The FLSA is the principal federal statute
that impacts the design of compensation
programs
Primary objective of the FLSA in 1938 was
workers’ rights



Eliminate detrimental working conditions
Establish a minimum wage rate
Protect the educational opportunities of youth

Hours of Work
 In order to implement its minimum wage and
overtime provisions, the FLSA had to define the
work hour for which payment is due.

Definition: All time which the employer requires,
permits, or allows an employee to work.

Non-exempt employees must be paid straight time
per hour for work performed up to and including
40 hours per week.

An employee cannot waive FLSA rights
Rate for overtime or compensatory time

1 ½ times regular rate over 40 hours. As
approved by the Board, Pinellas County uses a
blended rate provided under FLSA guidelines
when an employee works two or more jobs at
different rates.





Must be approved in advance by
director/supervisor.
Hours worked over the normal work week schedule
up to and including forty (40) hours will be taken on
an "hour-for-hour" basis. Hours worked over forty
(40) in a work week must be taken at 1-1/2 hours
for each hour of overtime worked.
Tracked using the TERMS system and entered by
the person responsible for departmental payroll.

Employees can accrue 240 hours of compensatory time —
160 hours of overtime
Requested use of compensatory time shall be permitted as
long as the time does not “unduly disrupt” operations at
the principal/administrator discretion

Must be used within six months from the time earned
•
No “use it or lose it”
•
Used comp time is documented on the Certificate of
Absence form (PCS Form 3-135)

NON-District Personnel
 Must be fingerprinted and processed three weeks prior to
starting work by Specialized Hiring / Human Resources
ALL Contracted Service Employees
 CSE Binder must be completed fully and submitted three weeks
prior to start of the job
 Indicate total hours to work. Hours per week cannot exceed
27.5 hours
 CSE Payment Form may be submitted monthly - after time
worked or at the end of the program (if employee was initially
notified that payment would be at end of project).




One individual per form
Fill in all areas – include months and hours worked
Job Number off original CSE Binder and appropriate signatures
Submit to Mickey in Payroll

Upon final applicant decision send a recommendation Form (32678) and complete Part-Time Hourly Action Form (3-3127) to
