Rental Agreement & Addenda

Welcome to our new tenants! This presentation is a brief overview of some of the paperwork you are signing. It is not intended to cover every item in the Rental Agreement or Addenda, so please read everything you received and call or email us if you have any questions.

The contract you sign is legally binding, so read it carefully.

 Make sure that the address and description of the property are correct.

 We should have your correct telephone numbers and email address. You must notify us immediately of any changes in this information during the course of your tenancy. We also need information for an on island emergency contact and for a next of kin not living with you.

 The rent is due monthly on the

first day of each month

. If there is a grace period, it is noted on the Agreement.

Late fees

: We charge a late fee of 10% of the monthly rent if not received by the due date.

You must pay 1% a month additional on any rents over a month overdue. However, you are subject to eviction if any of your rent is overdue.

 We will hold a

security deposit

equal to one month’s rent in a trust account. It may

not

be used as the last month’s rent. The security deposit will be returned to you no later than 14 days after termination of the Rental Agreement, less any deductions for damages, past due rent or the like. The tenant(s) will

not

collect any interest earned by Young Hawaii Homes, Inc. on the security deposit.

 Make sure that the

Rental Term

is correct. The unit will be available for occupancy on the start date stated on the Agreement. If the unit is not available on that date, because the previous tenant is still moving or for any other reason, you will be notified.

You will only pay for those days that you are occupying the unit.

 A “

fixed rental agreement

” ends on a specific day with no notification required prior to vacating. We will contact you at least 30 days prior to the end date to inquire about your plans to either vacate or continue renting.

 If the “

Rental Extension

” box is checked, your fixed term will automatically convert to a Month-to-Month term on the end date. In this case, you must notify us at least 30 days prior to the end date if you are planning to leave at the end of the fixed term.

 With a

Month-to-Month

agreement, you must give us notice at least 28 days in advance that you are vacating the unit. This notification must be in writing to us. You may either write us a letter or use the form on our website.

Utilities

: You are responsible to set up and pay for any utilities checked on the Agreement.

Telephone numbers and website information is in our Addendum.

Keys

: We will provide you with all necessary keys. Let us know if you are missing any keys. You may make additional unit keys at your expense. You will need permission to obtain additional fobs and that is also at your expense.

Special Terms

: Please review all the terms. There is

no smoking

allowed in any of our units or as forbidden by law. There are

no pets

allowed, unless you have our written permission, have signed the

Pet Addendum

, have secured liability insurance naming Young Hawaii Homes, Inc. as “additional insured” and, after November 1, 2013, have paid the additional pet deposit.

Lead-Based Paint

: All tenants will receive the Lead-Based Paint pamphlet and sign the

Lead-Based Paint Disclosure

, even if their home was built after 1978. If we have any knowledge of lead paint in the unit, we will discuss it you.

House Rules

: If your unit has separate House Rules, they are included in your lease.

You must abide by all rules and will be responsible to pay any fines assessed by those governing entities.

Property Condition Form

: We will provide you with this form on check-in. You will be given 14 days to review the form and notify us of any discrepancies. This form will be compared to the condition of the unit when you vacate. You will be responsible for any damages to the unit caused by you or your guests.

Tenant Responsibilities

:  You may NOT make any alterations, including painting, without our written permission. If in doubt, please call us.

You are responsible, not only for your own conduct, but the conduct of your guests.

 A common complaint is

Renter’s Insurance

Maintenance

: Call us for any maintenance issues you may have. If you do not hear from the vendor within 5 days, please call us again. :  Please notify us of any prolonged absences of over 5 days.

 The unit is only to be used for residential purposes and may NOT be sublet. All tenants and their guests must abide by all federal, state and county laws and any house rules.

Change of Roommates

: We will charge $25.00 to add or delete roommates on the lease. We require a Rental Application of any new tenants. Departing tenants will NOT be released from the terms of the Rental Agreement, unless Landlord agrees in writing.

The departing tenant’s interest in the security deposit will transfer to the remaining tenants.

Lease Termination

: A fee of $200.00 will be charged if the full term of the lease is not completed.

The tenant is still responsible for rents until the end of the lease or until a new tenant can be found. If the tenant supplies Landlord with a suitable replacement, a Lease Take-Over fee of $100.00 will be assessed.

Quiet hours

are from 10:00 pm to 8:00 am. Please be considerate of your neighbors.

 If you do not know how to use something, please contact us. You are responsible for damages due to improper use.

The Addendum has information on maintenance and plumbing. Please read this.

 Notify us for all

repairs

. Tenants will be charged for any damages caused by them or their guests. Tenants will also be charged for unnecessary service calls, or extra service calls as a result of Tenant’s failure to keep appointments with repairmen.

Yard care

: If tenant is responsible for yard care, they must water as needed, keep plants and trees away from the house, and maintain yard in good condition.

Tenants will be responsible for any fines assessed for improper yard maintenance. Please contact us if tall trees or bushes need trimming.

Vehicles

: All vehicles must be licensed and insured and in good condition.

No

businesses of any kind are allowed on the premises.

Parking

is allowed ONLY in your assigned spot. There is NO parking allowed as prohibited by the governing association or by law.

Tenants are responsible for any parking violation fines or towing fees.

 Tenants are responsible for regular

. Notify Landlord if you notice unusual infestations or any signs of termite activity as detailed in the Addendum.

Satellite Dishes

: Prior written permission must be given and the

Satellite Dish Addendum

must be signed.

On vacating, the tenant must remove any equipment and restore Premises to its original condition.

Smoke Detectors

: The tenant is responsible for testing the smoke detectors at least once a month and changing the battery at least yearly. Notify the Landlord immediately if the smoke detector is not working or missing. Landlord does not warrant or take responsibility for the malfunction or failure of the smoke detector.

Alarms

: If your unit has a home alarm system, you are responsible to register it with the Honolulu Police Department and paying the fees. You are also responsible to pay the costs of any outside monitoring agency.

Maintenance:

 Call the office during regular business hours or email us to request general maintenance. If you do not hear from the vendor within 5 days, contact us again.

 You are responsible for any further damage caused by your failure to notify us of a needed repair.

 You are responsible for costs related to your failure to show for an appointment with the Vendor.

 You are responsible for any unnecessary service calls.

Check to make sure the fuse box or GFI’s haven’t tripped.

Check our website for common maintenance issues and possible solutions.

Check out:

 You must give us written notice of your intent to vacate the unit at least 28 days in advance. On your check out day, the unit must be completely vacated and cleaned. There will be a charge of $50.00/hour if we must wait for you to complete cleaning.

Check out (continued):

 Your rent is still due on the first of the month even if it is a prorated amount. Please call us to find out what your prorated rent will be.

 Do NOT terminate utility services prior to your check out.

 The Addendum gives you instructions on how to do the

cleaning

.

The exterior should be clean and all debris removed.

The interior should be clean and carpets professionally shampooed.

Don’t forget screens and windows, window coverings, light fixtures (make sure they are not hot), air conditioning and vent filters, baseboards, ledges over doors and outlet covers. We will charge you if there is an infestation of insects.

Flea treatments are required if you had an animal in the unit at any time.

 If you have any questions about cleaning, contact us first.

You are responsible for damages caused by cleaning improperly.

 Certain units have additional House, Association or Community Rules. These rules are required in order to maintain a peaceful environment with neighbors living in close quarters, or to preserve the look of an area.

 Tenants living within an area with House Rules need to be extra careful to abide by noise regulations and to keep the exterior of their properties in good condition.

 Please read all the House Rules and call us if you have any questions.

Parking

: Park only in your assigned parking spot.

Use extreme caution in parking lots. Observe all guest parking stall rules.

Refuse

: Securely tie all garbage in plastic bags before placing it in the trash receptacles. You will be responsible to clean up any spills caused by leakages.

Do not leave garbage where pests can access it. You are responsible to properly dispose of items such as car batteries, paint, combustible items and the like. Bulky items may only be placed out for collection on the night before the pick up dates. Check on pick up dates in your area.

 Barbecuing or other forms of open fires are prohibited on lanais, walkways, in units or anywhere else as stated in the house rules.

 Associations do not allow certain items to be stored in view of the general public. You must keep lanais, garages, yards, etc. cleared of these items. Personal items may not be stored in the common areas of multiunit buildings.

 You will be held responsible for any and all fines assessed for non-compliance with the House Rules.

 Some condominium units require you to reserve a move-in date.

Any fees charged by the Association are your responsibility.

Any damages caused to the Premises on check-in or check-out are your responsibility.

This was a lot for you to read, but we wanted to make sure that you understand the contract you are signing. This just covered the basics. We encourage you to read the entire contract and let us know if you have any questions.

We expect you to keep the home in good, clean condition, pay your rent on time, obey all house rules and respect your community and neighbors.
