What to do when the learning environment is jeopardized?

A students fundamental right is the right to learn, and the College has a responsibility to provide protections, opportunities and environments that promote learning. The student, in turn, has responsibilities to other members of the Mott Community College community to refrain from interfering with the rights of others to learn, teach, and work.

Any student who commits any of the following acts of misconduct shall be subject to disciplinary action by the college. These regulations shall apply only where a student’s misconduct has adversely affected some college process or function or some other distinct and clear interest of the college as an academic community.

         Assault and Battery Weapons Drugs Alcoholic Beverages

Disruptive Behavior

Endangerment

Harassment

Discrimination Theft         Gambling Vandalism Soliciting Counterfeiting, Altering or Financial Irresponsibility Smoking Computer Misuse Academic Dishonesty Technology Usage

Disruptive Behavior: Intentionally or recklessly

interfering with normal college sponsored activities, including, but not limited to, studying, teaching, research, college administration, designated areas of activities, fire, security, or emergency services; or inciting others to commit disruptive behavior; and any unauthorized occupancy of Mott facilities or access to or from such facilities.

Harassment: Intimidation or harassment of another

student or staff member of the college, including but not limited to, sexual/racial harassment or threats, and may include verbal and/or physical actions. Intentionally making repeated telephone calls to or from the college with intent to annoy, threaten or harass another person. This includes stalking — following or appearing within the sight of another, approaching or confronting another individual in a public or private place, appearing at the work place or residence of another, entering or remaining on an individual’s property, contacting by telephone, or sending mail or electronic mail.

   Violation of Student Code of Conduct Incident Report (online)  Details, Details, Details  Name of witnesses Removal of Student  If misconduct warrants removal of a student from the classroom, call security at once (762-0222). Security officers will remove a student upon the oral request of the instructor.

Interim Suspension  The instructor will provide a report to the Code of Conduct Investigation Team as soon as possible. If suspension from additional class sessions seems warranted, the instructor may request that the Code of Conduct Investigation Team suspend the student on an interim basis. The Code of Conduct Investigation Team may suspend a student for an interim period pending disciplinary proceedings or medical evaluation, such interim suspension to become immediately effective without prior notice, whenever there is evidence that the continuing presence of the student on the college premises poses a substantial threat to the physical or emotional safety of any member of the college community or that any personal or public property is jeopardized.

    Investigation Charge Procedure  Pre-Hearing Conference Formal Hearing Procedure  Judicial Board (Appointed by the Executive Dean of Student Services) Appeal Process  Dean of Student Services – Right to due process; sufficient evidence; inconsistent or overly severe sanctions; new evidence.

If a student thinks that he/she has an academic concern and wishes to formally pursue resolution of that concern, the Academic Complaint Process shall be initiated within 45 calendar days of the cause of concern. The following outlines the complaint process;      Student contacts faculty member regarding concern in an attempt to resolve the matter.

If the concern remains unresolved, the student should contact and meet with the appropriate Dean before completing the Student Academic Complaint Form.

The Dean will attempt to resolve the concern informally with the student and faculty member.

If the concern remains unresolved after meeting with the Dean, and the student wishes to pursue the matter, the Student Academic Complaint form is to be completed within 10 business days and forwarded to the appropriate Dean.

Either party may appeal the written decision of the Dean by asking within 5 business days that the complaint be forwarded to the Vice President of Academic Affairs.

The entire formal procedure for student complaints against faculty and Student Academic Complaint Forms are available in division offices.

Sanctions applied.

Don’t let an incident “build up” without documenting.

Document and Detail.

Understand students rights and their rights to due process.

Seek advice from your Dean and/or colleagues.
