 What are major legal developments regarding educator evaluation systems since our December 2011 webinar?  What developments do you anticipate?

Student Growth in Tested Grades and Subjects

 How important is roster verification?

 Might states face challenges related to the instructional sensitivity of standardized exams? The validity of VAMs?  What are the implications of using last year’s VAM scores for the current year’s teacher evaluation?

 Are there legal implications if states want to measure status in addition to growth?

Student Growth in Non-Tested Grades and Subjects

 What are the legal ramifications for states that use data from standardized tests to evaluate teachers in non-tested grades and subjects?

 Might the comparability of Student Learning Objectives’ (SLOs’) rigor across classrooms in non-tested grades and subjects lead to legal challenges? What about the validity/reliability of teacher- or locally developed assessments?

 What are past or potential legal challenges related to the use of observation data in evaluation systems?  How can states mitigate challenges?

 What is the state’s legal exposure to challenges to locally-developed evaluation systems?

 How can a state provide greater legal cover for its LEAs as they design (where applicable), implement, and use new systems of educator evaluation?
