KEY EVENTS
EU: Schengen Convention – binding on the basis of the Accession Treaty
of the Republic of Lithuania to the EU.
Council of Europe: Convention (ETS No. 108);
Additional Protocol to the Convention (ETS No. 108).
Parliament: Law on Legal Protection of Personal Data, in compliance
with:
• Convention (ETS No. 108);
• Directive (95/46/EC).
Government: By the Governmental Resolution No 624 (year 2003) the
State Data Protection Inspectorate was assigned:
• as the institution responsible for the independent supervision of the
national Schengen information system.

INDEPENDENCE
• independent national supervisory authority under the Article 114 of the
Schengen Convention;
• individual line in the national budget of Lithuania;
• annually gives report on the activities to the Government.
• According to the Law on Legal Protection of Personal Data:
• is responsible for the supervision;
• discharging the functions shall be independent;
• state and municipal institutions, members of Parliament, other
officials, political parties, other legal and natural persons have no right
to exert any kind of pressure.
Interference with the activities of the Inspectorate shall render the
infringing party liable in accordance with law.

POWERS
Control activities apply to all personal data processing (including the police)
except the courts, intelligence services
To obtain all necessary information and get access to all data and documents
To draw up records about administrative offences
To give instructions to data controllers
To investigate the data subjects complaints
To cooperate with data protection authorities and EU bodies
