Immediately Reportable
Accidents and Injuries
• Mine operators are required to call The
New Mexico Emergency Operations
Center toll-free number at 1-866-7616039 and MSHA of an immediately
reportable accident. These phone calls
are required by NM State Statute and
Federal law.

• Mine operators must call immediately,
but no later than 15 minutes for MSHA
and 30 minutes for the NMEOC from
the time they know or should know that
an accident has occurred
Immediately Reportable
Accidents and Injuries are:
1. A death of an individual at a mine;
2. An injury to an individual at a mine
which has a reasonable potential to
cause death;
3. An entrapment of an individual for more
than thirty minutes or which has a
reasonable potential to cause death;
4. An unplanned inundation of a mine by a
liquid or gas;
5. An unplanned ignition or explosion of
gas or dust;

6. In underground mines, an unplanned
fire not extinguished within 10 minutes
of discovery; in surface mines and
surface areas of underground mines,
an unplanned fire not extinguished
within 30 minutes of discovery;
7. An unplanned ignition or explosion of
a blasting agent or an explosive;

8. An unplanned roof fall at or above the
anchorage zone in active workings
where roof bolts are in use; or, an
unplanned roof or rib fall in active
workings that impairs ventilation or
impedes passage;
9. A coal or rock outburst that causes
withdrawal of miners or which disrupts
regular mining activity for more than one
hour;

10. An unstable condition at an
impoundment, refuse pile, or culm bank
which requires emergency action in
order to prevent failure, or which causes
individuals to evacuate an area; or,
failure of an impoundment, refuse pile,
or culm bank;
11. Damage to hoisting equipment in a shaft
or slope which endangers an individual
or which interferes with use of the
equipment for more than thirty minutes;
and

death or bodily injury to an individual not
at the mine at the time the event occurs.

EMERGENCY ACTION PLAN
FOR
NEW MEXICO BUREAU OF MINE SAFETY
Plan for Code Red Entrapment or other emergency requiring activation of State wide
rescue resources.
1. NMT Emergency Operations Center (EOC) will contact SMI or other BMS
contact (representative).
2. SMI or representative (all other calls listed will be by the SMI or representative)
calls organization experiencing the emergency to verify details and make sure that
contact is maintained (get phone #’s for continued access). Be sure they have
contact information for state wide mine rescue team coordinators.
3. Call New Mexico State EOC @ (505) 476-9635 and describes the situation.
4. If SMI is Contacted, SMI calls Chris Hefner (505) 553-1535, and appraises him
of situation.
5. SMI or representative calls Underground Mine Rescue Teams Coordinators
(contact list attached) and describes the situation. Do not request teams to be
sent. This must be done by the mine representative from the mine experiencing
the emergency.
6. Call Governor’s office. Alarie Ray-Garcia, Deputy Director of Communications
(505) 231-7350 (c), and Sarah Cottrell, Energy & Environmental Policy Advisor,
(505) 699-7443 (c). Apprise them of the situation.
7. Call EMNRD Secretary Joanna Prukop (505) 476-3200 and NM Mining and
Minerals Director Bill Brancard, (505) 412-0317 (C), (505) 476-3405 (Office).
Apprise them of the situation.
8. Call MSHA field office (contact list attached). Be sure field office supervisor is
aware of the situation.
9. Call Amanda to cover BMS desk (505) 944-6141 (C).
10. Call Captain Randy Trujillo with Escondida NMSP substation.(575) 835-0741.
Describe situation, request road conditions, request any assistance to get to scene.
This also can be done through the NM EOC if special assistance is required
(helicopter).
11. Call organization experiencing emergency and reverify information. Ask if they
have called state wide mine rescue team coordinators.
12. SMI or representative proceeds to scene.
13. Make travel arrangements for mine rescue teams through NM EOC.
