRBoA of Architectural Specialization
Certificates and possibly of CHED-accredited Masteral
Degrees from partner schools;
2) More CPE/D Seminars and Workshops on P.D. No. 1096 (1977
NBCP), R.A. No. 9514 (2008 Fire Code of the Phils./ FCP), P.D.
No. 957 (Subdivisions and Condominium) , B.P. No. 220
(Socialized Housing), B.P. No. 344 (Accessibility), The Water Code,
Environmental Laws and their respective IRRs and the like to allow
RLAs a greater degree of appreciation of the laws that are the
primary LEGAL BASES for ALL ARCHITECTURAL PLANS
AND DOCUMENTS
3) Work for the eventual Repeal of P.D. No. 1096 (1977 NBCP);

4b. What Should be Next?
4) Be vigilant vs. civil engineer (CE) and other
proposals to repeal their professional regulatory
laws (PRLs);
5) Organize the RAFs into the 5th Other Association
of Architects (OAA);
6) Organize the alumni associations into the 6th
OAA;
7) A UAP-IAPOA Mentoring Program;
8) RLAs in active volunteerism thru BAC
Memberships at LGU and NG levels (under R.A.
No. 9184/ GPRA of 2003 and its 2009 IRR).
