formal advertising

Excludes “maintenance” work which is routine,
recurring and usual work for the preservation,
protection and keeping of any publicly owned or
publicly operated facility.
Public Project Defined: Public Contract
Code Section 22002(c): "Public project"
means any of the following:
(1) Construction, reconstruction, erection, alteration,
renovation, improvement, demolition, and repair work
involving any publicly owned, leased, or operated facility.
(2) Painting or repainting of any publicly owned, leased, or
operated facility.
(3) In the case of a publicly owned utility system, "public
project" shall include only the construction, erection,
improvement, or repair of dams, reservoirs, power plants,
and electrical transmission lines of 230,000 volts and
higher.

Contractor Requirements
• Valid California Contractors License
– The prime contractor and all of its
subcontractors must hold valid California
Contractors licenses for the trades
performed
– License Classifications can be found at
http://www.cslb.ca.gov/
• Must comply with all requirements imposed by
the Department of Industrial Relations (DIR)
regarding Labor Compliance including:
– Payment of Prevailing Wages rates
– Holiday and Overtime Pay
– Employment of Apprentices

• Must be able to obtain minimum insurance
coverages as required by the District including
General Liability, Automobile, Workers
Compensation.
– For certain projects, Builders All-Risk
insurance may also be required
– For most projects, a minimum A. M. Best
rating of “A-“ and a minimum financial size
category of “VII” is required

• Responsible and Responsive Bidder
– Properly licensed to perform work
– Bid Security Bond requirements
– Performance Bond requirements
– Labor and Materials Bond requirements
– Insurance requirements
– Non-collusion Affidavit
– Drug-Free Workplace
– List of Subcontractors- for each subcontractor
who will perform work or labor or render
service in or about the construction of the work
in excess of 1/2 of 1% of the prime contractors
total bid, Public Contract Code Section
4104(a).

• Submit quotes directly to the list of potential prime
contractors for the work
• Must be properly licenses for the trade work
performed
• Must have proper insurance coverage
• Subcontractors Rights
• Substitution of Listed Subcontractor
• 20-day Preliminary Lien Notices
