AGENCY FOR THE PREVENTION OF CORRUPTION AND COORDINATION OF THE FIGHT AGAINST CORRUPTION MEDIA INTEGRITY MATTERS Ljubljana 1/12/ 2014 RETROSPECTIVE Establishment The Parliamentary Assembly of Bosnia and Herzegovina adopted on 30 December 2009 the Law on the Agency for the Prevention of Corruption and Coordination of the Fight against Corruption. Status Independent and autonomous administrative organization, reporting about its operation to the Parliamentary Assembly of Bosnia and Herzegovina. Budget The funds required for the Agency’s operation are provided from the Budget. Management Management of the Agency was appointed in July 2011. RETROSPECTIVE Management of the Agency was appointed in July 2011 Rulebook on Internal organization has been adopted in July 2012 Agency has recruited first civil servants in April 2013 Development of the new Anti-corruption Strategy has started in March 2014 ORGANIZATIONAL STRUCTURE DIRECTOR DEPUTY DIRECTORS OFFICE OF DIRECTOR SECTOR FOR THE PREVENTION OF CORRUPTION SECTOR FOR ADMIN. SUPPORT SECTOR FOR THE COORDINATION PURPOSES OF THE AGENCY’S ESTABLISHMENT TO DETER PERSONS FROM COMMITTING CORRUPTION TO IDENTIFY AND ELIMINATE ANY CAUSES OF CORRUPTION PROMOTION OF A LEGAL FRAMEWORK FOR CORRUPTION PREVENTION TO RAISE PUBLIC AWARENESS TO ENCOURAGE THE CIVIL SOCIETY PARTICIPATION IN PREVENTING CORRUPTION TO EDUCATE THE SOCIETY ABOUT THE CAUSES AND EFFECTS OF CORRUPTION IMPACT TO PROMOTE TRANSPARENT AND ACCOUNTABLE OPERATION OF BH AUTHORITIES COMPETENCES OF THE AGENCY Develop the Anti-Corruption Strategy, and develop the Corruption Prevention Action Plan Coordinate and monitor the implementation of the Strategy and the Action Plan Coordinate the work of the public institutions in preventing corruption Monitor the instances of conflict of interest, provide recommendations for the strategy of managing the conflict of interest on a case-to-case basis, and issue the guidelines for the policy of managing the conflict of interest in government institutions Prescribe a uniform methodology for collection of the data about financial situation of public servants COMPETENCES OF THE AGENCY Take action upon receiving the reports on corruption Monitor the effects of laws and bylaws aimed at preventing corruption Cooperate with the national scientific and professional organizations, public media, and NGOs on the issue of corruption prevention Cooperate with international organizations, institutions, initiatives and bodies Develop educational programs on the issue of prevention of corruption and fight against corruption, and monitor their implementation Issue publications to inform the public about the corruption situation Prescribe a uniform methodology and guidelines for making integrity plans and providing assistance to all public institutions in their implementation PREVENTION OF CORRUPTION STRATEGY FOR THE FIGHT AGAINST CORRUPTION (2009-2014) ACTION PLAN 81 INTEGRITY PLANS (PUBLIC INSTITUTIONS) THE GUIDELINES FOR THE COOPERATION AGENCY – CSO WHISTLEBLOWER PROTECTION EDUCATION AND TRAINING MoU’s STRATEGY FOR THE FIGHT AGAINST CORRUPTION (2015-2019) By March 2014, the Agency has started the preparation for the Anti-corruption strategy of BiH 2015-2019. The development process of the new Strategy and Action Plan should be completed by December 2014. Until now, with the support of the Project, the Agency examined all relevant analysis’s on the implementation of the Strategy and Action Plan 2009-2014, recommendations of international organizations (in particular the EU and GRECO), anti-corruption conventions ratified by BH and Strategy and Action plans for transition countries in the region. In addition, research about the effects of the implementation of the current Strategy and Action Plan was conducted, recommendations for the work on the preparation of the new Strategy and Action Plan were created, analysis of the situation in the fight against corruption in BiH was prepared and a methodology for the preparation of the new Strategy and Action Plan was developed. Because of the need to involve local expertise in the new AC Strategy and Action Plan and to ensure local ownership of domestic institutions over these strategic anticorruption documents, a working group that will be a professional and consultative body to the Agency in the preparation process was established which is composed of representatives of 21 institutions from all levels of government in Bosnia and Herzegovina, as well as representatives of three non-governmental organizations active in this field.
