Establishes standards for commercial motor
vehicles ,their drivers, and truck and bus
companies involved in the interstate
transportation of passengers and cargo.
Responsible for monitoring and enforcing
compliance with regulations governing safety
and commerce.
Focus on safety and financial responsibility.
Applicability


Federal Motor Carrier Safety Regulations
apply to all employers, employees, and
commercial motor vehicles transporting
property and passengers in interstate
commerce.
Code of Federal Regulations Title 49, parts
40, 380, 382, 383, & 390-399.
Registration Requirement


Commercial vehicles transporting
passengers in interstate commerce must
be registered with FMCSA and have
appropriate identification markings.
The USDOT number is a unique identifier
used for collecting and monitoring safety
information.
Commercial Motor Vehicle




Any self-propelled or towed motor vehicle used
on a highway in interstate commerce to
transport passengers or property when:
Gross Vehicle Weight Rating > 10,001 lbs.
or, designed/used to transport > 8 passengers
(includes driver) for compensation,
or, designed/used to transport > 15 passengers
(including driver) and is not used to transport
passengers for compensation.
Passenger Carriers

“For hire” carriers



Compensated, directly or indirectly.
Service is generally available to the public at large.
Private motor carriers of passengers (PMCPs):


Business
Nonbusiness
Business PMCPs


Private transportation of passengers in the
furtherance of a commercial purpose.
Transportation of employees; professional
musicians on tour.
Non-Business PMPCs


Provide private passenger transportation
that is not in the furtherance of a
commercial purpose.
Examples: Churches, scout groups, senior
centers, and other like-type organizations.

Transportation provided by Federal, State,
and local governments are exempt.
School bus operations.
Transport of sick and injured people
(emergency services).
New Rule On Small Carriers



Rule change effective 2/1/2010 impacts 915 passenger carriers who are directly
compensated and operating within 75 airmiles.
Now subject to same regulations of those
operating beyond the 75 air-mile radius.
Must comply with Parts 390, 391, 392,
393, 395, and 396.
Other Small Carrier Group




Not operated for direct compensation.
Not otherwise defined as a commercial
vehicle.
Registered and marked according to
FMCSA requirements. (390.21(a)&(b)
Also subject to 390.15 (Investigations)
and 390.19 (Reporting).
New-Entrant Program


All first-time applicants for a USDOT
number will be enrolled in FMSCA
Safety Assurance Program.
Requires applicant to pass a safety
audit and maintain acceptable safety
performance over initial 18-month
period.

Police and the Arkansas Division, Federal
Motor Carrier Administration.
