Need for umbrella for existing & proposed energy
efficiency legislation (EPBD, Eco-design, CHP, etc).
Legal basis Art. 175 (1) Environmental Protection.

Promotes cost-effective energy efficiency with
targets, mechanisms, incentives, institutional,
financial & legal frameworks.
Market transformation-commercially viable market.
Develops market for energy services (energy/ tech).

Scope
Covers energy suppliers (distributors and/or
retailers) of: electricity, gas, district heating and
cooling, heating oil, coal, lignite, transport fuels,
forestry & agri. energy products & waste (may
exclude < 50 GWh/year).
End-use sectors include:
-domestic, agricultural, public and tertiary sectors
-non-energy intensive industries
-transport (excl. aviation and foreign shipping)

1 % annual overall target (Article 4):
- cumulative to 2012, max. 6 years (6-yr target instead?)
- target absolute & fixed for period, thus independent of GDP
- measures from 1991 may be included; (but 70´s & 80´s?)
-allows effects of information, energy advisors, improved
building codes, tax changes; (problem of double-counting! )
- annexes guidelines/methodology; examples; (Committee?)
- independent public sector bodies to oversee (exist!)
“white certificates”/energy efficiency later? (need M&V!)
Measurements : need clear and simple methodology: mixture
of top-down (adjusted intensity) & bottom-up?

1,5 % annual public sector target (Article 5):
- a sub-target of the overall 1 % target (PS=10%.)
- uses same methodology as overall target
- uses aggregated public procurement to increase
demand for energy efficiency & energy services

Obligation for some energy distribution and/or
retail energy sales companies (Article 6):
- to offer energy services or energy audits
(electricity, gas, district heating and heating oil)
Remove market barriers
- 5 % of customers not covered by services, free
energy audits (under discussion, could change!)
Information to public authorities to promote
energy services & energy efficiency

measures, ESCOs etc. allowed (Article 11).
Opens funds to all providers of energy services,
energy efficiency programmes & measures, without
prejudice to State Aid rules.
Energy audits (Article 12):
Member States to ensure the wide availability of
independent audit schemes.

Metering & informative billing (Article 13):
- Ensures accurate metering of net-bound energy,
actual consumption & time of use.
Ensures frequent & informative billing, more
information on benchmarks, available energy
services & measures. Branch organisations assist.

reactions. Concerned with targets & measurement.
M.S. can accept indicative targets; need definitions of
energy efficiency, energy services, simpler & more
harmonised measurement methods & schemes …
Importance & value of targets needs more explanation.
