What is Liability Insurance?

And why do I need it?

 Liability insurance protects you from claims or lawsuits claiming your legal responsibility for damage or injury caused by your negligent act(s). – Protection against negotiated settlement or court judgments.

– Pays for the cost of investigation and legal costs, including defense attorney fees. – Interest on judgments and other related costs.

What are

Examples:  Loss of control of aircraft, strikes another member or spectator, or vehicle.

 Inattention or error in takeoff or landing, aircraft strikes person or vehicle.  Helper injured by propeller when you accidentally hit the throttle.

Clubs and club officers are covered also!

 Premises liability, such as slip-and-fall due to defect in the premises, or bleacher collapse.

 Injury or damage caused by club activities.

 Claim or suit against a club officer alleging injury due to lack of safety enforcement or similar allegations of officer negligence .

Remember:

 AMA liability insurance is a liability the to coverage. That means that insured must be negligence legal legally liable before payment is offered to the injured party. due – This is not a voluntary payment coverage.

Special Feature Site Owner Coverage

 The $2,500,000 liability limit that applies to site owners applies per location (site), so the limit is available to the site owner at each insured site.

This means the site owner does not have to be concerned about sharing the limit with 2,500 other site owners.

The liability policy is excess coverage Why?

 Homeowners policy specifically insures you and is primary.

 Required by insurance company to keep premium cost down.

 Saves AMA and its members over $100,000 each year in insurance costs.

AMA uses the waiver on the membership application to deny coverage based on assumption of risk.

AMA has never denied a claim on the basis that an AMA member acknowledged that model flying posed risks

Death Benefit and Dismemberment Benefit

 Pays $10,000 to the estate of any AMA member whose death is a direct result from an accident involving modeling activity.

 Scheduled benefits for loss of eye, hand, foot, arm or leg.

Why is it excess of my own insurance? Why is the deductible $750?

 Excess of your own insurance is required by the insurance company.

 Reduces cost to AMA and its members.  Most members have group health insurance- either private or Medicare.

– No impact on their cost if they make a claim.

 Deductible increase allowed AMA to maintain the high limit.

Model Fire or Theft Coverage

     $1,000 limit per member per year.

$100 deductible.

Excess of homeowners or other insurance Covers fire damage while in a structure or vehicle.

Covers theft from a locked vehicle or structure.

– If evidence of forced entry and reported to police.

Model Fire or Theft Coverage

     Pays for material, components or kits only.

Only applies to model aircraft.

Does not insure your own labor.

Material, components or kit costs must be documented by receipts or verification from hobby shop or other supplier.

Must be for same or similar model.

Any serious incident needs to be reported as soon as possible.

Serious bodily injury accidents require a different line of action and MUST be reported to AMA right away !

What do you consider an emergency?

Injury requiring more than on-site first aid, such as transport to a medical facility by ambulance or private vehicle. Property Damage resulting a severe damage to a structure, or a timber or grass fire endangering persons or structures.

Medical Claims Procedure

 You will be provided with a claim report form to be completed and returned to AMA’s SSD.

 SSD then reports the claim to Chubb Insurance Company for handling.

Model Fire or Theft Claims

 You will be provided a claim report form to be completed and returned to AMA’s SSD.

 AMA will assign your claim to VeriClaim, an independent claim adjusting company, for handling.
