WHAT IS ECSA?
• The Engineering Council of South Africa (ECSA) is a
statutory body established in terms of the
Engineering Profession Act, 2000 (Act No. 46 of
2000). ECSA's predecessor was established by
Engineering Profession of South Africa Act, 1990 (114 of
l990).
• Apart from administrative provisions, the principal focus
of the Act is aimed at promoting the safety, health
and interests of the public in relation to the
engineering work and Professional Conduct of
persons registered with ECSA.

ECSA’s MISSION
• "To ensure, through a co-operative process
of quality assurance,
that persons wishing to enter the profession
are educated and trained
according to widely accepted standards,
so as to be able to render
a professional service for the benefit of the
public and the country as a whole".

ECSA – STATUTORY FUNCTIONS
• Setting and auditing of academic standards
• Setting and auditing of professional development
standards
• Prescribing requirements for CPD
• Prescribing a Code of Conduct and Codes of Practice
• Identification of work of an engineering nature that
should be reserved for registered persons by the CBE
• Advising the CBE and Minister of Public Works on
matters relating to the engineering profession
• Recognition of professional associations
• Publication of a guideline tariff of fees for consulting
work

VOLUNTARY ASSOCIATIONS
• Voluntary Associations

Rules in terms of Section
– The Engineering Council of South Africa, has in terms of
section 36(1) of the Engineering Profession Act, 2000 (Act
46 of 2000) made the rules in relation to the recognition of
voluntary associations as contemplated in Sections 14(d)
and 25 of the Act.
• The following categories of voluntary associations are
hereby established:
– Category A
– Category B
– Category C

VOLUNTARY ASSOCIATIONS
Category A
Associations whose membership consists of natural
persons who, subject to the applicable provisions of Rule
4, are: –
• practising in any particular discipline or sub-discipline of
engineering; or
• practising in any particular category of registration
contemplated in section 18 of the Act.

VOLUNTARY ASSOCIATIONS
Category A and B
• The association must be governed by a formally
accepted constitution which –
– is not in conflict with the Constitution of the Republic of
South Africa;
– is not in conflict with the Act or any policies and rules of
the Council; and
– does not obligate its members to adhere to a code of
conduct, which is in conflict with the Council’s code of
professional conduct, or any applicable code of practice
published by the Council.

VOLUNTARY ASSOCIATIONS
Category A and B
•
The association must be of South African origin and
its governing body must be independent of direct
influence by any foreign body.
•
The association must adhere strictly to its
constitution, and be able to satisfy the Council of such
adherence.

VOLUNTARY ASSOCIATIONS
Category A
– The association must have as one of its core missions the
promotion of the interests of its members and the
engineering profession.
– The association must have at least 100 voting members,
who are in good standing with the association.
– A majority of its voting members must be registered
persons.

VOLUNTARY ASSOCIATIONS
Category A
If an association does not comply with this requirement, the Council
may condone such failure on condition that•
At the time of application, which may not be later than 30 June 2006, the
association must prove that at least 30% of its voting members are
registered persons; and that
By no later than 31December 2006, the association must prove that
at least 40% of its voting members are registered persons, and that
By no later than 31 December 2007, the association must prove that
majority of its voting members are registered persons.
A majority of the members of its governing body must be
registered persons.
