Reevaluation

 Is specified in IDEA 2004 – (P.L. 108-446 of 2004)  Section 614. “Evaluations, Eligibility Determinations, IEPs and Educational Placements  Michigan Law no longer has the 3 Year Reevaluation rule as before 2

When Are Re-evaluations Done?

    When District determines it is needed by: – Educational or related service needs, including – Improved achievement and functional performance of student When requested by: – Child’s Parent, or Teacher At least once every 3 years Not more than once/year unless agreed upon 3

Before a Reevaluation

 An Evaluation Review Team (ERT) is established to:  Review student data already available  Discuss and answers specific questions  Determine an Evaluation Review Plan  Get signed agreement from parents 4

Who Participates on ER Team

   The IEP Team: – Student (when appropriate) – Parents – District Rep/Designee – General Education Teacher – Special Ed Teacher/Related Service Provider – Person who can explain instructional implications of evaluation results Other Qualified Professionals ER process does not have to be a meeting 5

What’s Reviewed To Plan for Reevaluation

   At Least: – Evaluations/Information provided by Parent – Current Classroom-based Assessments and Observations – Local or State Assessment Data Other Existing Data Optional: Description of Data Reviewed 7

Key Planning Points

   Initial Evaluations still require Michigan MET Procedures.

Evaluation Review Form Requires: – Description of Additional Data needed – If No Additional Data is needed, indicate NONE for each discussion item Then….assessments and other evaluations are administered to get data needed 8

The ER Team Recommends One Item at a Time…  What additional data is needed to determine: – Whether Child Is/Continues with a Disability – Child’s Educational Needs – Child’s Present Levels of Academic Performance and Related Developmental Needs – And……..

 Whether any additions or modifications to special education and related services are needed… – To meet the measurable annual goals of the IEP and… – To participate in the general curriculum (as appropriate) 10

 Also Suggested that: – ER Team sets anticipated completion date of any recommended assessments.

If NO New Data is Needed

 Record rationale for ER team decision  Signed Parent Consent is required even if no further assessments are needed  Highlight Parent right to request assessment 12

Signed Parent Consent

   Initial Evaluations (if ER is appropriate): – Parent signs Evaluation Review Form AND Initial Evaluation Consent Form Reevaluations (ER is required): – Parent signs Evaluation Review Form, even if the plan calls for NO assessments.

Temporary Placement Evaluation (Best Practice): – Parent signs Evaluation Review Form AND the Prior Enrollment in Special Education Form 13

Parent Consent for Re-evaluation is Not Needed When…  District reasonably tried to get consent, but  Parent failed to respond  Clearly document efforts to get parent consent 14

  • Right of parent to request assessments, however … – District is not required to do assessments unless asked by parents.

Copy of Parent Rights and Due Process:   Short or Long Version Indication that MET is required for Initial IEP, Change of Impairment, or Parent Request 15

Q:Must district notify parent if the Evaluation Review determines that no further testing is needed?

A: YES. The district must inform the parent about that determination and the reasons for it, and about the parent’s right to request a reevaluation to determine whether the student continues to be a student with a disability. Federal Authority: 34 CFR § 300.305 18

Q: Is an Evaluation Review required for an initial evaluation?

A: NO. An Evaluation Review is optional, but may be used “as appropriate” for an initial evaluation. Federal Authority: 34 CFR § 300.305

Q: What is the exact date that "resets the clock” on a reevaluation?

A: An evaluation review or reevaluation date does not set or reset the clock. The 36-month "clock" resets on the date of the Reevaluation IEP. Federal Authority: 34 CFR § 300.305

Q: Must district always complete an evaluation by a MET when an IEP determines that student is no longer eligible for special education?

A: NO. An Evaluation Review is not required prior to graduation with a regular high school diploma or when student exceeds the age of eligibility. If student is exiting from special education programs & services, but continuing in general education, an evaluation by a MET is required if determined necessary by the Evaluation Review, or if the parent requests a reevaluation of the disability. Federal Authority: 34 CFR § 300.305

Q: Is there a minimum timeline between when the Evaluation Review is completed and the completion of reevaluation IEP?

A: NO. A Timeline is not mentioned in IDEA Federal Authority: 34 CFR § 300.305

Q: When considering a change of disability can Evaluation Review determine that an evaluation by a MET is not required?

A: NO. To change the disability of a student an evaluation by a MET is required as defined in Michigan Rules 340.1705 340.1716 applicable to the disability.
