Application of the Uniform Code of Military
Justice (UCMJ) to Contractors in the Field
Section 552 of the John Warner National Defense Authorization Act for
Fiscal Year 2007 (Public Law #109-364) contains a provision that is
intended to address whether civilians accompanying an armed force in
the field can be tried in military tribunals. The provision states:
Paragraph (10) of Section 802(a) of Title 10, United States Code
(article 2(a) of the Uniform Code of Military Justice), is amended by
striking ‘war’ and inserting ‘declared war or a contingency
operation’.
In the past, the courts have interpreted the term ‘war’ to mean
only wars declared by Congress
This change applies UMCJ jurisdiction over persons accompanying
an armed force in the field both in time of declared war
and in a contingency operation.
