Students who return from any school to the public school of the residence
of his/her parents (or other persons with whom the student has resided
for at least six months) or a private school within that districts
boundaries shall receive a waiver of the transfer rule. Such transfer
without penalty will only be permitted once in a high school career.

Skin Infections
During weigh-ins, the coach presents the nurse
practitioner a hand written note stating a lesion
on the wrestler is not contagious. The nurse
practitioner determines the lesion is not
contagious and permits the wrestler to compete.
Is this the correct process that should be followed,
why or why not?
Answer
Yes, a nurse practitioner can be the “designated onsite appropriate health care provider” and they do
have the authority to allow a wrestler to compete
or not compete.
Transfer
St. Margaret and Mercy HS have merged for Boys
Soccer. A male soccer player who attended St.
Margaret’s transferred to Mercy without
corresponding change of address. Is he eligible to
compete on the merged Soccer team?
Answer
No, The student is subject to the transfer rule and
would be ineligible to compete in soccer without a
waiver of the transfer rule.
Age and Grade
A student enters 9th grade in 2009. They participate in
soccer in 9th – 12th grade. Students birthday is June
27, 1993. Was this student eligible as a 12th grader
and if not what are the consequences?
Answer
The student was not eligible in 12th grade because
he/she had turned 19 before July 1st. The team would
have to forfeit any game he/she participated.
Amateur
.A local golf club has offered to waive the $2500 junior
membership fee to an accomplished HS golfer. The
player will be entering his senior year in HS. Will his
eligibility be jeopardized by accepting this offer, why
or why not?
Answer
Yes, This would be a violation of the Amateur Rule. The
student would be capitalizing on his athletic fame.
Transfer
An out of district student attends Bradshaw HS and
participates in Field Hockey. In Spring transfer to a
private school. In the Fall transfer back to
Bradshaw HS and wants to participate on the cross
country team. Is she eligible, why or why not?
Answer
Yes, because she did not participate in cross country
the year prior to her transfer.
Practice
Football team practices Monday through Friday and
plays a game on Saturday during the regular
season. On Sunday the team meets for a team
dinner and the coach reviews a game ending drive
for the purpose of instruction. Is this a legal
activity, why or why not?
Answer
No, physical and/or instructional activities specific
to the sport on 7 consecutive days are prohibited.
Bona Fide Student
A GED student is taking 2.5 hours of instruction and
PE. In January, he received his GED diploma. He then
decided he wanted to finish the year and participate
on the track team. Is he eligible to participate, why or
why not?
Answer
If the student is enrolled in the school and is taking 3
classes plus physical education he would be eligible
for track, as long as he met all other eligibility
standards.
Scrimmage
Lincoln’s baseball team wants to scrimmage three other
teams. They will play round robin with each team
scrimmaging every other team. They will play 6 outs
per 1/2 inning and no umpires will be used. Is this a
permissible scrimmage, why or why not?
Answer
No, because you are only allowed to have two
scrimmages per day. Each school may be censored,
sanctioned, or placed on probation by the Section.
Transfer
A student a JFK has transferred to RFK to follow a
teacher that is going to teach the same 3 AP courses
at RFK. RFK has applied for an academic waiver so
the student may participate on the bowling team.
Should the waiver be granted, why or why not?
Answer
No, an academic waiver requires a combination of 3 AP,
IB, or college level courses not offered from the
sending school.
Transfer
Female athlete participated in tennis and track
during her freshman year. At the beginning of her
sophomore year she enrolls in a tennis academy. In
the Spring of her sophomore year, she enrolls back
into her public school and wants to participate in
track. Is she eligible? Junior year, why or why not?
Answer
She is eligible in her sophomore year with a District
of Residency Waiver but would be ineligible to
participate in her junior year.
Transfer
An out of district student swims for Praire View HS,
where her mom is a math teacher. Before her junior
year, the HS eliminates the swim program. She
decides to transfer to Sand Beach where her parents
reside. Is she eligible to swim at Sand Beach and if so,
how?
Answer
The new school would request a District of Residency
waiver of the transfer rule. Once the paper work is
filed she can begin to practice. Once the Section
approves the waiver she may compete.
All – Star Contests
A Girls Basketball team was eliminated from the
Sectional Tournament. The leading scorer
participated in the approved league all-star contest.
She then participated in the approved Section All-Star
Contest. Does this raise a red flag?
Answer
.Yes,
A student may only participate in one approved
all-star contest.
Concussion Management
A student is diagnosed with a concussion by a licensed
physician. Three days later the coach is presented with a
note from the student’s pediatrician stating that the
student is symptom free and cleared to resume full
participation. Can the coach accept this clearance and
allow full participation, why or why not?
Answer
No, according to SED the only person that can clear a
student back to full participation is the School Medical
Director. The school should also consider a
RTPP.
Conducting a Contest
Coaches vs. Cancer Football game. School will donate
gate revenues and $10 for every point scored during
the game. Players will wear pink arm bands during
the game. Is this event permissible, why or why not?
Answer
No, donations may not be made based on student
performance. Players may wear pink sweatbands on
the wrist extending no more than 3 inches toward the
elbow (NFHS).
Duration of Competition
A soccer player enters 9th grade in 2008. Student
sustains a serious injury requiring extensive
hospitalization missing the entire school year. In
2012, the school applies for an extension of eligibility.
Birth date is July 1, 1993. Does she qualify?
Answer
Yes, she would qualify for extension of eligibility
because her injury caused her to be physically
ineligible for interscholastic sports and need extra
semesters in order to graduate.
She will not violate the age rule.
Modified
A school and league have decided to use ability as a
criteria for organization of their 7th and 8th grade
basketball team. A much smaller school, who also
organizes by ability has 7th, 8th, and 9th graders and
would like to schedule a basketball game. Both AD’s
agree that the game would be safe and equitable. Can
these two teams compete, why or why not?
Answer
Yes, both schools have established the same criteria for
organization. Teams shall practice and compete only
against teams that use the same criteria for
organization.
Mixed Competition
The Girls Volleyball team in the State Championship
finals. Our coach has asked the Boys Volleyball team,
whose season is over, to come practice and scrimmage
with the team. Is this allowed, why or why not?
Answer
No, teams organized for one sex may only practice and
compete against teams of the same sex.
Overtime
Both our Boys and Girls Soccer teams played overtime
in the Sectional Finals. The girls won in sudden
victory during the first 10 minute overtime period.
The boys lost on penalty kicks after two 15 minute
overtime periods. Was the correct overtime period
used, why or why not?
Answer
The boys did use the correct procedure. The girls do not
have sudden victory. Must play two 10 minute
overtime periods.
Duration of Competition
5th year senior decides to go out for Varsity Basketball.
He turns 19 after July 1st. He only played basketball
in his Freshman year. Is he eligible to compete and if
not, does he qualify for an extension of eligibility.
Why or why not?
Answer
No, he is not eligible. He does not qualify for an
extension because there was no injury or illness
causing additional semesters in order to graduate.
There was never a loss of opportunity.
Promotion
A Varsity Softball team travels south to participate in
a sanctioned event. A S/C 8th grade student for
varsity softball, practices with the team but does
not play in any games. Is the student eligible to
practice? Will she be eligible to participate on the
modified team, why or why not?
Answer
She is eligible to practice and play with the Varsity
team because she was S/C. She will not be eligible
to participate on modified because she has
been promoted.
Scrimmages
Baseball team schedules 20 games. Team schedules a
scrimmage at the beginning of the season. Each
inning a different boy pitches and game uniforms
were not worn. Was this a scrimmage or contest?
What are the potential consequences?
Answer
It is considered a game because they did not use the
standards for a scrimmage for baseball. The team
could go over maximum number of games for the
season, which would make them ineligible.
Practice
A basketball team with 8th and 9th graders plays four 9
minute quarters with the 1st quarter being 8 minutes.
There are no 3 pointers counted. Our JV coach wants
to have the 9th graders scrimmage his team during
Christmas break. Is this allowed, why or why not?
Answer
No, since the freshman team is using modified rules
they are considered a modified program. Any
modified athlete that competes or practices against a
high school athlete has been promoted and cannot
return to the modified level.
Sportsmanship
Softball game played on Tuesday was suspended and
scheduled to resume on Friday. On Wednesday the
coach was disqualified from the game. Saturday is
the next regularly scheduled contest. When is she
eligible to coach?
Answer
The coach is ineligible to coach any interschool
competition until the completion of the next regularly
scheduled contest (Sat.). This includes the suspended
game on Friday.
Interstate Contest
Pineview HS hosts a wrestling tournament with schools
from PA. and NJ. The event has been properly
sanctioned. A last minute a non-member school
wrestler is added to the tournament. What are the
potential consequences for the athletes and host
school?
Answer
Any athlete that competes against the non-member
athlete may lose their eligibility for the remainder of
the sport season. The host school may be censored,
sanctioned or placed on probation by the Section.
Foreign Exchange
A foreign exchange student, not in an approved CSIET
program, wants to participate on the basketball team.
What steps should the AD take to determine her
eligibility?
Answer
Determine if the student has graduated. Then
determine the level of participation in home country
by using the list of questions found in the AD tool kit.
Selection Classification
Maple HS has merged with South HS for the sport of Ice
Hockey. Maple HS has an exceptional 8th grade Ice
Hockey player. Can the 8th grader go through S/C and
try-out for the merged team?
Answer
Yes, he will still be representing Maple HS and if he
makes the team he will have 5 years of eligibility in the
sport of Ice Hockey.
Penalties
A wrestler received a forfeit loss in the semifinals of a
regular season tournament due to the fact that the
match would have been his 6th of the day. What are
the consequences of the wrestler and team, if any?
Answer
Because a forfeit is a contest, the wrestler would be
ineligible, forfeiting all of his matches for the day. The
team would have to forfeit all of its points but the
other wrestlers individual results would stand. The
host school should not put students in this position
and could be censored, sanctioned or placed
on probation.
Practice
Boys Varsity Soccer coach announces in June that he
will be hosting school sponsored workouts on
Tuesday and Thursday during the summer for
anyone interested in attending. Does this comply
with NYSPHSAA rules and regulations, why or why
not?
Answer
Yes, school sponsored activities must be open to all
students and may not be mandated by the coaches.
Transfer
Talented point guard successfully completes S/C as a
7th and 8th grader playing JV and Varsity
respectively. Suspended for one year before 9th
grade year. Transfers to neighboring school. No
waiver was applied for. Is he eligible to compete in
basketball for new school, why or why not?
Answer
Yes, Transfer Rule does not begin until the entry into
9th grade.
Penalties
Athlete turns 19 on May 10th of junior year. In her senior
year she participates in 6 out 7 lacrosse games. The
team is 7-0 when they discover she is too old. What
happens to the athlete and the team?
Answer
The athlete is ineligible to practice or compete. The
team would forfeit the 6 games she participated in
and their record would now be 1-6.
