equal to the value of the contract or other
instrument when a concern willfully seeks and
receives an award by misrepresentation. Ref:
13-CFR-121 for size regulations.
 Failure to update size information in ORCA and
SAM at least annually will no longer be identified
in the database.

JV’s without triggering size and affiliation.
 Changes formula for calculating the
limitations on subcontracting for services
contracts. A “similar situated entity” (same
socio-economic category as prime) is
considered in the 51% performed by SB
Prime.

Surety Bond Limits
 Raises the SBA guaranteed surety bond
limits from $2m to $6.5m, and $10m if
certified by Contracting Officer if required
for award.

Small Business Subcontracting
 Final Rule – implements provisions of
SB Jobs Act 2010 – Prime Contractor
must notify the KO in writing whenever
the prime contractor does not utilize a
SB sub used in preparing its bid or
proposal during contract performance.
