XIII FC Recommendations – Major issues referred
• The recommendations of the Thirteenth Finance
Commission are of far reaching significance for
strengthening local governance in India.
• The 13th FC referred to
– the growing urban population,
– shrinking fiscal space,
– increasing expenditure of ULBs,
– Below optimal level civic service delivery,
– dismal state of fire services,
– delays in transfer of Finance Commission grants to
local bodies,
– Lack of maintenance of accounts,
– LBs ‘slack attitude’ to get their accounts audited etc..
XIII Finance Commission - Allocations
• 13th FC substantially increased share of the local
bodies - both urban and rural.
Country:
• Allocated Rs. 87,519 crs –from Rs.25,000crs of 12FC
• For ULBs Rs. 23,111 crs- from Rs.5,000 crs of 12 FC

Rural:
Rs. 5226.55 Crs.,
Urban:Rs. 1918.85 Crs. from Rs. 375 Crs. in 12th FC.
Allocations of XIII FC – Reforms/Conditions to access
• Grants divided -General basic grants and General
Performance Grants
• Performance Grants can be accessed by only states
complied 9 conditions
• States are given one year 2010-11 to initiate & complete
legislative process and put in place institutional
arrangement to comply with the conditions.
• Performance grant is available from FY 2011-12
• Entitlement is only prospectively after complying with
conditions and not retrospectively.
• General Grant (1254.60) & Performance (664.25) for
ULBs for 5 yrs (2010-11 to 2014-15) allocated for AP..

•Basic Grants Rs. 1254.60 Crs will be released on furnishing of UCs for last releases
• Performance Grants Rs. 664.25 Crs on fulfillment of 9 specified conditions
by 31st March of FY 2010-11
• The 9 conditions stipulated by 13th FC can be considered as reforms to improve
financial status as well as governance of ULBs.
• Para 10.161 of Report – Performance grants can be accessed if 9 conditions are
complied by 31st March, of FY 2010-11.
Forfeiture of Performance Grants – 13th FC
• Performance grant is available from FY 2011-12
• Entitlement is only prospective after complying
with conditions
• Performance Grant of states failing to comply
with conditions would be forfeited.
• Forfeited amount would be distributed in the
following manner:
– 50% of amount to all, irrespective of compliance
– Remaining 50%, amount among the states which
complied with conditions.
Reforms/Conditions to access performance grants
The nine conditions stipulated by 13th FC are:
• Ist – a) introduction of a supplement to budget documents on ULBs; and
•
b) Accrual Based Accounting in ULBs
• 2nd- putting in place audit system in all local bodies;
• 3rd-establishment of an independent Local Body Ombudsmen System;

4th- electronic transfer of grants to ULBs in 5 days;
5th-prescribing qualifications to SFC members through an Act;
6th -empowering the ULBs to levy property tax without hindrance;
7th-constitution of State Property Tax Board;
8th-putting in place benchmarks for delivery of essential civic services; and
• 9th-putting in place Fire-hazard Response and Mitigation Plan.

Constitution of MAARC & MAACC
(G.O. Ms. No. 270, MA&UD (R),Dt. 15.07.11)
• A Municipal Accounts & Audit Reforms Cell (MAARC) is constituted to function in
the O/o DMA, AP Hyderabad , initially with the following Expertise and Support
staff: (a) 3 Senior Auditors/ Technicians (b) 3 Data Entry Operators (c) 1
Supervising Officer in the cadre of Audit officer/Asst Audit officer.
•
A Municipal Accounts & Audit Coordination Committee (MAACC) constituted with the
following officers/functionaries, which will meet 2nd Monday (next day, if it happens to be
holiday) of every month under chairmanship of DMA: a) Project Director, APMDP , b.
Director, Local Fund Audit , c. Addl. Director, O/o.DMA, d. Assistant Secretary , Finance(TFR)
– Member, UGE, APUFIDC. f. RDMA (Hyd)/Joint Director, (XIII FC), O/o DMA, g. Joint Director
(ULB Accounts) , O/o DMA, h. Deputy. Director, State Audit Department, i. Domain Expert
from M/s. CGG – Members and j. MIS Expert, APUFIDC/XIII FC Cell, O/o.C&DM – Member
Convenor.
The Committee will review the progress of (A) Accounts and Audit of ULBs ( B) Functioning of
Cell (MAARC) including issue of guidelines necessary for the Cell and consider & augment
the support and technical staff in the Cell as per future requirements (C) Strengthening&
Institutionalization of process initiated in this front and of all Accounting & Auditing
Reforms taken up in AP (D) other related issues (E) any other issue included by the DMA.
DEABAS – Background – merits & demerits
Demerits of present cash based accounting:
• Only receipts actually received are reflected in
accounts and receivables not known in accounts.
• Only payments actually made are reflected in
accounts and not payables .
• Represents only surplus / deficit in cash flow.
• Assets and liabilities are not reflected, and
• consequently, financial strength not reflected.
DEABAS – Background – merits & demerits
Benefits of Accrual Based Accounting System:
• Revenue is recognised as it is earned and that ‘income’ constitutes both
revenue received and receivable.
• Expenditure is recognised as and when the ‘liability’ for payment arises and
thus it constitutes both amount paid and payable
• Expenses are matched with the income earned in the year
• A distinct difference is maintained between items of ordinary nature and
capital nature
• Cost which are not charged are carried forward and kept under constant
review
• Surplus or deficit as shown at the year-end represents the correct financial
position.
• Presents true picture of financial position of the municipality and helps in
better financial management
• Assists in effective follow-up of receivables and payables.
• Facilitates the credit rating organisations to appraise the financial position
of municipality.

and adjusted, with in the stipulated time
framed under the new system.
The 1st instalments of grants Rs. 89.32 Crores
and 2nd Instalment of grants Rs. 87.17 for FY
2010-11 are sanctioned and released.

8. Municipal Administration and Urban
Development Department, has decided to
Operationalise Service Level Benchmarking in
all the ULBs of Andhra Pradesh with the
support of (ASCI), who are also acting as the
National Technical Support Unit (NTSU). A
session was held on 25.10.2010 with RDMAs
and Commissioners of bigger ULBs. The
required data sheets also procured from all
ULBs by 15.11.2010. Regional level
consultations and orientation workshops for
validating the data were conducted in Nov. –
Dec. 2010 and Jan 2011. After finalisation,
Proposals submitted by the Commissioner &
Director of Municipal Administration on SLBs
were notified in the State Gazette published in
the extraordinary issue of the State Gazette,
Dated 25.03.2011.
Now, the gaps in targets also obtained through
regional workshops for gezette publication.
Condition 8 : Standards for service delivery
• In the form of a declaration of a minimum level of
service for the indicators as per SLB Handbook of
MoUD.
• Level may be different for different municipalities.
• Commitments through a consultative process

9. Director of Fire services was requested to
prepare plans of Fire hazard response and
Mitigation in consultation with ULBs – GHMC
(Hyderabad), GVMC (Visakhapatnam) and VMC
(Vijayawada) and submitted plans. A workshop
was conducted on 28.12.2010. The revised
plans were received in First week of March
2011. The same are referred to ULBs
concerned for approval of Standing
Committees. After approval, the Proposals
were submitted to government vide Lr.Roc.No.
/13th FC/FHRMP/CDMA/2010 Dt.16-03-2011
for notification in state Gazette and the same
were approved and published in the
extraordinary issue of the State Gazette, Dated
25.03.2011

• Up dation of your action Plans/ADPs, progress of works
including tendering shall be done online in addition to sending
hard copy.
• User ID and Pass word is your ULB Name with First Letter as
Capital
• Follow the guidelines prescribed in G.O. Rt.No. 532, MA&UD
(R),Dt. 14.05.2010 for preparation and formulation ADPs for
every year including perspective plan for 13th FC period i.e., upto
2014-15.
• ADPs for next FY shall be submitted by end of March of
previous FY..
ROLE OF ULBs contd…
• Admissable Components for utilising 13th FC Funds are:
(G.O. Rt..No. 532, MA&UD (R), Dt. 14.05.2010 & G.O.Rt.No 1474 MA & UD Dept ,dt 24.12.2010 )
1. Integrated solid waste management under PPP mode excluding purchase
of equipment for collection and transport of garbage since the said equipment
has been purchased with 12th Finance Commission grants.
2. Town-wide sullage drain projects as per city sanitation plan covering
(1) Construction and interception of sullage outfall drains and treatment of
sullage (2) Establishment of STPs preferably on PPP mode
3. Service level Benchmarking (SLB)
4. DEABAS System - for improvement of Accrual based Accounting system in
all ULBs.
5. Gaps in water supply lines
6. Replacement of old pump sets

SANCTION OF ADPs/ACTION PLANS:
As per Para 8.1 & 8.2 of the guidelines of G.O. Rt.No. 532, MA&UD (R),Dt.

A Sanctioning and Monitoring Committee (SMC) under Chairmanship of
Secretary to Govt.. will accord approval for Annual Development Plans

In the recent review meeting Hon’ble Minister for Municipal Administration,
directed to Dist Collector to identify and alienate suitable site for Compost
Yard. Presently two sites have been identified which are under Court
litigations.
An extent of Ac 9.30 cents land has been identified in Sy.No.256/1,2 & 3,
257/3, 258/2, 261/2, 262/2 & 255/2 at Valasagunta Cheruvu in 12th Ward of
ULB limits.
Collector has inspected the site and proposal is rejected due to Hon’ble High
Court orders in WP No.2493/2006, dt.03.01.2007.
An amount of Rs.48.00 lakhs has been deposited to RDO, Elurru which was
sanctioned under TFC Gratns for alianation of land for Compost Yard.
An extent of Ac 1.91 cents of land is identified in Sy.No.334 at Nadamuru
Punta Road, Kovvur.
Draft Notification has been done and Rs.25.00 lakhs has been deposited in
favour to Revenue Divistional Officer, Kovvur. The Gazzette notification was
published vide Gazettee No.85m dated,14.12.2009. The Land acquisition
process is pending with RDO, Kovvur.

that “Status quo obtaining as on today shall be maintained for period of
weeks in respect of the lands under acquisition in the Sy.No.452/1.Acrs. 5.48
cts of Mulapalem village of Bapatla Mandal”. It is requested to take necessary
action in this matter.
The Collector has directed the MRO Chinnaganjam for alienation of land.
Accordingly 24.00 acres of Govt. land is identified and survey work is going
on. Alienation from the Collector is awaited.
Govt. land is not available.
MRO has issued No Land Certificate.
10.00 acres of private land identified at Reddycheruvu which is 4 KM away
from the Armoor and Rs.25.00 lakhs have been deposited to RDO.
Dumping is being done in low lying areas.

All the Commissioners of Mpl Corps (except GHMC) appointed as Additional Election
Authorities by the State Election Commission, to exercise such powers and to perform
such functions as may be assigned by the Election Authority/ District Election Authority and
to make necessary Administrative arrangements relating to conduct of Elections, by the
State Election Commission .

All the Municipal Commissioners of Municipalities appointed as Election Officers to perform
the functions and discharge the duties relating to conduct of ordinary elections by the
Election Authority & DMA.
•
All the District Election Authorities and District Collectors (except Hyderabad) were
authorized to appoint Additional Election Officers and Assistant Election Officers to
Municipalities under their jurisdiction as many number as required, by the Election
Authority.
•
All the RDOs / Sub Collectors appointed as Deputy District Election Authorities to perform
the functions and duties to be assigned by the District Election Authority in case of Mplts by
the State Election Commission.
PRELIMINARY ISSUES
• Fixing the strength of Mplts and Mpl Corps has been done
as per the Rules issued there under:
• Delimitation of wards: Re-division of Mplts / Mpl Corp into
ward has been initiated in 12 Mplts and 2 Mpl Corps where
ever upgraded and newly constituted as per the Rules
issued thereon, the following is the status:

IDENTIFICATON OF BC VOTERS
• For the purpose of reservation of seats / Offices

identification of BC Voters has been completed
in two phases (1st phase 85 Mplts + 10 Mpl Corp
& 2nd phase 20 Mplts + 6 Mpl Corp) as per the
programme given by the Government.
RESERVATION OF SEATS ( WARDS) IN Municipalities/Nagar
Panchayanths.

As per G.O.Ms.No.37 MA Dt.3.2.1995, the C&DMA will fix the no of seats
to be reserved for STs, SCs, BCs and women in case of Municipalities
and Nagarpanchayats.
After that, the District Collectors concerned as per the delegation made in
G.O.Ms.No.38 MA Dt.3.2.1995, will specify the wards to STs, SCs, BCs
and Women as per the guidelines issued in G.O.Ms.No.35 MA
Dt.3.2.1995.
As per the existing provisions of the APM Act, 1965 and Rules issued
there under reservation of seats (wards) shall be done by rotation for
every ordinary election. Accordingly the present ensuring elections are
the second cycle after delimitation of Mplts into wards taken up during the
year-2005 except those Mplts Upgraded recently for which will be the
first cycle, since delimitation is taking place.
Procedure for specifying seats to STs, SCs, BCs and Women based on
the fixation of seats by the C&DMA. Detailed guidelines are indicated in
Rule 6 to 12 of the AP Municipalities (Reservation of seats in Municipal
Councils and Nagarpanchayats) Rules, 1995 issued in G.O.Ms.no.35 MA
Dt.3.2.1995 as amended time to time.
RESERVATION OF SEATS (WARDS) IN
Municipal Corporations.
• As per G.O.Ms.No.44 MA Dt.3.2.1995, Government will
fix the no of seats to be reserved for STs, SCs, BCs and
women in case of Mpl Corps by issuing a notification in
the AP Gazette.
• After that, the Commissioner, Mpl Corp concerned will
submit draft proposals specifying the seats (wards) to
various categories STs, SCs, BCs and Women as per
the guidelines issued in G.O.Ms.No.44 MA Dt.3.2.1995
to the Government through DMA Office.
• Thereupon, Government will specify the wards to STs,
SCs, BCs and Women in the AP Gazette.
THE FOLLOWING ARE THE STEPS TO BE
TAKEN FOR SPECIFICATION OF WARDS.
I. Information on the following should be kept ready:

The entire process is divided into 5 STEPS which are as follows:
STEP 1: Specification of wards to ST’s
The first step shall be reservation of seats(s) for Scheduled Tribes.
Work out the ward wise ST population percentage i.e. total ST
population in ward to the total population in ward as per 2001
census.
Then arrange this percentage of ST population in descending order.
Strike off the wards allotted to STs during Ordinary Election-2005
from the list of the wards so arranged in descending order.
Then select the ward (s) having highest % of ST population as per the
number of seats fixed. Then, reserve 50% of seats to women of that
category where ever more than one seat is to be allotted based on
the highest total percentage of women population among the
reserved seats. If one seat is reserved to ST, this goes to ST
(GENERAL) only.
STEP 2: Specification of wards for SC’s
•
The second step shall be reservation of seats (s) for SC’s. Work out the
ward wise SC population percentage i.e. percentage of SC population in
ward to the total population in ward as per 2001 Census.
•
Then arrange the percentage of SC population in descending order. Then
after arranging the wards as explained above, remove from the list the
wards reserved for STs (done in first step) and strike off the wards already
reserved for SCs during Ordinary election-2005. The balance list will be the
list of wards for consideration for reservation for SCs.
•
Thereafter, as per the number of wards fixed for reservation for SCs, select
that many number of wards starting from first in the list of wards for
consideration arranged in descending order. Then, reserve 50% of seats to
women of that category where ever more than one seat is to be allotted
based on the highest total percentage of women population among the
reserved seats. If one seat is reserved for SC, goes to SC (General) only.
STEP 3 : Specification of wards fo BCs.
• The third step shall be reservation of seats for BCs. Work out
the ward wise BC voters percentage i.e., Total BC Voters in
the ward to the total voters in the ward as per survey
conducted recently. Then arrange the percentage of B.C.
voters in descending order.
• After arranging the wards as explained above, remove from
the list the wards reserved for STs and SCs (done in the first
and second step respectively) and strike off the wards
reserved to BC’s during ordinary elections-2005. Then the
balance list will be the list of wards for consideration for
reservation for BCs. Then, reserve 50% of seats to women of
that category where ever more than one seat is to be allotted
based on the highest total percentage of women population
among the reserved seats.
STEP4: Specification of wards to Women
(General).
• The fourth step shall be reservation of seats for women from
unreserved seats (General). Work out the ward wise Women
Population percentage i.e. Total women population in ward to the
total population in ward as per 2001 census.
• From the total list of wards, remove from the list the wards reserved
for STs, SCs and BCs (done in first, second and third steps
respectively) and strike off the wards already reserved for women
(G) during the Ordinary Election-2005.
• The balance list will be the list for “Unreserved wards” and this list
will be the list of wards for consideration for reservation for women
(General). Then arrange the percentage of women population in
descending order. Thereafter, as per the number of wards fixed for
reservation for women, select that many number of wards starting
from the first in the list arranged in descending order
STEPS 5 : Specification of wards to General.
• The fifth and final step shall be declaration of
unreserved seats – General the remaining wards
left after the above steps.
• Before issue of final notification by the District
Collector, a draft notification shall taken from the
Municipal Council calling for its views. Then the
District Collector shall publish the same in the
District Gazette and submit the same to the
Election Authority and Government.
Selection & appointment of polling personal
The SEC in its Circular No.2 No.393/SEC-F2/2011 Dt.23.6.2011 has issued instructions for
polling personal selection, appointment and training. The following are some important
points:
• Polling personal should be drawn from a Revenue Divisional other than one in which the
Mplty is located and other than Municipal Employees. Adequate number with 10% excess.
• The Presiding officer / Assistant Presiding Officer must be appointed from persons working
under Central / State Government holding the post not below the rank than that of
Superintendent.
• While selecting the polling personal (1) Employees having political leanings towards any
party or candidate (2) School teachers working as extra departmental post masters (3)
Pensioners (4) Teachers of private educational institutions should be avoided.
• The list of polling personal selected should be finalized with the approval of the District
Election Authority.
• The Municipal Commissioner should address all the heads of Offices to furnish the lists of
Employees working under them along with their Scale of Pay for payment of flat rates of
D.A and T.A for polling duty well in advance.
• The District Collector will decide the no of training classes required for the polling personal
selected. The SEC will depute ECIL personal to all the Districts for giving proper guidance
Setting up of Polling Stations
• SEC will issue time schedule for setting up
of polling stations in Mpltys and Mpl
Corps, thus the same may be followed
scrupulously.
Supply of statutory Forms and Covers for
Municipalities / NPs
• The Election Authority & DMA will supply
the required no of Forms and Covers to all
the Municipalities at an appropriate time.
Thus send a responsible Municipal
Employee to receive them.
ROs and AROs to be appointed. – Municipalities
/ Nagar Panchayaths.
• Particulars of ROs and AROs.
• The State Election Commission has called
for the lists of ROs, AROs in consultation
with the District Collectors in respect of 10

VISION
“The concept of clubbing or clustering of ULBs was adopted to make the
processing and final disposal (landfill) of waste as a viable activity”
• Govt. reconstituted both Technical Committee and State Level Official
Committee vide G.O.Rt.No. 122 M.A, Dated: 16.02.2001 to undertake
Techno Economic Assessment of bids received for Municipal Corporations
& Municipalities in the State.
• All ULBs grouped into 19 clusters vide G.O.Rt.No. 1464 M.A, Dt: 24.10.2005 for
management of MSW in ULBs.
•Govt. vide G.O.Ms.No.360 MA & UD, dt.14.05.2008 constituted “Solid Waste
Management Cell” to prepare guidelines and to monitor the programmes in
the ULBs for effective implementation of SWM.
• The Govt. vide G.O.Ms No. 10 M.A dt 4.1.2007 have appointed EPTRI as Technical
Consultant for MSW Management for the State of A.P. for giving
Professional/ Technical assistance for scrutinizing the bids received and
shortlisted by the Technical Committee and other issues.
• Govt. approved 5 WTE projects after recommendations of the Technical Committee
and State Level Official Committee covering 62 ULBs in 5 clusters

Norms for Staffing Pattern in various ULBs except

Significant increase in urban services to be provided to the increased urban
population from 125 lakhs in 1981 to 205 lakhs in 2001 where as there is no
increase in the staff in ULBs during this period.
During Last 15 years, 21 ULBs constituted from GPs, No staff sanctioned.
Entrustment of new functions ie., Urban Poverty Alleviation, Slum Improvement,
Welfare of Weaker Sections to ULBs in recent past.
Implementation of Urban Reforms in Property Tax, Accrual Based Double Entry
Accounting System, Engineering and Poverty Alleviation Schemes.
Implementation of Centrally sponsored schemes / External Aided Projects within
the time line fixed to have access for further release of funds.
Significant increase in financial transactions in ULBs -Municipal Revenue from Rs.
688.00 crores in 1994-95 to Rs. 3500.00 crores in 2008-09 & similar increase in
expenditure.
Need to improve quality of various services rendered by ULBs to meet the growing
aspirations of the Community – SLBs under 13th FC.
Need to improve governance due to RTI, CPL, PDL, IT, Citizens Charter etc..

At present, 23,209 employees including Public Heath and Non-Public Health
workers are working in all categories in all ULBs except GHMC, GVMC &VMC.
The Orders cover the posts from category of Commissioner to Bill Collector in 55
categories of posts only.
At present 5,115 employees are working in these categories.
The Orders do not cover the posts of Public Health and Non-Public Health Workers,
Attenders, Drivers, Record Assistants, other Class-IV employees in ULBs for the
reason that the requirements of these posts vary from ULB to ULB and also these
posts are also outsourced to a major extent.
Norms have been developed for sanction of posts in Administration, Revenue,
Public Health, Engineering and Town Planning sections based on population for
the reason that
population is the basis for provision of civic services in ULBs.
ULBs except GHMC have been classified into six categories based on population
for norms
Income has been taken as criteria for sanction of posts in accounts section of the
ULBs
