appears that the unlawful combination or disaster has progressed
beyond the control of the civil authorities to notify the Governor; and

Public officials can be sued personally for their
activities on behalf of the municipality. Generally,
public officials are indemnified for their official
activities by state law. The municipality is
required to defend and pay any claims brought
against the public official, unless the public
official commits an act that is outside the scope
of official responsibilities or where the activities
are committed intentionally, with knowledge of
wrongdoing.
