Italy has implemented Council Framework Decision 2005/214/JHA on the application of the
principle of mutual recognition to financial penalties, by Legislative decree no. 37 of 15 February
2016, in force since 27 March 2016.

Declarations under Council Framework Decision 2005/214/JHA of 24 February 2005 on the
application of the principle of mutual recognition to financial penalties
Article 2 § 1 - Competent Authorities
Issuing Authority: Public Prosecutor at the Court of first instance which issued the decision on the
financial penalties or within which jurisdiction is the seat of the administrative authority which
decided about the administrative penalty (see attached list).
Authorities competent for enforcement: Prosecutor General at the Court of Appeal within which
jurisdiction the sentenced person has property or income, or normally resides and lives or, in the
case of a legal person, has its registered seat when the measure decision is transmitted from abroad.
The decision on the recognition of the decision is made by the Court of Appeal having jurisdiction
as specified above. Jurisdiction for the enforcement is exercised by the Prosecutor General at that
Court of Appeal.
